STAFF REPORT

Subject: Assumption of Services - Kamfai Developments Ltd. and Jondan Investments Limited - Registered Plan 66M-2293 - East side of Markham Road, South of McLevin Avenue

(Ward 16 - Scarborough Highland Creek)

Purpose:

This report requests Council's authority for the City to assume the services with respect to the above subidivision.

Financial Implications and Impact Statement:

No financial implications.

Recommendations:

It is recommended that:

(1) the services installed for Registered Plan 66M-2293 be assumed and that the City formally assume the roads within the Plan of Subdivision; and

(2) the Legal Services Department be authorized to release the performance guarantee in the form of a Letter of Credit, subject to the receipt of a cash deposit from the developers in the amount of $13,500.00 as set out in the attached report; and

(3) the City Clerk and Treasurer be authorized to sign any release or other documentation necessary to give effect thereto.

Background:

Kamfai Developments Ltd. and Jondan Investments Limited (the "Owners") entered into a Subdivision Agreement dated August 25, 1994 with The Corporation of the City of Scarborough. All obligations of the Subdivision Agreement have been completed, all relevant City departments have signed the Development Acceptance form and it is now appropriate for the City to assume the services and release the performance guarantee subject to the following:

(1) A cash payment in the amount of $13,500.00 to be used by the City for tree planting purposes as requested by Recreation, Parks and Culture Department.

After the Subdivision Agreement was executed, changes were made to the noise abatement measures. An Amending Agreement was prepared to reflect the measures in place and approved by the Planning Department. Due to a dispute between the two original owners of the land, the Amending Agreement has never been executed. All departments, however, are satisfied that the provisions of the Amending Agreement have been satisfied.

Comments:

Not Applicable.

Conclusions:

It is now in order for the City to assume the services and formally assume the roads therein and for Legal Services to authorize the release of the Letter of Credit subject to the above recommendations.
