Subject: Stopping up and closing part of original Road Allowance
between Lots 6 and 7 Concession 2, Scarborough
(Dean Park Road)
Ward 16 - Scarborough Highland Creek
Purpose:
To secure authority to stop up and close part of an original road allowance in conformity with a former City of
Scarborough subdivision agreement.
Funding Sources, Financial Implications and Impact Statement:
None.
Recommendations:
It is recommended that:
(1) the portion of the original Dean Park Road Allowance as shown on the attached Schedule "A" be stopped up and
closed;
(2) notice be given of the City's intent to dispose of the lands by conveying them to the adjoining property owner for $1.00
subject to the purchaser paying the costs associated with advertising the closing; and
(3) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.
Background:
In 1995, the former City of Scarborough Council approved an application from Arrowdale Developments Ltd., Arrowdale
in Trust and Loring Developments Ltd., to amend the zoning by-law and approved a draft plan of subdivision for the
development of lands on the west side of Dean Park Road in the 401/Meadowvale area of Scarborough. A condition of the
subsequent subdivision agreement required the subdivision owners to make satisfactory arrangements with the City
regarding the closure and acquisition from the City, of a portion of the original Dean Park Road Allowance. This portion of
original road allowance is to be incorporated with lots 150 and 151 of the draft plan of subdivision. The parcel to be
incorporated with the two lots has an area of 26.312 square metres (283 square feet).
Comments:
To comply with the conditions of the subdivision agreement it is necessary to first stop up and close the remnant portion of
the road allowance, declare it surplus and give notice of the City's intent to dispose of same. A portion of Dean Park Road
immediately to the north has been realigned through the approval and development of another subdivision. Conveyance of
this remnant parcel for nominal consideration is recommended as the road allowance has already been replaced to the east.
The subdivider will bear the cost of advertising the road closing.
Conclusion:
Closing and disposing of this portion of the original road allowance will complete the subdivider's obligations relative to
this section of the subdivision agreement.
