Subject: Tree Removal on Private Property, North Star Developments, Formerly Known as Reznick Construction, on the North Side of Lawrence Ave, West of Megan Avenue

Purpose:

In accordance with By-law # 25150, being a by-law for the protection and conservation of trees, adopted by Council on June 24, 1997, to inform the Community Council of the removal of private trees within Subdivision T84021, by applicant Frank Dodaro, on the north side of Lawrence Avenue, west of Megan Avenue.

Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendations:

It is recommended that:

(1) permission be granted for the applicant to remove eight (8) trees that meet the criteria of Scarborough's Tree Conservation Bylaw #25150 located within the proposed scope of work, and that a minimum of thirty new trees, each with an 80 mm diameter be planted on the boulevard as replacements.

Background:

On June 24, 1997, the former City of Scarborough passed its Tree Protection and Conservation By-law No. 25150 to help preserve significant trees on private property. Under the by-law, a permit is required to injure, destroy or otherwise cause damage to any tree having a 30 cm diameter or more measured at a height of 1.4 metres above ground level. Council approved the draft plan of subdivision on September 16, 1997, and has already considered the application for permission to cut the trees and deferred the decision to issue or deny a permit for the removal of the trees until such time that the grading plans have been reviewed in concert with the tree preservation plans.

Comments:

In order for the residential subdivision to proceed, the trees must be removed. The developer has agreed to plant a minimum of 30 large caliper street trees, each with an 80 mm diameter trunk and to post a letter of Credit in the amount of $10,000 for a period of two (2) years. Tree Preservation Methodology to protect over 70 trees on the subject site or on the adjacent properties has been prepared and will be implemented prior to ground breaking (Attachment No. 1).

Conclusions:

Many of the existing trees on this site are undesirable species. A good number are in poor to fair condition. Proposed grade changes require an additional rise in elevation of between 1 - 2 metres. The Developer has agreed to move the location of the required swales and catchbasins in order to minimize the impact on the over 70 trees that are being preserved. Once the Development has been completed, a minimum of 30 street trees, each with an 80 mm diameter trunk will be planted.
