Subject: Proposed Turn Prohibition at Private Driveway at 8119 Sheppard Avenue East, Just East of Morningside Avenue

Scarborough Malvern

Purpose:

To report on the terms of permit issuance as it relates to access restrictions and internal circulation at a new Tim Horton's drive-through facility on the south side of Sheppard Avenue, approximately 140 metres east of Morningside Avenue.

Financial Implications and Impact Statement:

The developers, 574780 Ontario Limited, are responsible for the cost of signing the turn prohibition and "Do Not Enter" regulations under the terms of issuance of their development permit.

Recommendations:

It is recommended that:

(1) the driveway on the south side of Sheppard Avenue East, approximately 140 metres east of Morningside Avenue, operate as an exit only, with westbound left turns and eastbound right turns prohibited at all times, as identified in Appendix 1 of this report;

(2) all costs associated with signing the eastbound and westbound turn prohibitions and "Do Not Enter" condition at the driveway be borne by the developers of the property serviced by the driveway, namely 574780 Ontario Limited; and

(3) the appropriate by-law be amended accordingly.

Background:

As a condition of permit issuance, developers have agreed to the imposition of an eastbound right-turn prohibition and a westbound left-turn prohibition at all times at their easterly driveway on Sheppard Avenue East, approximately 140 metres east of Morningside Avenue, at their cost, which is estimated to be $1,600.00.

Comments:

574780 Ontario Limited applied for a permit for a Tim Horton's establishment, including a drive-through service, on the south side of Sheppard Avenue East just east of Morningside Avenue. The property will be serviced by two driveways, one approximately 60 metres east of Morningside Avenue, which will be a full-movements driveway, and the other approximately 140 metres east of Morningside Avenue, which is the subject of this report.

Because the queuing of cars at the drive-through window could extend close to the easterly driveway and internal site traffic aisle, which could result in periodic obstructions of the internal traffic aisle close to the driveway, it is prudent to design the site access and circulation so that this design feature cannot impact traffic operations and safety on Sheppard Avenue East.

In order to maintain safe traffic operations on Sheppard Avenue East, the subject driveway should operate as an exit only. Therefore eastbound right-turn and westbound left-turn manoeuvres should be prohibited at all times so this driveway can be signed "Do Not Enter".



As a condition of approving the development application and public access to this site, staff recommended and the developers agreed to the imposition of the aforementioned exit only operation at the easterly driveway. Motorists wishing to enter the site will be able to use the westerly driveway and motorists making a westbound left turn will have the advantage of turning from a westbound left-turn lane on Sheppard Avenue East.

Conclusions:

As a condition of permit approval, and in order to protect public safety, the developers of a Tim Horton's establishment on the south side of Sheppard Avenue East agreed to the installation of an exit only operation, in effect at all times, at their easterly driveway approximately 140 metres east of Morningside Avenue.
