Purpose:

The application is for a Zoning By-law amendment to lift the Holding "H" designation from the lands so that they may be developed for Neighbourhood Commercial uses

Recommendations:

It is recommended that:

Community Council recommend enactment of the proposed amendment to the Dorset Community Zoning By-law No. 9508 to lift the Holding "H" designation from the lands.

Background:

Scarborough Council in March 1996 created a new community known as AMondeo@. Phase I consisting of townhouses has been built and a portion of Phase II, consisting of single-family and street townhouse dwellings is under construction. The balance of the Phase II lands, as shown on Figure 1, are presently zoned Neighbourhood Commercial (NC) and is subject to a Holding Provision (H)

The holding provision was incorporated into the zoning by-law to ensure that certain conditions be satisfied prior to allowing the removal of the holding provision from any portion of the subject lands. These conditions include the requirement that the Subdivision Agreement be executed for all the lands subject to the current zoning categories. Additional conditions, applying to the Neighbourhood Commercial (NC) zoning, require necessary transportation improvements to be implemented to accommodate the development on this site and the satisfactory resolution of Site Plan Control applications.



The applicant is seeking to remove the Holding Provision (H) as it applies to the final portion of the Phase II lands. With respect to the Neighbourhood Commercial (NC), shown hatched on Figure 1, the (H) can now be removed because the requirement to have the Subdivision Agreement executed has been fulfilled. The applicant has submitted a site plan application for the commercial site which is satisfactory in principle. The applicant has also submitted additional transportation reports and agreed to transportation improvements that will address satisfactorily, the development of the site. This will enable the final portion of Phase II of the Mondeo community to be developed for Neighbourhood Commercial facilities.

An application under Consent file number B018/00SC, has been received. This application is to provide a driveway easement in favour of this commercial site over the adjoining lands covered by site plan application SC-S19990079.

Comments:

The developer has submitted revised transportation reports and has modified the access to the site that now satisfies City Staff. Staff feel that the Site Plan control process is adequate to address the final evaluation of the application. Planning requirements identified under Site Plan Control review process will be incorporated into the final Site Plan Control Agreement and registered to ensure that the provisions necessary to implement the desired improvements and development are undertaken.

Conclusions:

The applicant has addressed and satisfied Council's conditions for the lifting of the holding provisions. Therefore, staff now recommend that Council implement a bylaw to lift the Holding Provision "H".
