Subject: Residential Demolition Application - 264 St. Clair Avenue West

Ward 23 (Midtown)

Purpose:

In accordance with former City of Toronto Municipal Code Chapter 146, Article II, Demolition Control, I refer the demolition application for 264 St. Clair Avenue West to you to recommend to City Council whether to grant or refuse the application, including conditions, if any, to be attached to the permit.

Financial Implications and Impact Statement:

Not applicable.

Recommendations:

That City Council choose one of the following recommendations:

1. That the application to demolish the subject commercial and residential building be refused by City Council, since no replacement building is proposed at this time, and the building has been listed on the City's Inventory of Heritage Properties, and Heritage Toronto is considering the property for designation under Part IV of the Ontario Heritage Act, OR

2. That the application to demolish the subject commercial and residential building be granted by City Council, provided:

(a) that a replacement building is erected on the site not later than two (2) years from the day demolition of the existing building is commenced, and

(b) that, on failure to complete the new building within the time specified, the City Clerk shall be entitled to enter on the collector's roll, to be collected in like manner as municipal taxes, the sum of twenty-thousand ($20,000) for each dwelling unit contained in the building in respect of which the demolition permit is issued, and that such sum shall, until payment, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued, OR

3. That the application to demolish the subject commercial and residential building be granted without conditions.

Comments:

On October 27, 1999, Gary Switzer applied for a permit to demolish the detached house at 264 St. Clair Avenue West. The existing building contains one dwelling unit.

This application is being referred to City Council because this building is residential and the applicant has not applied for a replacement building on this site, at this time. In cases such as these, the Municipal Code requires that City Council consider the demolition of residential property.

The building has recently been included on the City's Inventory of Heritage Properties and Heritage Toronto objects to the demolition at this time, so that it may consider the property for designation under Part IV of the Ontario Heritage Act. Councillors Bossons and Adams are also opposed to the demolition of this building.
