Subject: Application for Front Yard Parking at 43 Nanton Avenue

(Midtown)

Purpose:

To report on an application for front yard parking at 43 Nanton Avenue. As this is a matter of public interest, it is scheduled as a deputation item.

Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendation:

It is recommended that City Council approve the front yard parking at 43 Nanton Avenue, as such a request complies with Chapter 400 of the former City of Toronto Municipal Code.

Background:

Bernard Morton of Councillor Adams' office, in his communication of October 5, 1999, requested us to report to Toronto Community Council on the application for front yard parking at 43 Nanton Avenue.

Comments:

Front yard parking is governed by the criteria set out in the former City of Toronto Municipal Code Chapter 400, Traffic and Parking. The current criteria of the Code stipulates the physical criteria that must be met in order for the property to be eligible and requires that a formal poll be conducted to determine whether there is sufficient neighbourhood support for the application, and that such poll has a favourable result.

Ms. Nella Fiorino, owner of 43 Nanton Avenue, Toronto, Ontario M4W 2Y8, submitted an application for front yard parking on May 10, 1999. The application met the physical requirements of the Municipal Code, and a formal poll was conducted.

The polling was conducted in accordance with Chapter 90, Polling and Notifications Procedures, of the former City of Toronto Municipal Code. The area polled was on both sides of Nanton Avenue, from Nos. 17 to 53 on the odd side and between Nos. 22 to 50 on the even side, including 99 Elm Avenue. The deadline for receiving the ballots was November 22, 1999. The results of the poll were as follows:

The majority of the ballots cast were in favour of the parking proposal.

For your Committee's information, the property is on a street that is not authorized for permit parking. In addition, on this portion of Nanton Avenue, within the polling limits noted above, there are six properties licensed for front yard parking.

Conclusions:

The proposal for front yard parking at this property complies with all the requirements of the Municipal Code, including a favourable result to the formal poll.

On hearing of deputations, the Toronto Community Council must decide whether or not to recommend that City Council grant the front yard parking at 43 Nanton Avenue
