Subject: Proposed closing of the public lane west of Carroll Street, extending northerly from the first lane north of Matilda
Street, adjacent to Premises No. 777 Dundas Street East. (Don River)
Purpose:
To obtain City Council authority for the stopping-up and closing of the public lane west of Carroll Street, extending
northerly from the first lane north of Matilda Street, adjacent to Premises No. 777 Dundas Street East.
Financial Implications and Impact Statement:
There are no financial implications resulting from the adoption of this report.
Recommendations:
Subject to any additional terms and conditions, including compensation and costs, that may be determined by City Council
in connection with the conveyance of the subject lane, as set out in the report to Toronto Community Council from the
Acting Commissioner of Corporate Services, it is recommended:
(1) That the public lane west of Carroll Street, extending northerly from the first lane north of Matilda Street, shown
hatched on the attached sketch dated September, 1999, be stopped-up and closed; and
(2) That the appropriate City Officials be authorized and directed to take the necessary action to give effect to the
foregoing, including the introduction in Council of any Bills that might be required, and giving notice to the public of the
proposed by-law to close the public lane.
Background:
Works and Emergency Services has received and evaluated a request from The Butler Group (Consultants) Inc., on behalf
of Downtown BMW, to stop-up and close the public lane at the above-noted location. Downtown BMW is the owner of all
lands abutting the subject public lane.
Comments:
The proposed lane closing, shown hatched on the attached sketch dated September, 1999, is required by the applicant in
order to incorporate this land into their development site for the construction of an automobile dealership.
The proposal has been investigated by staff and has been determined to be feasible.
A separate report on the terms and conditions of the sale of these lands will be submitted to the Toronto Community
Council by the Acting Commissioner of Corporate Services.
This undertaking is pre-approved in accordance with Schedule "A" of the Class Environmental Assessment for Municipal
Road Projects.
Conclusions:
The stopping-up and closing of this public lane is technically feasible, subject to City Council approving of the Disposal
and Sale of the subject lands.
