ENCROACHMENT APPLICATION FOR 242 WYCHWOOD AVENUE

Ward 28, York Eglinton

City Clerk

(November 29, 1999)

Purpose:

To present comments from relevant agencies and departments regarding an encroachment application with respect to the existing steps of the subject property encroaching onto the Wychwood Avenue road allowance. The approximate size of the encroachment is 1.56 square feet.

Financial Implications and Impact Statement:

None.

Recommendations:

It is recommended that:

(1) the encroachment application be approved;

(2) the City enter into an agreement with the owner of 242 Wychwood Avenue, with terms to the satisfaction of the City Solicitor, such agreement to include the concrete approach steps within the City boulevard as noted by Right-of-Way Management; and

(3) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.

Background:

The owner of 242 Wychwood Avenue submitted an application for this encroachment which was received on September 21, 1999.

Comments:

The following are the comments received:

Bell Canada

Thank you for your letter dated September 21, 1999 concerning the above proposed survey plan. We have no concerns or objections to this plan as submitted. If there are any conflicts with existing Bell Canada facilities or easements, the owner/Developer shall be responsible for rearrangement or relocation.

Enbridge Consumers Gas

We have indicated on the attached print our existing and/or proposed underground plant.

We have no objection to the above proposal, provided our standard clearances or 0.3m minimum vertically and 0.6m horizontally are maintained.

Toronto Hydro

As per your request dated September 21, 1999, the existing encroachment does not conflict with our existing plant.

We would expect that this encroachment will be covered by the City of Toronto (York) Standard Encroachment Agreement which makes provision for our future installations.

Subject to the above, we have not objection to the encroachment.

Planning Division

This department has reviewed the encroachment application for the above referenced property and has no objections to the requested 5 inch encroachment.

Building Division

The Building Department has no objection regarding the encroachment application for the above noted property.

Right-of-Way Management, Transportation Services

I have no objection to the maintenance of the existing wooden entrance steps within the City boulevard fronting 242 Wychwood Avenue.

In addition, inspection has determined that there are concrete private approach steps, setback 0.4m from the rear edge of the City sidewalk being maintained within the City boulevard that should be included in the encroachment agreement.

Operations, Transportation Services

We have no objection.

Conclusion:

In view of the fact that the applicant has met all requirements, the City may enter into an agreement with the owner of 242 Wychwood Avenue.
