CONSENT AGREEMENT ARISING FROM

A COMMITTTEE OF ADJUSTMENT DECISION

1945 LAWRENCE AVENUE WEST (REAR)

Purpose:

To obtain the authority for the Chief Financial Officer and Treasurer and Clerk, on behalf of the City, to enter into a Consent Agreement with respect to the subject property.

Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendations:

It is recommended that:

(1) the Chief Financial Officer and Treasurer and Clerk be authorized on behalf of the City, to execute a Consent Agreement with respect to lands at the rear of 1945 Lawrence Avenue West, in the former City of York, such Consent Agreement to be in form satisfactory to the City Solicitor;

(2) that City staff be authorized to take the necessary action to facilitate the dedication of the parcels on the site to be conveyed to the City, for the purposes for which they are intended; and,

(3) the preceding recommendations be subject to provisional consent coming into effect..

Background:

This matter arises from a Committee of Adjustment decision dated January 25, 2000 regarding applications B3/00YK to B25/00YK (inclusive) to grant consent to the severance of lands located at the rear of 1945 Lawrence Avenue West into 24 semi-detached dwelling lots (parts 1 to 24) and the creation of rights-of-way/easements for pedestrian access and maintenance between the proposed semi-detached dwellings. The lands are currently vacant. A Site Plan Approval application has been filed for the semi-detached development and is nearing approval

The resulting lots will have a frontage ranging from 5.51 m (18ft) to 7.89m (25.9ft) and a lot area ranging from 198.36 m² (2,135 ft²) to 283.87m² (3,0556 ft²). In addition, Parts 26, 28, 29, and 30 will be conveyed to the City of Toronto for the purpose of a public lane and reserves. The lane will provide vehicular access to the garages proposed at the rear of the dwelling lots. Part 27 will be dedicated to the City of Toronto for widening of the municipal road allowance at the corner of Gibson Avenue and Wright Avenue . Part 25 has been approved for creation as a separate parcel under part-lot control by Community Council on January 18, 2000. By-law 654-1999 is now in effect to permit the 24 semi-detached dwelling house development and the creation of the lots consistent with these consent applications. (see attachments 1, 2 and 3)

By its decision dated January 25, 2000, the Committee of Adjustment granted provisional consent subject to a number of conditions, including that the applicant shall execute a consent agreement for the subject lands (severed and retained) and that the agreement shall be registered on title, to the satisfaction of the City Solicitor. Provisional consent will be in effect on February 18, 2000 unless an appeal is filed prior to this date.

Comments:

The condition to enter into a Consent agreement as imposed by the Committee of Adjustment reflects the recommendations made by the Community Planning Division to the Committee of Adjustment. The entering into the Consent Agreement is necessary in order for the owner of the subject property to finalize the land severance. This agreement is currently being prepared in a form satisfactory to the City Solicitor. The parcels to be conveyed to the City for road widening, public lane and reserve purposes may require dedication by-laws and therefore authorization should be granted to staff to take the necessary action to facilitate their dedication for their intended use.

Conclusions:

The entering into and registration of the Consent Agreement against title to the subject property will satisfy one of the conditions imposed by the Committee of Adjustment for severance of the subject property. Authorization should also be given to City staff to take the necessary action to facilitate the dedication of parts of the site to be conveyed to the City, for their intended use.
