REQUEST FOR DESIGNATED DISABLED PERSONS' PARKING SPACE

AT NO. 358 KANE AVENUE

Purpose:

To respond to a request for a report on the feasibility of establishing a designated disabled persons' parking space in front of No. 358 Kane Avenue.

Financial Implications and Impact Statement:

There are no financial implications resulting from the adoption of this report.

Recommendation:

It is recommended that this report be received for information.

Background:

Councillor Frances Nunziata, by memo dated January 20, 2000, is requesting staff to report on the feasibility of designating a disabled persons parking space directly in front of No. 358 Kane Avenue.

Comments:

Kane Avenue is a local roadway, operating in a one-way southbound direction. On-street parking is exclusively permitted on the east side of Kane Avenue. A maximum unsigned three hour parking duration is currently in effect at all times, except between the hours 12:00 midnight and 6:00 a.m. when motorists are required to display a valid on-street parking permit stating Kane Avenue.

No. 358 Kane Avenue is located on the west side of Kane Avenue between Cameron Avenue and Holwood Avenue. The residence is a single dwelling with a total frontage width of 9.1 metres.

Presently, there is an illegal parking space located in the front yard at No. 358 Kane Avenue. On May 31, 1999, the concrete curb stone installed to prevent occupation of the parking space was broken and placed in boxes for waste collection. Since then, numerous investigations have revealed parking continues to occur illegally in the front yard. As a result, the resident, by letter dated December 10, 1999, was notified to cease all parking within the City boulevard, failure of which the City would proceed with installing steel posts without further notice. This matter continues to be unresolved.

The resident possesses a valid Province of Ontario Disabled Persons Parking Permit. On- street parking is currently prohibited on the west side of Kane Avenue, abutting No. 358 Kane Avenue.

It is our practice to only establish a disabled persons parking space where on-street parking is legally permitted. Establishment of a designated persons' parking space, therefore, would require the resident to obtain written permission from a neighbour on the east side of Kane Avenue.

Alternatively, legalization of the existing front yard parking space would provide the resident a permanent parking facility for his exclusive use, that is located directly in front of his residence at No. 358 Kane Avenue.

However, should the resident receive written permission from a neighbour on the east side of Kane Avenue to designate a space in front of their residence, this matter could be reconsidered. This would be subject to a minimum available curb space of 5.5 metres and would reduce the availability of one overnight on-street parking permit space.

Would you please place the following request on the next available York Community Council Agenda.

I have been contacted by a constituent at 358 Kane Avenue who presently holds a valid handicap certificate, number B96984. He is requesting a dedicated parking spot on Kane Avenue in front of his residence.

Further, I request that staff review the above noted and report back to York Community Council.
