Ontario Municipal Board Hearing - Committee of Adjustment
Application UDCA-99-570 - Appeal by George Kibedi - 48 Eunice
Road - Seneca Heights
The North York Community Council recommends the adoption of the following Resolution by
Councillor David Shiner, Seneca Heights:
"WHEREAS on October 21, 1999 the North York Committee of Adjustment had before it an
application for minor variance respecting 48 Eunice Road (UDCA-99-570) to permit the
construction of a one storey addition attached to the rear of the existing dwelling, and
WHEREAS the Committee heard from numerous area residents in opposition to the application, and
WHEREAS on the grounds that the variance is not minor, is not within the general intent of the
Zoning By-law, is not an appropriate development of the property, and is not in keeping with the
character of the neighbourhood, the Committee unanimously refused the application, and
WHEREAS the applicant has commenced construction of the addition despite having the application
refused by the Committee, and
WHEREAS the applicant has appealed the Committee's decision to the Ontario Municipal Board,
where a hearing date has not yet been set, and
WHEREAS North York Planning staff did not oppose the application and did not prepare a staff
report on the matter,
THEREFORE BE IT RESOLVED THAT the City Solicitor and/or appropriate legal staff be directed
to attend at the Ontario Municipal Board (O.M.B.) in opposition to the proposed addition at 48
Eunice Road and oppose the requested minor variances;
AND BE IT FURTHER RESOLVED THAT the City Solicitor be authorized to retain outside
consultants to support the City's defense in this matter;

York Community Council with the agenda for its meeting on January 18, 2000, and a copy thereof
