The Scarborough Community Council recommends the adoption of the following report (December 14, 1999) from the Director of Community Planning, East District:



Purpose:

This report recommends approval of a Draft Plan of Condominium for a 135 unit residential townhouse development currently under construction on the west side of Midland Avenue, south of the Ellesmere Service Road. A total of 164 parking spaces will be provided on-site, including 29 surface visitor parking spaces. Vehicular access will be provided from Midland Avenue and the new extension of Midwest Road, which will connect to the Ellesmere Service Road.



Financial Implications and Impact Statement:



None.



Recommendations:



It is recommended that City Council support the Draft Plan of Condominium SC-C19990005 by Corey Leibel, on behalf of Kradler Investments Inc., being Part of Lot 108, Registrar's Compiled Plan 9846, known municipally as 1075 Ellesmere Road, subject to the following conditions:



(1) Plan as stamped "Recommended" this date (see Figure 1);



(2) the following warning clause be included in the Condominium Description Declaration and be brought to the attention of prospective owners and tenants:

"Purchasers/tenants are advised that there are existing industrial operations to the west and south of the site and that the impacts ordinarily associated with such operations may be experienced. Without limiting the foregoing, and despite the inclusion of noise control features in this development, noise levels may continue to be of concern and may occasionally interfere with some activities of the dwelling occupants."; and

(3) the owner to complete all conditions of the Site Plan Control Agreement prior to registration, or enter into a financially-secured development agreement with the City secured by a performance guarantee in a form and amount satisfactory to the City Solicitor, to guarantee completion of the site work, if the owner chooses to register the condominium prior to completion of the project.



Comments:



All technical agencies circulated had no comments or their requirements have been incorporated into the recommendations. There are no concerns under the current High Density Residential provisions of the Official Plan raised by this application, and the development complies with the "Commercial Residential" (CR) zoning requirements of the Employment Districts Zoning By-law No. 24982 (Dorset Park), as amended. The residential development is currently under construction in accordance with the Site Plan Control Agreement registered in August 1999.
