Harmonization of the Fence By-laws
The Scarborough Community Council recommends that City Council request the Acting
Commissioner of Urban Development Services to report to Planning and Transportation
Committee on harmonizing fence regulations across the City with a view to introducing
appropriate standards in the Zoning By-law and repealing Fence By-laws previously adopted
under the Municipal Act.
The Scarborough Community Council reports having received the following report (January
4, 2000) from the Acting Commissioner of Urban Development Services:
Purpose:
To report further on the status of the development of a harmonized fence by-law for the City of
Toronto.
Financial Implications and Impact Statement:
Nil.
Recommendations:
It is recommended that this report be received for information purposes.
Background:
At its meeting in October 1999, the Scarborough Community Council requested a report at its first
meeting in January 2000 providing an update as to the status of the harmonization of the Fence By-law.
Comments:
After a number of reviews and revisions, a draft fence by-law has been completed and submitted to
Legal Services for final review.
The draft by-law does not include a process for exemptions and while Council delegated authority
for exemptions to the Director of Municipal Licensing and Standards, it has been suggested that such
delegation may not be possible under law. Notwithstanding, staff are exploring alternatives to the
current process. One such alternative would utilize the use of the Committee of Adjustment.
Initially, the draft will be submitted to the Planning and Transportation Committee and then referred
to the Community Councils for comment. Staff will provide comparison charts outlining the
existing and proposed legislation for ease of review.
