Keele Valley Landfill Site -

Amendment to Consulting Agreement with

Conestoga Rovers & Associates Limited



The Works Committee recommends the adoption of the following joint report (December 16, 1999) from the Commissioner of Works and Emergency Services and the Chief Financial Officer and Treasurer:



Purpose:



To seek authority to extend the Agreement between the City of Toronto and Conestoga Rovers & Associates Limited (CRA) for general engineering and consulting services, landfill gas consulting services including gas utilization, leachate handling, stormwater management, moisture recirculation, final cover, progressive rehabilitation and site closure requirements at the Keele Valley Landfill Site (KVLS).



Financial Implications and Impact Statement:



The 1999-2003 Capital Works Program approved a total budget of $15,802,000.00 for ongoing development of the KVLS under Project No. C-SW165. Funding for landfill gas, leachate and general consulting services is available in this account.





Recommendations:



It is recommended that:



(1) authority be granted to increase the approved level of expenditure for technical services for Conestoga Rovers & Associates Limited by an amount of $278,773.00, including the Goods and Services Tax ($268,351.25 after the Municipal Goods and Services Tax Rebate), for general engineering and consulting services, landfill gas consulting services including gas utilization, leachate handling, stormwater management, moisture recirculation, final cover, progressive rehabilitation and site closure requirements at the Keele Valley Landfill Site;



(2) the term of the Agreement be extended to December 31, 2002; and



(3) the appropriate officials be authorized to amend the existing Agreement between the City of Toronto and Conestoga Rovers & Associates Limited to give effect thereto.



Background:



On October May 13, 1998, Council approved Clause No. 8 of Report No. 4 of The Works and Utilities Committee extending the Agreement between the City of Toronto and CRA to December 31, 1999, and raising the limit on the approved expenditure by $246,000.00 to $2,817,000.00 after the Municipal GST Rebate.



Comments:



The City requires landfill gas, leachate and general consulting services related to the KVLS. CRA has provided this consulting since the site's inception. Services under this Agreement are mandated by conditions of the provisional Certificate of Approval governing the development and operation of the landfill. As CRA's current agreement for consulting services in relation to the Keele Valley Landfill Site expires on December 31, 1999, a Request for Proposals was issued on November 5, 1999, by the Finance Department, Purchasing and Materials Management Division, for landfill gas, leachate control, and general consulting.



Twelve firms with experience in landfill gas and leachate were invited to submit proposals. In addition, the RFP was advertised on the City's internet site. The Request for Proposals indicated that only firms with experience with landfill gas collection and utilization at landfills with more than 5,000,000 tonnes of refuse would be considered. Staff believed this qualification to be very important, as the required experience would be critical toward the ability of the consultant to adequately understand the issues at the site. Only two firms, CRA and Earth Tech, submitted proposals.











The selection committee concluded that both proposals submitted satisfied the overall project requirements and demonstrated an appropriate level of effort to properly address the necessary elements of the work. However, CRA's price of $278,773.00, including the Goods and Services Tax was significantly lower than Earth Tech's. Therefore, the selection committee chose CRA as the preferred proponent.



The Manager, Fair Wage and Labour Trades Office, has reported favourably on the firm recommended.



An extension of CRA's Agreement to December 31, 2002, would ensure that the City of Toronto is provided the necessary continuity required for the development of the Keele Valley Landfill Site in a cost-effective manner.



Conclusions:



A consultant is required for general consulting services, landfill gas consulting services including gas utilization and ambient air monitoring, leachate disposal, moisture recirculation, final cover, progressive rehabilitation and site closure at the KVLS. It is therefore recommended that the Agreement between the City of Toronto and CRA for consulting services at the KVLS be extended to December 31, 2002, and that authority be granted to increase the approved level of expenditure for these consulting services.
