Parking Restrictions on Coxwell Avenue: Proposal to Implement

a No Parking Restriction Adjacent to 806 Coxwell Avenue

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The East York Community Council recommends the adoption of the following report (January 5, 1998) from the Commissioner of Development Services:

Purpose:

To amend East York Area By-law No. 92-93, Schedule VIII, "No Parking", to introduce a "No Parking Anytime" prohibition adjacent to 806 Coxwell Avenue and improve sightlines for the residents of 806 and 808 Coxwell Avenue.

Funding Sources, Financial Implications and Impact Statement:

The recommended change can be implemented within the existing Borough Operating Budget.

Recommendations:

It is recommended that:

(1) East York By-law No. 92-93, entitled "To Regulate traffic on roads in the Borough of East York", be amended to introduce a "No Parking Anytime" restriction on the west side of Coxwell Avenue from Queensdale Avenue to a point 19 metres south thereof; and

(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Council Reference/Background/History:

The proposed parking restriction is recommended to address the concerns of Sam and Marg Anderson, 806 Coxwell Avenue, who have difficulty exiting their driveway when vehicles are parked on Coxwell Avenue, adjacent to their driveway.

Comments and/or Discussion and/or Justification:

The Andersons expressed concerns with respect to parking problems on the west side of Coxwell Avenue, from Sammon Avenue south and parking immediately in front of their home. They are also concerned with the ability of the Works Department to clean the streets and clear the snow on Coxwell Avenue.

They recommend the adoption of some of the other parking restrictions already in place in the neighbourhood, including an extension of the current 15 metre corner restriction in place on the west side of Coxwell Avenue, south to eliminate one parking space adjacent to their home.

Currently, the west side of Coxwell Avenue, south of Queensdale Avenue, is governed by a 15 metre corner parking restriction, south of Queensdale Avenue, and a "No Standing" zone, north of Springdale Avenue which serves the Toronto Transit Commission bus stop at this corner. Approximately three parking spaces are available between these two parking restrictions on Coxwell Avenue. These spaces are governed by the three-hour parking By-law.

The east side of Coxwell Avenue, opposite 806 Coxwell Avenue is governed by the unsigned three-hour parking By-law. Metered parking exists north of Sammon Avenue on both sides of Coxwell Avenue.

The Andersons share their driveway with the residents of 808 Coxwell Avenue.

Staff have investigated parking operations in front of the Andersons' home and confirm that the parking space located immediately north of the driveway to 806 and 808 Coxwell Avenue is being used on a daily basis. This space, however, is approximately three metres in length and is bounded by the driveway to 806/808 Coxwell Avenue and the driveway to 810 Coxwell Avenue. The parking space can only be used by small vehicles. Mid-sized cars and trucks encroach into either driveway. Staff concur with the Andersons that sightlines can become restricted if a vehicle is parked immediately north of the driveway to 806/808 Coxwell Avenue and encroaches into their driveway.

To reduce sightline restrictions for vehicles accessing 806 and 808 Coxwell Avenue, it would be prudent to extend the existing 15 metre corner parking restriction a further four metres to the south. This would eliminate one parking space which is technically available only for a small vehicle.

Staff do not recommend the introduction of any further parking restrictions on Coxwell Avenue at this time in this area. While further parking restrictions would potentially assist staff in maintaining the roadway, we recognize the importance in allowing residents to park on the street, especially in areas with limited on-site parking opportunities.

Conclusions:

Staff recommend that the existing corner parking restriction on the west side of Coxwell Avenue, south of Queensdale Avenue, be extended a further four metres to the south. This would provide for clearer sightlines for motorists exiting the driveway to 806 and 808 Coxwell Avenue. The proposed restriction would remove one parking space, however this space can only accommodate small vehicles.

Traffic Control on Holmstead Avenue at Squires Avenue

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The East York Community Council recommends the adoption of the following report (January 5, 1998) from the Commissioner of Development Services:

Purpose:

To replace an existing yield sign with a stop sign.

Funding Sources, Financial Implications and Impact Statement:

The proposed recommendation can be accommodated within the operating budget.

Recommendations:

It is recommended that:

(1) By-law No. 92-93, entitled "To regulate traffic on roads in the Borough of East York", be amended to replace the existing yield sign on Holmstead Avenue at Squires Avenue with a stop sign; and

(2) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Council Reference/Background/History:

The Development Services Department received a request from Mr. Jim Ferrari, 15 Holmstead Avenue, by telephone on September 3, 1997, requesting that the existing yield sign on Holmstead Avenue at Squires Avenue be replaced with a stop sign.

Comments and/or Discussion and/or Justification:

The intersection of Holmstead Avenue and Squires Avenue is a "Tee" type intersection with existing yield control for westbound motorists on Holmstead Avenue. It is departmental practice to install yield signs at intersections that have no control to indicate the right-of-way to motorists. Before the yield sign was installed, the intersection of Holmstead Avenue and Squires Avenue was operating without any signed control. On April 24, 1997, a yield sign was installed.

It is also departmental practice to replace a yield sign with a stop sign where a request has been submitted by a resident of the neighbourhood for such a change. We recommend that the yield sign be replaced with a stop sign to clearly delineate the right-of-way.

Conclusions:

It is departmental practice to install yield signs at uncontrolled intersections to indicate to motorists the right-of-way. The intersection of Holmstead Avenue and Squires Avenue is presently controlled by a yield sign on Holmstead Avenue. A resident has made a request to replace the existing yield sign with a stop sign. To clearly indicate which motorists have the right-of-way, it is recommended that this yield sign be replaced with a stop sign.

Implementation of a Disabled Parking Space on Bryant Avenue

(City Council on February 4, 5 and 6, 1998, struck out and referred this Clause back to the East York Community Council for further consideration.)

The East York Community Council recommends the adoption of the following report (January 6, 1998) from the Commissioner of Development Services:

Purpose:

To implement a disabled parking space on Bryant Avenue for use by disabled residents.

Funding Sources, Financial Implications and Impact Statement:

The recommended change can be accommodated within the existing Operating Budget.

Recommendations:

It is recommended that:

(1) East York By-law No. 34-93, entitled "To Provide for Disabled Person Parking Permit Holders" be amended to implement a disabled parking space on the east side of Bryant Avenue, from a point 43.3 metres north of Denton Avenue to a point 49.9 metres north of Denton Avenue;

(2) this disabled parking space be removed when Mr. Alec Goydas ceases to reside at 18 Bryant Avenue; and

(3) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Council Reference/Background/History:

The Development Services Department received a letter from Mr. Alec Goydas, 18 Bryant Avenue, dated October 21, 1997, requesting the installation of an on-street disabled parking space adjacent to 18 Bryant Avenue.

Comments and/or Discussion and/or Justification:

Bryant Avenue, between Denton Avenue and Dentonia Park Avenue, is governed by a "No Parking Anytime" restriction on the west side of the street and the three-hour parking by-law on the east side. A review of parking on Bryant Avenue during a typical weekday indicates that parking is near capacity, however, designating one space as a disabled parking space would not necessarily eliminate an on-street parking space since the disabled permit holder has no on-site parking and currently parks on the street. It is recommended that one on-street parking space on the east side of Bryant Avenue, adjacent to 18 Bryant Avenue, be designated as a parking space for a disabled permit holder. A plan indicating the location of the proposed disabled parking space is attached.

Mr. Goydas and the neighbouring residents will be notified by the City Clerk's Department, East York Office, that this report is being presented to the East York Community Council.

Conclusions:

It is recommended that a disabled parking space be installed on the east side of Bryant Avenue, adjacent to 18 Bryant Avenue, to facilitate disabled residents in the vicinity. The removal of one on-street parking space on Bryant Avenue is not expected to significantly impact parking in this area.

Application for Judicial Review by Invar Building Corporation

regarding 7 Overlea Boulevard

(City Council on February 4, 5 and 6, 1998, adopted this Clause, without amendment.)

The East York Community Council recommends the adoption of the following report (January 20, 1998) from the Commissioner of Development Services:

Purpose

The owners of the property at 7 Overlea Boulevard, Invar Building Corporation, have made an application to the Divisional Court to have several conditions of consent, imposed by the Leaside Committee of Adjustment in 1966, including one prohibiting residential uses on the property, declared of no force and effect. The condition is inconsistent with approvals on the property given by the former East York Council in 1997.

The purpose of this report is to request Council to authorize the City Solicitors to consent to the Divisional Court application. In order to avoid the delay of reporting to next month's Community Council meeting, it was decided to walk this report on to the January 21, 1998 meeting.

Recommendation:

It is recommended that the City Solicitor be given authority to consent to the Divisional Court application brought by Invar Building Corporation to delete the four conditions of consent imposed by the Leaside Committee of Adjustment in Decision No. B-11, Hearing No. 9 in 1966, and to take such actions as are necessary to protect the City's interests in that respect.

Background:

On June 9, 1966, the Leaside Committee of Adjustment approved an application by the owners of the property, Canadianwide Properties Ltd., to sever the property from their adjacent holdings. The Committee attached four conditions to the approval:

(1) "that the site and building plans shall be presented to and subject to the approval of this Committee prior to issuance of any building permit;

(2) "the purpose for which this parcel may be used is only as an office building, a bank, a clinic or a public building and uses accessory or incidental to the foregoing, including an eating establishment;

(3) "there is to be no direct vehicular access to Overlea Boulevard; and

(4) "parking, landscaping and fencing to the satisfaction of the Committee".

The severed land was subsequently conveyed to Markborough Properties Limited.

On May 20, 1997, East York Council passed a zoning by-law amendment to permit the existing seven-storey office building on the land to be converted to a residential apartment building with 144 one-bedroom units, and 2,033 m2 of commercial floor area on the ground floor. The Official Plan was modified by the Minister of Municipal Affairs to allow residential zoning on the site. Both the Official Plan modification and Zoning By-law Amendment are in full force and effect.

Before a building permit is issued, the East York Building Division is requesting Invar to address the 1966 consent conditions. In response, Invar has applied to Divisional Court for a declaration that the conditions are null and void or of no force and effect. It was determined in discussions with staff and the Solicitors that this would be the most expeditious manner of proceeding.

Comments:

Planning staff and the City Solicitors have reviewed this matter, and agree with Invar's course of action. The use of the property was the subject of a full public consultation resulting in a zoning by-law amendment and official plan modification last year. The 1966 severance conditions are inconsistent with Council's recent planning decisions. This is inappropriate, and the conditions should be deleted.

Conclusions:

Staff are recommending that Council authorize the City Solicitors to consent to the application by Invar.

(a) Community Council Briefing.

The East York Community Council reports having received presentations from the following regarding the programs and services under the responsibility of the Community Council:

(January 6, 1998) from the Commissioner of Development Services advising of the status of current development applications under consideration for the East York area, and recommending that the aforementioned report be received for information.

(c) East York Community Council Political Structure.

The East York Community Council reports having:

(1) recommended to the Special Committee to Review the Final Report of the Toronto Transition Team, the following:

(I) a joint evening meeting of the East York Community Council and the Special Committee to Review the Final Report of the Toronto Transition Team be scheduled to permit the East York community an opportunity to express its views regarding political representation in East York;

(ii) the Chief Administrative Officer and the City Solicitor be requested to report to the aforementioned joint evening meeting on the process and legal options available to the City Council to establish a third political representative for Ward One, East York; and

(iii) the aforementioned meeting be scheduled at a time which is acceptable to the Special Committee to Review the Final Report of the Toronto Transition Team; and

(2) received the following communication (January 19, 1998) from Ms. Margaret Simpson:

(January 19, 1998) from Ms. Margaret Simpson, East York, requesting an evening information session to allow East York residents to debate and discuss the meaning and details of the process to increase the political representation for Ward One, East York.

(1) advised the Urban Environment and Development Committee that it has endorsed the position of the Council of The Corporation of the Borough of East York whereby the Borough Council authorized entering into an agreement with Bell Canada with respect to advertising on telephone booths and sharing revenue from such advertising until December 31, 1998, in accordance with Minute No. 3.468, 1997; and

(2) received the following communication (January 13, 1998) from the City Clerk, regarding Bell Canada telephone booth advertising:

(January 13, 1998) from the City Clerk, inviting members of the Community Council to appear before the Urban Environment and Development Committee at its meeting on Monday February 9, 1998, regarding illuminated commercial advertising on telephone booths.

(e) Budget and Reporting Relationship of the

East York Local Architectural Conservation Advisory Committee

and the Don Valley Brickworks.

The East York Community Council reports having:

(1) directed that the Acting Executive Commissioner for Community and Neighbourhood Services and the Acting Executive Commissioner for Urban Development Services be requested to report to the East York Community Council meeting to be held on February 18, 1998, on the following:

(i) the future role, budget and reporting relationship of the East York Local Architectural Conservation Advisory Committee and the future status of properties formerly designated by The Corporation of the Borough of East York; and

(ii) the future budget, reporting relationship and status of the Steering Committee for the Don Valley Brickworks; and

(2) received the following communication from Mr. John Carter:

(January 21, 1998) from Mr. John Carter, East York, raising questions on the budget and reporting relationship of the East York Local Architectural Conservation Advisory Committee, the Don Valley Brickworks and the Goulding Estate.

The East York Community Council reports having:

(1) requested the Acting Executive Commissioner for Urban Development Services to report to the East York Community Council meeting on February 18, 1998, on enforcement issues in relation to the parking pad located at 745 Sammon Avenue; and

(2) directed the Acting Executive Commissioner for Urban Development Services to request APCOA Parking Limited to cease enforcement action at 745 Sammon Avenue, pending East York Community Council's consideration of this matter.

(h) Toronto Transition Team's Recommendation to Move

to Single Member Wards for the Next Term of Council.

The East York Community Council reports having deferred consideration of the following communication (January 15, 1998) from the City Clerk, to allow for further discussion, community input and clarification of the proposed process with respect to the Toronto Transition Team's recommendation to move to single member wards for the next term of Council which begins in the year 2001:

(January 15, 1998) from the City Clerk, asking the Community Council to consider the proposal for one Councillor per ward representation.
