Purpose:

To allow the existing road surfaces on the following roads to be removed and resurfaced with a minimal disruption to a large number of commuters using these major arterial roads:

(A)Eglinton Avenue West from Black Creek Drive to the intersection at Weston Road; and

(B)Rogers Road from Old Weston Road to Weston Road North (intersections of Rogers Road at Old Weston Road, Keele Street and Bicknell Avenue)

Funding Sources, Financial Implications and Impact Status:

No funding required nor are there any financial implications.

Recommendations:

That an exemption from the Noise by-law be granted to the Transportation Department, Construction Branch, City of Toronto, from 7:00 p.m. to 6:00 a.m. from (a) April 20,1998 to August 21, 1998; and (b) August 31, 1998 to December 4,1998.

Background:

Required maintenance and repair are necessary at the above mentioned intersections. Each intersection requires an exemption from the Noise by-law between 7:00 p.m., Friday to 6:00 a.m., Monday for two successive weekends between April 20, 1998 and August 21,1998 also August31,1998 and December 4, 1998. The exemptions will allow removal of the existing pavement to a depth of 125 mm or to the concrete road base, paving with base asphalt during the first weekend, adjustment of maintenance hole frames and covers during the week between rush hours, and surface paving the following weekend. A third weekend may be required due to inclement weather or equipment breakdown. The request is not specific as to the exact weekends for which the exemption is requested. However, the contracts commence on (a) April 20,1998 with an anticipated completion date of August 21, 1998 and (b) August 31, 1998 with an anticipated completion date of December 4, 1998. The weekends on which the exemptions would be used would fall between those respective dates. The reason for the request is to permit resurfacing of the roadway with a minimum disruption to commuter traffic in each of the two areas.

Discussion:

The City of York's Noise By-Law No. 3453-79 specifically provides that Council may grant an exemption from any of the by-law provisions. The exemption may be for any specified time not in excess of six months and may be made subject to terms and conditions set by granting an exemption, Council is required to obtain a report from the Commissioner of Community Services. The report is to set out an opinion on the merits of the application and recommendations as to terms and conditions which should be imposed upon the applicant.

I have reviewed the request for an exemption and am of the opinion that the exemption should be granted. Rogers Road and Eglinton Avenue West are major arterial roads and it is a reasonable request that major repairs be done when the disruption caused by them will be minimized. There is no recommendation for special terms or conditions to the exemption. Most of the buildings fronting along Rogers Road are commercial with apartments above and a large portion of the area from Bicknell Avenue to Weston Road has very few buildings fronting on Rogers Road. The Eglinton Avenue West location between Black Creek and Weston Road is primarily unoccupied and as it is unlikely that any one property will be affected by noise for any inordinate length of time

City Wide Issues:

None.

Conclusions:

It is reasonable to grant the exemption from the noise by-law provisions, as requested by the Transportation Department.

Request for Exemption from York Noise By-law No. 3453-79

In conjunction with Two Religious Festivals

Ward 27, York Humber

The York Community Council recommends the adoption of the following report (April28,1998) from the York Commissioner of Community Services:

Purpose:

To allow the participation of marching bands and a pop music group in two important religious festivals celebrated by the Parish of St. Matthew's School, during a prohibited time for amplified sound.

Funding Sources, Financial Implications and Impact Status:

No funding required nor are there any financial implications. The requested exemptions are very limited in scope and duration therefore, it is very unlikely that the surrounding community would be exposed to any significant adverse impact.

Recommendations:

That St. Matthew's Church, 706 Old Weston Road, be exempted without conditions from the provision of Borough of York By-law Number 3453-79, which prohibits the emission of amplified sound audible in a residential area for the following dates and times:

Background:

Attached is a letter dated March 5, 1998 from the executives of St. Matthew's Church 706 Old Weston Road, requesting an exemption from the City's Noise By-law on the above noted occasions. The two religious festivals, which attract a large number of parishioners, are celebrated in the school yard of St. Matthew's School which is located to the back of the church. The requested exemptions are for two concerts to be held which include the participation of marching bands and a pop music group. There have been no reported incidents during previous years' festivities.

Discussion:

The City of York Noise By-law Number 3453-79 prohibits the emission of amplified sound from electronic devices incorporating one or more loudspeakers if the noise is audible in residential areas on any day after 5:00 p.m.

By-law Number 3453-79 provides that Council may, by resolution, grant exemptions from the Noise By-law provisions. The by-law provides that such an exemption may be granted only after Council considers a report from the Commissioner of Community Services. The report is to set out any recommendations as to terms and conditions which should be imposed upon the applicant.

With respect to this application, the requested exemptions are very limited in scope and duration. It would be appropriate that Council grant the exemption requested without attaching any conditions. The exemption would only be in effect to 12:00 a.m. (midnight) on the dates indicated and is unlikely to have any significant adverse impact on the surrounding community.

City Wide Issues:

None.

Conclusions:

For the past three years, the applicants have held their festivals in conjunction with granted exemptions to the Noise By-Law without reported incidents. The concerts, while enhancing celebratory festivals, are likely to be more interesting and entertaining than disturbing to non participants in the community. For these and other reasons reported above, it would appear logical that the exemption to the Noise By-Law be granted on the above noted occasions without conditions.

Request for 24-Hour Permit Parking on Batavia Avenue

Purpose:

Batavia Avenue residents, by petition (Appendix I) through Councillor Frances Nunziata's office, are requesting implementation 24-hour on-street permit parking.

Funding Sources, Financial Implications and Impact Statement:

Traffic budget.

Recommendations:

(1)That the York Uniform Traffic By-law No. 2958-94 be amended, to rescind the daytime No Parking prohibition during the hours 9:00 a.m. to 5:00 p.m., Monday through Friday, on Batavia Avenue between St. Clair Avenue West and Pritchard Avenue; and

(2)that the City officials be authorized and directed to take the necessary action to give effect thereto.

Council Reference/Background History:

Councillor Frances Nunziata, by memo dated April 27, 1998, is requesting a report on the feasibility of providing 24-hour on-street permit parking on Batavia Avenue.

Comments and/or Discussion and/or Justification:

Batavia Avenue traverses in a north/south direction, between St. Clair Avenue West and PritchardAvenue, providing two-way vehicular traffic flow.

Currently on-street parking legally alternates from the west to the east sides of Batavia Avenue between St. Clair Avenue West to Pritchard Avenue, during the months April through November. During the winter months December through to March an exclusive one side parking regulation is in effect on the east side of the street.

There is currently a daytime parking prohibition on Batavia Avenue, during the hours 9:00 a.m. to 5:00 p.m., Monday through Friday, with a maximum unsigned three (3) hour parking limit for all other times, except during the hours 12:00 midnight to 6:00 a.m. when an exclusive on-street permit parking regulation is in effect, for any vehicle displaying a valid on-street permit stating BataviaAvenue.

On-street permit parking provides those residents without adequate off-street parking facilities to legally park their vehicles on the streets on which they reside for extended periods of time, with impunity from the signed and unsigned parking regulations.

We, therefore, support the residents request to rescind the current daytime no parking prohibition on Batavia Avenue between St. Clair Avenue West and Pritchard Avenue.

Conclusions:

A review of the petition reveals a total of twenty-six (26) municipally addressed residences are requesting the service. For Committee's information there is a total of fifty-three (53) municipally addressed properties on Batavia Avenue between St. Clair Avenue West and Pritchard Avenue. The petition represents 49% of the total number of municipally addressed properties on the street.

On-street parking is a service benefit for every municipally addressed taxpayer, without adequate off-street parking facilities. We, therefore, support and recommend rescinding the daytime no parking prohibition on Batavia Avenue between St. Clair Avenue West and Pritchard Avenue.

Cash Payment-in-Lieu of Parking - 1728 Eglinton Avenue West

Purpose:

Cascais Bakery, 1728 Eglinton Avenue West, by application is applying for Cash Payment-In-Lieu of Parking.

Funding Sources, Financial Implications and Impact Statement:

None required.

Recommendations:

(1)That the York Community Council approve a cash payment-in-lieu of three (3) parking spaces required at 1728 Eglinton Avenue West, in accordance with the York Zoning By-law No.1-83; and

(2)that the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

Council Reference/Background History:

Mr. C. Pierozzi acting as agent for Cascais Bakery located at 1728 Eglinton Avenue West on April6,1998, submitted an application with respect to cash payment-in-lieu of parking for three (3) spaces. The owner is intending to convert the current restaurant located in the basement into a licenced restaurant.

Comments and/or Discussion and/or Justification:

The property municipally addressed as 1728 Eglinton Avenue West is located on the north/east corner of Locksley Avenue and Eglinton Avenue West, within Ward 28 York Eglinton (AppendixI, aerial photo detailing property location.)

As part of the application process, a memorandum is circulated to the various internal departments concerned for comment. Outlined below is a summary of the comments received concerning CascaisBakery's application for cash payment-in-lieu of parking:

Development Services

Development Control Division has no objections to this application.

The Building Division has indicated the owner is required to provide an additional three (3) parking spaces under the terms of York Zoning By-law No. 1-83 in converting the restaurant to a licenced establishment. Due to the fact that these spaces cannot be provided on the site, the applicant is applying for Cash payment-in-lieu of parking.

Operations Services

Currently on-street parking is legally permitted on both the north and south sides of EglintonAvenueWest, immediately adjacent to these premises providing one (1) hour maximum parking duration controlled by parking metres. In addition, there are two municipal parking lots all within walking distance of the establishment, which provide for varied parking durations dependent upon the customers' needs.

Conclusions:

The owner is required to provide an additional three (3) parking spaces to convert the existing restaurant into a licenced establishment, we, therefore, support and recommend approval of CascaisBakery's application for Cash payment-in-lieu of parking.

Request for Disabled Parking Space - 360 Whitmore Avenue

Ward 28, York-Eglinton

The York Community Council recommends the adoption of the following report (May6,1998) from the York Commissioner of Operations Services:

Purpose:

Mr. William Richman, 360 Whitmore Avenue is requesting a designated disabled parking space be established directly in front of his residence.

Funding Sources, Financial Implications and Impact Statement:

Traffic budget.

Recommendations:

(1)That the York Uniform Traffic By-law No. 2958-94 be amended to prohibit parking anytime on both the north and south sides of Whitmore Avenue to establish a designated disabled parking space for one vehicle length, directly in front of municipally addressed residences 360 and 345 Whitmore Avenue; and

(2)Further, that Mr. W. Richman receive a copy of this report.

Council Reference/Background History:

Mr. William Richman by letter dated April 20, 1998 (Appendix I), is requesting consideration to establish a designated disabled parking space directly in front of his residence, located at 360Whitmore Avenue.

Comments and/or Discussion and/or Justification:

Whitmore Avenue is a local roadway, traversing in an east/west direction between Dufferin Street and Marlee Avenue. The street currently provides one-way vehicular traffic flow in an eastbound direction.

The property municipally addressed as 360 Whitmore Avenue is located on the north side of the street between Times Road and Marlee Avenue. Currently within this section of Whitmore Avenue, on-street parking alternates between the south side for the first half of the month to the north side for the last half of the month, during the months April through to November. During the winter months, parking is exclusively permitted on the south side of Whitmore Avenue. A maximum signed one(1)hour parking regulation is in effect, during the hours 8:00 am to 7:00 pm, with a maximum unsigned three (3) hour parking regulation for all other times, except during the hours 12:00 midnight to 6:00 a.m. when an exclusive on-street permit parking regulation is in effect, for any vehicle displaying a valid on-street parking permit stating Hanson Road.

Mr. W. Richman is requesting that a designated disabled parking space be established directly in front of his residence, as well as his neighbours located at 345 Whitmore Avenue having received their consent, to coincide with the alternate parking regulations, without disrupting vehicular traffic flow.

As Council is aware, any person currently possessing a valid provincial permit bearing the international symbol of access is exempt from the following on-street traffic regulations:

(1)Payment to engage a parking meter;

(2)"No Parking" for a period longer than 3 hours;

(3)"No Parking" restrictions, other than rush hour prohibitions,

i.e. 7:00 to 9:00 a.m. or 4:00 to 6:00 p.m.; and

(4)Signed maximum parking duration regulations, i.e. 1 hour.

A disabled parking permit, however, does not exempt the motorists from parking without an on-street parking permit between 12:00 midnight and 6:00 a.m., on those streets where this restriction is in effect. Should Mr. W. Richman wish to leave his vehicle on the roadway during these times, it will be necessary for him to obtain a current on-street parking permit stating WhitmoreAvenue.

Mr. W. Richman does possess a valid Province of Ontario Disabled Parking Permit #000894, expiring in March 2002.

Conclusions:

Based on this information, Mr. W. Richman can legally park on the north side of Whitmore Avenue where on-street parking is presently prohibited, during the first half of the month from April through to November, including the winter months, which would result in an impediment to emergency and service vehicles utilizing the street.

In view of this and the fact that Mr. W. Richman has obtained permission from his neighbour residing at 345 Whitmore Avenue to designate a disabled parking space on their side of the street. This would enable the City to create a designated disabled parking space on both the north and south sides of the street, to coincide with the legal parking regulations, without disrupting traffic.

It is, therefore, recommended that a designated disabled parking space be established on both the north and south sides of Whitmore Avenue, directly in front of municipally addressed properties 360and 345 respectively to accommodate a single motor vehicle.

Consent Agreement Arising from a

Committee of Adjustment Decision

1956 Weston Road - Ward 27, York-Humber

(City Council on June 3, 4 and 5, 1998, adopted this Clause, without amendment.)

The York Community Council recommends the adoption of the following report (May12,1998) from the York Solicitor:

Purpose:

To obtain the authority for the Chief Financial Officer and Treasurer and the City Clerk, on behalf of the City, to enter into a Consent Agreement with respect to the subject property.

Funding Sources, Financial Implications and Impact Statement:

Not applicable.

Recommendations:

(1)That the Chief Financial Officer and Treasurer and the City Clerk be authorized, on behalf of the City, to execute a Consent Agreement with respect to 1956 Weston Road, in the former City of York, such Consent Agreement to be in a form satisfactory to the CitySolicitor; and

(2)That the City require conveyance of the laneway referred to in this report, such conveyance to be satisfactory to the City Solicitor.

Council Reference/Background/History:

This matter arises out of the Committee of Adjustment Decision dated June 18, 1996 under Application No. CA-96-82 pertaining to the subject property. The property is located near the northwest corner of Weston Road and Lawrence Avenue West in the former City of York. The building on the property was formerly occupied by the S.S. Kresge Company. The building fronts on Weston Road and has a frontage of approximately 23.902 metres. There is a large parking lot at the rear of the building with frontage on Lawrence Avenue West of approximately 49.85 metres. The total lot area is approximately 7,916.5 square metres (1.96 acres). A sketch of the property is attached as Schedule "A" to this report.

The owner of the building wishes to demolish the rear portion of the existing building and create four separate commercial units within the remaining portion of the building. Under the severance application, the owner also proposed the creation of separate parts for the purpose of shared parking, loading, garbage storage and access from Lawrence Avenue West to the rear of the proposed four commercial units. The retained lands would consist of the existing parking lot.

By its decision dated June 18, 1996, the Committee of Adjustment granted the severance subject to a number of conditions being fulfilled within one year from the date of its Decision. Condition No.7 of the Decision required that the owner enter into a Consent Agreement with the City to provide for the following matters:

(a)the construction, maintenance, repair and reconstruction of the parking area, garbage storage and loading area, and any associated underground services in relation to the lands shown as Part 5 on the attached sketch;

(b)the restricted use of Part 5 on the sketch for surface parking, garbage storage and loading facilities and the use of Part 6 on the sketch as a private access lane if the lane is not conveyed to the City;

(c)snow removal from the lands shown as Part 5 on the sketch;

(d)the designation and allocation of parking spaces to each of the four separate commercial units being created;

(e)the lighting of the parking area on the Part 5 lands;

(f)the granting in favour of the properties municipally known as 1946, 1948 and 1952WestonRoad, of an easement or right-of-way satisfactory to the City Solicitor for access from the rear of those properties to Lawrence Avenue West over Parts 5 and 6 shown on the sketch or from the rear of those properties over Part 5, if Part 6 is conveyed to the City as a public lane. The Owner shall prepare and register the said easements where approval and acceptance is given by the owners of the benefiting lands and where such approval and acceptance is not forthcoming, the owner shall prepare and deliver the easements to the City;

(g)the granting to the City of a one-year period from the date of the Committee of Adjustment's decision, to express whether or not the City will require conveyance of the laneway shown as Part 6 on the sketch for public purposes;

(h)the construction of a laneway over Part 6 on the sketch to City standards, at no cost to the City, in the event that the City expresses an interest in acquiring title to the lane;

(i)the sharing of the maintenance, repair and reconstruction costs of the laneway;

(j)the granting in favour to the property municipally known as 1966 Weston Road, of a right-of-way for access to the rear of the said property from Lawrence Avenue West, over Part 6 in the event that Part 6 is not conveyed to the City as a public laneway. The owner shall prepare and register the said easement where approval and acceptance is given by the owner of the benefiting lands and where such approval and acceptance is not forthcoming the owner shall prepare and deliver the easement to the City;

(k)that the owner pursue the Rezoning and Plan of Subdivision applications with respect to the retained parking lot and receive a final decision by Council within one year of the filing of those applications;

(l)the registration of the Consent Agreement on title to the lands and to provide for the payment by the owner of the Consent Agreement fee and registration fee; and

(m)for other matters as deemed appropriate by the City Solicitor.

A copy of the decision of the Committee of Adjustment dated June 18, 1996 is attached as Schedule"B" hereto.

The Board of Management of the Weston Business Improvement Area appealed the Decision of the Committee of Adjustment to the Ontario Municipal Board. By its decision dated December22,1997, the Ontario Municipal Board allowed the appeal in part, subject to certain conditions including that a Consent Agreement be entered into with the City. The matters to be dealt with under the Consent Agreement are essentially the same as required by the Committee of Adjustment, with the exception that the owner need not pursue the Rezoning and the Plan of Subdivision applications with respect to the retained lands (the rear parking lot area) and with the revision to paragraph (g) above that the City has one year from the date of the OMB's Decision to determine whether or not the City requires title to the laneway as shown on Part 6.

A copy of the Ontario Municipal Board Decision dated December 22, 1997 is attached as Schedule"C" hereto.

Comments and/or Discussion and/or Justification:

Planning Department staff are satisfied with the conditions imposed by the Ontario Municipal Board with respect to the subject property. The conditions imposed by the OMB largely reflect the recommendations made by the Planning Department to the Committee of Adjustment. The entering into of the Consent Agreement is necessary in order for the owner of the subject property to finalize its severance. The Consent Agreement will provide for the matters set out in the decision of the Ontario Municipal Board.

Planning Department and Works Department staff are in support of the laneway shown as Part 6 on the sketch being conveyed to the City. It will provide service access to businesses along this portion of Weston Road.

Conclusions:

(a)Damage to Basement of 12 Eileen Avenue

by Roots from Tree on City Property

Ward 27, York-Humber.

The York Community Council reports having discussed this matter in camera in view of pending litigation by the owner of 12 Eileen Avenue against the City, and having:

(1)forwarded the following correspondence to the City Solicitor, to take into consideration when reporting to the Corporate Services Committee on a general policy for paying claims arising from damages to private property by roots from City-owned trees; and that if applicable, the owner of the property at 12Eileen Avenue be considered for retroactive compensation; and

(2)received the confidential information provided by the York Solicitor.

(i)(April 30, 1998) advising that Ms. Margaret Zerafa has reported damages to her basement that she claims was caused by a tree located on City property; providing a letter from John J. Blatinecz, PH.D., Professor of Wood Science, Faculty of Forestry, University of Toronto, confirming that the root came from a silver maple tree, most likely from the one on the subject property since that tree is the closest to the house (at about 20 feet); and also a letter from J. W. Kidd, Acclaim Adjusting Service Inc.(representing the insurers of the former Corporation of the City of York) advising Margaret Zerafa that in order for her to be successful in her claim against the City, she must demonstrate the City was negligent in some way even if she shows roots from a City tree invaded her drain and basement and suggesting she seek independent legal advice.

(ii)(April 20, 1998) from Mr. John Balatinecz, Professor of Wood Science, to Mr.PeterSilverman, City TV, providing information confirming that the tree on the front lawn at 12 Eileen Avenue was a silver maple; that an examination was conducted on the root sample and it was determined that the root came from the silver maple tree.

(iii)(October 20, 1997) from Mr. J.W. Kidd, Acclaim Adjusting Service Inc. to Ms.MargaretZerafa, 12 Eileen Avenue, advising that the York Building Department report does not confirm the presence of roots in the drain and basement from a City tree; that the York Works Department advises that there is no previous history of tree root problems at this address; that the City has to be shown as negligent; that the claim is denied in full; and suggesting that independent legal advice be sought.

The York Community Council reports having:

(1)deferred consideration of this matter pending the report from the City Solicitor on a policy for paying claims for damage to private property by City-owned trees; and

(2)forwarded a copy of the following report to the City Solicitor and to the owners of 112 Robina Avenue:

(May 20, 1998) from the City Solicitor, providing information on a claim by the owners of 112 Robina Avenue, that the roots from a City-owned tree allegedly damaged their property; that under the present policy the owners are not entitled to compensation; that it would be appropriate to defer this matter until City Council makes a decision on a new general policy regarding payment of such claims; and that the report be received.

(c)Toronto Police Services - School Safety Campaign

and Parent Safety Program - Ward 27, York-Humber.

The York Community Council reports having endorsed the Toronto Police Services School Safety Campaign and the Parent Safety Program, proposed for the St. John the Evangelist Catholic School and H.J. Alexander Public School.

(May 27, 1998) verbal submission by Officer Talbot Torrance, Toronto Police 31 Division, advising of the conclusion of a five-week safety program involving 11 schools in Toronto; that 875 charges were laid under the Provincial Offences Act and Municipal By-laws; that the program is geared to ensuring the safety of children in school zones; suggesting the same type of campaign for the St. John the Evangelist Catholic School and H.J. Alexander Public School; that a Steering Committee has been formed with representatives from the Transportation Department (North York and York Divisions), the Toronto District School Board, the Toronto Catholic District School Board, the CAA, the Ministry of Transportation, the Toronto Board of Health, the Toronto Police Services and school representatives; and requesting that the Community Council endorse this community initiative.

(d)Ward Boundary Review Process.

The York Community Council reports having:

(i)requested the Staff Working Group to consider using the major arterial roads as natural dividing boundaries as part of "minor refinements", and to consult with appropriate staff at the civic centres;

(ii)invited the Staff Working Group to attend the Community Council meeting scheduled for June 24, 1998 to explain the process; and

(iii)amended Councillor Nunziata's resolution by deleting all references to the holding of public consultation meetings "on the roles and responsibilities of Community Councils", so that the resolution refers only to public consultation meetings for the "Ward Boundary Review Process".

The Community Council submits the following communications:

(i)(May 7, 1998) transmittal letter from the City Clerk forwarding Clause No. 1 in Report No. 4A of the Urban Environment and Development Committee, advising in part that Community Councils are being requested to hold meetings to invite the public's input on the matter of ward boundaries, ward division and governance, and report thereon through the Urban Environment and Development Committee.

(ii)(May 26, 1998) resolution by Councillor Frances Nunziata, seconded by Councillor Mihevc, that the York Community Council hold a public consultation meeting on the Roles and Responsibilities of Community Councils; and on the Ward Boundary Review Process as recommended by the Urban Environment and Development Committee and adopted by Council.

(2)requested the Commissioner of Planning and Urban Development Services to report on a policy that would allow municipalities to respond more timely to complaints of violations to the Cleaning and Clearing By-law.

(i)(May 13, 1998) from the York Commissioner of Community Services, advising that warning letters were sent to the owners of 295 Boon Avenue on November 7, 1996 to clear the property of junk, rubbish and debris, with an extension granted to November 22, 1996; that a June 26, 1997 prepaid registered letter was refused by the addressee; written warnings were issued personally by the supervisor providing a compliance date of August 11, 1997; that on August 19, 1997 on instructions from the City, the property was cleared of all junk, rubbish and debris by a private contractor at a cost of $461.00 for labour and dumping costs (two truckloads) to clear the property; and recommending that a rebate for costs incurred to clean up the property not be granted.

(ii)(March 28, 1998) from Inam Dar to the Community Council advising that work was in progress to clear the property of material for which they were not responsible, and requesting that the clean-up charges be withdrawn.

(g)Preliminary Report on Rezoning Application for

(w)Toronto Transit Commission 1999 Service Plan

The York Community Council reports having advised the two Councillors for Ward27 and representatives from the West Park Hospital, to make deputations at the meeting of the TTC when the 1999 Service Plan is being presented.

The Community Council submits the following communication:

(April 30, 1998) from Mr. David L. Gunn, Chief General Manager, Toronto Transit Commission acknowledging receipt of York Community Council's resolution regarding service improvements to both West Park Hospital and the Humber River Regional Hospital, Church Street site; and advising that the service plan is currently being developed and will be presented to the Commission and distributed to City councillors for comments this summer.

(x)Existing Environmental Committees and the Environmental Task Force.

The York Community Council reports having:

(1)directed that a copy of the following transmittal letter (May 7, 1998) from the City Clerk, including the report (March 10, 1998) from the Commissioner of Works and Emergency Services, be sent to the members of the former York Environment Advisory Committee, requesting that they submit their comments to the Chief Administrative Officer regarding the advisory committee's work and potential role in the new City; and

(2)reaffirmed its support for an ongoing environmental advisory committee for York, and that the Special Committee to Review the Final Report of the Transition Team be so advised, after receipt of comments from the Environmental Task Force.

(May 7, 1998) transmittal letter from the City Clerk advising that the Works and Utilities Committee on March 25, 1998), concurred with the recommendation embodied in the report dated March 10, 1998 from the Commissioner of Works and Emergency Services, respecting existing environmental committees and the Environmental Task Force; and that each Community Council advise the Special Committee to Review the Final Report of the Transition Team on the ongoing need for a general environmental advisory committee for its community, after receiving comments from the Environmental Task Force.

(y)Draft Report on Heritage Services Governance Structure and Staffing.

The York Community Council reports having endorsed in principle the proposal submitted by Mr. John Court, member of the former York LACAC, in response to a draft staff report, that the Toronto Preservation Commission and the Toronto Museums Commission be integrated to create a single arms-length agency, and that the City's Culture Office be so advised.

The Community Council submits the following communication:

(May 6, 1998) from Mr. John Court, member, former York LACAC, submitting proposed recommendations in response to a draft staff report (April 22, 1998), which the Culture Office advises is presently undergoing revisions in preparation for a new version of the Heritage report, for consideration by the Miller Committee in June.

Ms. Madeline McDowell, former York LACAC, appeared before the Community Council in connection with the foregoing matter.

(z)Garbage Inspection Process - Ward 27, York-Humber

and Ward 28, York-Eglinton.

The York Community Council reports having requested the Commissioner of Works and Emergency Services to report on the feasibility of introducing a by-law requiring the owners of commercial buildings with apartments above, and multi-unit apartment buildings, to display signs in prominent locations on the door leading to a main street, regarding compliance with the City's by-law with respect to putting out garbage.

The Community Council submits the following memorandum:

(May 14, 1998) from Councillor B. Saundercook expressing concerns regarding the litter and garbage situation in some parts of York, especially on Eglinton Avenue West.

(aa)Additional Lighting in Laneway adjacent to

The York Community Council reports having approved the installation of additional lighting in the laneway adjacent to 6 Hillary Avenue, pending a report from the York Commissioner of Operations Services regarding the process for routing requests for the installation of lighting.

The Community Council submits the following communication:

(April 20, 1998) from Mr. Jerry Mirka, Manager of Engineering, Toronto Hydro-Electric Commission (York Branch) to Councillor Bill Saundercook, advising that the 1998 estimated cost for the installation of 3 - 70 watt HPS luminaires on existing Bell poles including wiring is $2,500.00, the incremental annual energy cost is $85.00, and the annual Bell attachment cost is $60.00.

(bb)Additional Lighting in (a) Laneway at rear of 2543 Eglinton Avenue West;

The York Community Council reports having approved the installation of additional lighting (a) in the laneway at the rear of 2543 Eglinton Avenue West, and (b) along the Pathway in Smythe Park from Edinborough Court to the Park, pending the report from the York Commissioner of Operations Services regarding the routing process for lighting requests.

The Community Council submits the following communication:

(March 6, 1998) from Mr. Jerry Mirka, Manager of Engineering, Toronto Hydro-Electric Commission (York Branch), advising of that the 1998 estimated costs for (a) installing 1 pole complete with 1-70 W HPS luminaire and wiring in the laneway at the rear of 2543Eglinton Avenue West is $1,800.00, and that the incremental annual energy cost is $30.00; and (b) installing along the pathway in Smythe Park from EdinboroughCourt to the park, 4 fibreglass poles complete with 4-150 W HPS luminaires utilizing underground wiring (City forces) is $15,000.00, and the incremental annual energy cost is $250.00; or installing 4 wood poles complete with 4-70 W HPS luiminaires utilizing overhead wiring (Hydro forces) is $8,000.00, and the incremental annual energy cost is $125.00.

(cc)Request for Special Occasion Permit regarding the

Annual Festival of Our Lady of Light, St. Matthew's Church,

September 4-6, 1998 - Ward 27, York-Humber.

The York Community Council reports having:

(1)authorized the City Clerk to forward to the Liquor Licence Board of Ontario, the relevant departmental clearances required for the issuance of a special occasion permit to St. Matthew's Church; and

(2)requested the LLBO to impose a condition that the sale of alcohol be permitted up to 12:00 midnight.

Request for Reactivation of the Westpointe Advisory

The York Community Council reports having deferred the following report to its next meeting scheduled for June 24, 1998:

(May 14, 1998) from the York Solicitor, responding to a request from the Community Council for a report on the history of the Levy site, the status of the current application and any legal implications of the request for reactivation of the Westpointe Advisory Committee; and recommending that the Committee not be activated at the present time.

(ee)Parking Problems on Weston Road from Eglinton Avenue West

to Ray Avenue - Ward 27, York-Humber.

The York Community Council reports that having regard to the concerns of area residents and businesses that the parking meters on Weston Road between EglintonAvenue West and Ray Avenue are discouraging visitors and customers to the area, requested the Toronto Parking Authority to report on:

(1)the usage and revenue from the parking meters on Weston Road between Eglinton AvenueWest and Ray Avenue;

(2)the amount of revenue generated by the municipal parking lot on Weston Road and suggest alternatives to encourage customer parking in the area;

(3)the appropriateness of parking enforcement officers communicating with a particular tow truck operator to tow vehicles; and

(4)the parking meters designed to accept $2.00 coins but provide only $1.00 value in time.

The Community Council submits the following memorandum:

(May 26, 1998) from Councillor F. Nunziata, advising of parking problems at EglintonAvenue West and Weston Road to Ray Avenue, being experienced by the residents and businesses in the area, and concerns regarding the use of the municipal parking lot near Eglinton Avenue West, off Weston Road.

(ff)Request for Removal of Tree at 4 Corbett Avenue

The York Community Council reports having deferred consideration of the following letter to its meeting of June 24, 1998, and directed that the owners of the properties at 6, 8, 13 and 15Corbett Avenue be notified of the proposed removal of the tree, and that the City Clerk be advised of any concerns/comments by June11,1998:

(May 25, 1998) from Councillor F. Nunziata, forwarding a letter (May 25, 1998) from KevinBowser, YorkDirector of Parks, advising that 4 Corbett Avenue is the site of construction of two, new semi-detached homes, and that the owner is requesting that a City-owned Siberian Elm tree located in front of the westerly residence, be removed.

(gg)Request for Traffic Calming Project in the Pelmo area of Ward 2

The York Community Council reports having requested the Commissioner of Works and Emergency Services to direct the York Commissioner of Operations Services, to consult with staff of the North York Civic Centre regarding the following proposals, and to report back to the Community Council:

(May 22, 1998) from Councillor B. Saundercook requesting that staff of the York Works Department be requested to meet with staff of the North York Works Department, to discuss the feasibility of:

(1)extending the traffic calming project underway in the Pelmo area of Ward 2, to the Wendell/Queenslea intersection; and

(2)constructing a traffic island at this intersection similar to other traffic islands in the area.

(hh)City Powers, Policies and Procedures regarding the Conversion

to Condominium and Demolition of Rental Housing before and

after the Proclamation of the Tenant Protection Act.

The York Community Council reports having deferred consideration of the following communications to its next meeting to be held on June 24, 1998:

(May 20, 1998) transmittal leter from the City Clerk, advising that the Urban Environment and Development Committee had recommended to Council adoption of a report (May1,1998) from the Commissioner of Urban Planning and Development Services, subject to several amendments, including that a copy of said report be forwarded to the Community Councils for review.

(ii)Pilot Project regarding Possible Locations for

the Installation of Red Light Cameras.

The York Community Council reports having requested the Commissioner of Works and Emergency Services to:

(1)examine the following intersections as possible sites for a pilot project to install red light cameras:

(A)St. Clair Avenue West and Dufferin Street;

(B)St. Clair Avenue West and Vaughan Road;

(C)Jane Street and Eglinton Avenue West;

(D)Weston Road and Eglinton Avenue West;

(E)Dufferin Street and Eglinton Avenue West; and

(F)Black Creek Drive and Eglinton Avenue, and

(2)consult with the Toronto Police Services with regard to statistics to determine the most suitable location for the cameras, should only one of the aforementioned intersections be considered.

The Community Council submits the following motion by Councillor Mihevc:

Whereas the Premier of Ontario has agreed to a pilot project for the installation of red light cameras and intersections; and

Whereas the intersections at St. Clair Avenue West and Dufferin Street, and St.ClairAvenueWest and Vaughan Road, are two of the most dangerous intersections, as indicated by the traffic fatalities involving pedestrians;

Therefore be it resolved that the Commissioner of Works and Emergency Services be requested to examine the above intersections as possible sites for the pilot project.

(jj)Extension of Parkskeeper Program to all

Residents in the former City of York

Ward 27, York-Humber and Ward 28, York-Eglinton.

The York Community Council reports having deferred consideration of the following motion for two months, to allow the Councillors for Ward 27, York-Humber, to discuss this matter:

Moved by Councillor Saundercook:

Whereas the maintenance of City parks has always been a municipal responsibility; and

Whereas an inadequate tax base in the past forced the municipality to look for creative ways to maintain City resources and services; and

Whereas the Councillor for Ward 7 in the former City of York initiated a parkskeeper program, raising funds from the private sector for honoraria to reward volunteers for keeping their local parks clean; and

Whereas a Councillor is now advertising this private sponsorship program in the local Guardian newspaper to the residents in Ward 27; and

Whereas it is unfair to offer this program to residents of only one part of the former CityofYork, unlike the honoraria program to maintain former City of York ice rinks;

Therefore be it resolved that the Parkskeeper Program be extended to all residents in Wards27 and 28.
