The York Community Council submits the following communication (June 5, 1998) from CouncillorFrances Nunziata, York-Humber:

I am attaching for your information or any attention deemed necessary, a communication dated May17, 1998 from Mr. Henry Formosa, President, Maltese Canadian Federation, requesting the use of Lambton Park for the annual Maltese Community Festival. Approval was granted by the York Commissioner of Community Services to hold this event on Sunday, June 28, 1998.

It is my understanding that the Alcohol and Gaming Commission of Ontario requires that all Community Festivals be designated by either a resolution of the municipal council or a delegated municipal official. I am attaching a copy of that designation from the York Commissioner of Community Services dated June 3, 1998, as well as the completed application form.

Also, as required, I have forwarded a copy of Mr. Formosa's communication to the appropriate Police division for their information.

Consent Agreement Arising from a

Committee of Adjustment Decision

1576 Weston Road - Ward 27, York-Humber

The York Community Council recommends the adoption of the following report (June8,1998) from the York Commissioner of Development Services:

Purpose:

To obtain the authority for the Chief Financial Officer & Treasurer and Clerk, on behalf of the City, to enter into a Consent Agreement with respect to the subject property.

Funding Sources, Financial Implications and Impact Statement:

Not applicable.

Recommendation:

That the Chief Financial Officer & Treasurer and Clerk be authorized, on behalf of the City, to execute a Consent Agreement with respect to 1576 Weston Road, in the former City of York, such Consent Agreement to be in form satisfactory to the City Solicitor.

Council Reference/Background/History:

This matter arises out of the Committee of Adjustment decision dated April 14, 1998 for odd numbered consent applications CA-98-81 to CA-98-101 inclusive. The applications pertain to the property municipally known as 1576 Weston Road located on the northwest corner of Weston Road and Clouston Avenue in the former City of York. The building on the property was formerly occupied by a car leasing operation. The property has a length of 56.03 metres measured along Weston Road and a lot area of approximately 2006 square metres (0.5 acres).

The owner of the property wishes to demolish the existing building and create 12 separate lots each to be developed with a townhouse. Six townhouses will front on Clouston Avenue and will have built-in garages with driveway access to the street. The other six townhouses will front on Weston Road and each will have a rear yard parking space accessed from a new lane leading to Clouston Avenue. Under the consent applications, the owner also proposes the creation of two separate parts for the purpose of conveying a parcel (Part 19) to the City for a public lane and a parcel (Part 20) along the full length of Weston Road for roads purposes. The lot subdivision plan and the site plan are attached as Schedules A and B, respectively.

By its decision dated April 14, 1998, the Committee of Adjustment granted provisional consent subject to a number of conditions being fulfilled within one year from the date of its decision. Condition "A" of the decision requires that the owner enter into a Consent Agreement with the City to be registered on title to subject lands and to provide for the following matters:

(1)Construction of the lane over Part 19 to municipal standards, including lighting, to the satisfaction of the Operations Services Department and York Hydro;

(2)Construction of all municipal services, including utilities, within the lane (Part 19) to the satisfaction of the Operations Services Department;

(3)A warning clause to advise of the City's lack of maintenance provisions of the lane, with respect to snow removal (including sanding and salting);

(4)The connection of municipal services and utilities constructed on site of the existing off-site municipal services and utilities, including any improvement, replacement or extension of such existing off-site municipal services and utilities, all to the satisfaction of the Operations Services Department;

(5)Conveyance of the following parcels:

-Lands on the west side of Weston Road (Part 20) to the City; and

-Part 19 to the City for public lane purposes.

(6)The provision of all works and facilities required by the agreement, at no cost to the city;

(7)Time frames for providing the required works and facilities, and limitations on building permits and occupancy of residential units;

(8)Financial security to guarantee completion of the required works and facilities;

(9)The Submission to the Chief Building Official, a completed "Record of Site Condition" pursuant to the Ministry of the Environment and Energy "Guideline for Contaminated Sites in Ontario", stating in Part 3 of the "Record of Site Condition" that the lands are suitable for Residential/Parkland uses, and such "Record of Site Condition" shall be marked as having been received by the Ministry of the Environment and Energy;

(10)The applicant pay to the City a levy for parks or other public recreational purposes equivalent to 5% of the total value of the severed land. For this purpose the value of the land is to be determined by a qualified appraiser acceptable to the City, and

(11)Any other matters deemed appropriate by the City Solicitor.

A copy of the decision of the Committee of Adjustment dated April 14, 1998 is attached as Schedule"C".

Comments and/or Discussion and/or Justification:

The condition to enter into a Consent agreement as imposed by the Committee of Adjustment reflects the recommendations made by the Planning Department to the Committee of Adjustment. The entering into of the Consent Agreement is necessary in order for the owner of the subject property to finalize the land severance and advance the development to the building permit stage. The agreement is currently being prepared in a form satisfactory to the City Solicitor.

Conclusions:

The entering into a registration of the Consent Agreement against title to the subject property will satisfy one of the conditions imposed by the Committee of Adjustment to sever the subject property for a 12 unit freehold townhouse development.

Alteration of Various Streets to Facilitate

1998 Traffic Calming Measures

Ward 27, York-Humber & Ward 28, York-Eglinton

The York Community Council recommends the adoption of the following report (June5,1998) from the York Commissioner of Operations Services:

Purpose:

To facilitate implementation of traffic calming measures on various streets, within Wards 27 and 28, representing York Humber and York Eglinton, respectively.

Funding Sources, Financial Implications and Impact Statement:

A sum of $500,000.00 has been approved within the 1998 Capital Budget for traffic calming.

Recommendation:

That the City Solicitor be authorized to submit By-laws for alterations on the following streets to facilitate traffic calming:

(1)Alameda Avenue;

(2)Arlington Avenue;

(3)Atlas Avenue;

(4)Everden Road;

(5)Greenbrook Drive;

(6)Heath Street;

(7)Winnett Avenue; and

(8)Winona Drive.

Council Reference/Background History:

To facilitate those projects identified in the 1998 Capital Budget for traffic calming within Wards27 and 28, representing York Humber and York Eglinton, respectively.

Comments and/or Discussion and/or Justification:

The sum of $500,000.00 has been allocated within the 1998 Capital Budget for traffic calming, within both York-Humber and York-Eglinton Wards.

These projects are a result of public initiatives within various communities, as outlined below:

Ward 28 - Neighbourhood Speed and Traffic Management Plan

City Council retained the services of Delcan Corporation to undertake a Neighbourhood Speed and Traffic Management Plan, within the area bordered by Oakwood Avenue to the west, Eglinton Avenue West to the north, Everden Road/Arlington Avenue to the east and Vaughan Road to the south.

The study was managed by a Traffic Task Force, represented by local area residents, transportation staff, the local councillor and local businesses.

Developed within the final draft is four (4) individual neighbourhood speed and traffic management plans. These plans vary from "open" unimpeded access to and from the community to "very restrictive" completely eliminating non-local vehicular traffic.

On September 11, 1997, an open house session was held with the community to present the four (4) neighbourhood speed and traffic management plans for comment and criticism. Based on the written comments received it was concluded that no changes were necessary to any one of the four (4) neighbourhood speed and traffic management plans.

As a result, a meeting was held with the local Councillors to discuss the advantages and disadvantages of each of the four (4) individual neighbourhood speed and traffic management plans. Based on this meeting it was decided to proceed with implementing only the common traffic calming measures featured within each of the four (4) neighbourhood speed and traffic management plans. The common traffic calming measures being raised pedestrian crossings at nine (9) separate intersections, representing Phase 1 of the overall neighbourhood speed and traffic management plan.

Included also, is a request to enhance pedestrian safety within the intersection of Heath Street and Tweedsmuir Avenue. As a result of our review, we are recommending raising the pedestrian crossings on each of the four approaches within the intersection to improve and enhance pedestrian safety.

Ward 27 - Completion Traffic Calming Plan

The residents of Greenbrook Drive between Keele Street and Trethewey Drive developed a traffic calming plan, which was approved by Council and partially implemented in 1997. The traffic calming plan includes road narrowings, with speed regulator humps at strategic locations along Greenbrook Drive between Keele Street and Trethewey Drive.

Conclusions:

Based on the fact that these neighbourhood speed and traffic calming plans involved an extensive development and consultation process within each individual community we, therefore, recommend that the various traffic calming measures approved on each of the individual streets be implemented.

Tree Removal By-law

(City Council on July 8, 9 and 10, 1998, adopted this Clause, without amendment.)

The York Community Council recommends the adoption of the following report (June2,1998) from the York Commissioner of Operations Services:

Purpose:

The purpose of this report is to request Council to direct the Legal Services Division to prepare a by-law to approve the removal of City-owned trees. The properties and reasons for removal are described in this report.

Funding Sources, Financial Implications and Impact Status:

Removal and planting costs are approved in the 1998 Operating Budget.

Recommendation:

That the City Solicitor be authorized to prepare a by-law for the removal of City-owned trees, and that forestry staff begin removal and planting.

Comments:

In accordance with York Policy, attached is a list of locations where trees located on City property have either been removed or are in need of removal and the reason for their removal.

It should be noted that in each case, where a tree has been removed, the resident has agreed to permit the City to plant a replacement tree.

Conclusion:

Upon approval by Council, city forces will begin removal and planting of replacement trees.

Removal of Tree at 4 Corbett Avenue

Ward 27, York-Humber

(City Council on July 8, 9 and 10, 1998, adopted this Clause, without amendment.)

The York Community Council recommends that:

(1)the City-owned Siberian Elm tree located in front of the westerly residence at 4CorbettAvenue, be removed;

(2)the Commissioner of Economic Development, Culture and Tourism, be authorized to:

(a)accept $1,000.00 from the owner(s) of 4 Corbett Avenue, in return for the removal of the tree and its replacement with a B&B tree, following construction; and

(b)use the $1,000.00 for the planting of trees in the community along CorbettAvenue; and

(4)the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

The Community Council submits the following communication (May 25, 1998) from Mr.KevinBowser, York Director of Parks to Councillor Frances Nunziata:

The above address is the site of construction two, new semi-detached homes, and we have recently received a request from Mrs. Cerqueira, owner of 4 Corbett Avenue to remove a City-owned Siberian Elm tree, located in front of the westerly residence.

Please note that at the March 24, 1997 Works and Parks Committee meeting (Item B-12), the removal of a second, smaller tree (in front of the proposed No. 2 Corbett Avenue) was conditionally approved i.e. requiring receipt of $500.00 (for replanting) and notification of the proposal to four neighbours (Nos. 6, 8, 13, and 15 Corbett Avenue).

In March, 1997, the remaining tree was valued at $1,200.00. Currently, as a result of some Hydro pruning to facilitate new hydro lines, the subject tree is valued at $1,000.00.

Recommendation:

That upon approval by the York Community Council to remove the City-owned Siberian Elm tree at 4 Corbett Avenue, and notification of this proposal to the same four Corbett Avenue neighbours (Nos. 6, 8, 13, and 15), that permission be granted to the York Parks Division to accept $1,000.00 in return for the removal of the tree and replacement with a burlapped root ball ( B and B) tree at No. 4 Corbett Avenue following construction.

Please advise as soon as possible if you are in agreement with this proposal as the applicant, Mrs.Cerqueira, is in the process of construction and therefore anxious for resolution of this matter.

Street Lighting Improvements on Eglinton Avenue West

Between Bicknell Avenue and Richardson Avenue

Ward 27, York-Humber

The York Community Council recommends the adoption of the report dated June 26, 1998 from the York Commissioner of Operations Services.

The Community Council reports, for the information of Council, having requested:

(i)the Toronto Hydro-Electric Commission to proceed with the installation of the street lighting improvements as soon as possible; and

(ii)the York Commissioner of Operations Services to:

(a)submit a report to Council for consideration with this Clause, identifying the accounts to which this expenditure is to be charged; and

(b)remove the tree planter in front of 2524 and 2520 Eglinton Avenue West.

The Community Council submits the following report (June 26, 1998) from the York Commissioner of Operations Services:

Purpose:

To obtain approval to implement street lighting improvements on Eglinton Avenue West, from Bicknell Avenue to Richardson Avenue, as recommended by the Toronto Hydro-Electric Commission.

Funding Sources, Financial Implications and Impact Statement:

The estimated cost of the recommended street lighting improvements is $35,000.00. Funding of the improvements is proposed to be divided between Lane Lighting Capital Account No.458-56 ($20,000.00) and Street Lighting Capital Account No. 459-561 ($15,000.00).

Recommendation:

It is recommended that City Council approve the expenditure of $20,000.00 from Lane Lighting Capital Account No.458-56 and $15,000 from Street Lighting Capital Account No. 459-561 towards street lighting improvements on Eglinton Avenue West, as recommended by the Toronto Hydro-Electric Commission.

Background:

In March 1998, the Toronto Hydro-Electric Commission, conducted a street lighting audit along Eglinton Avenue West, from Bicknell Avenue to Richardson Avenue. The audit was carried out at the request of the Keele-Eglinton Business Improvement Area, who feel strongly that improved street lighting will help address crime-related issues in the area. On May 6, 1998, York Community Council had before it a letter dated from April 9, 1998 from the Toronto Hydro-Electric Commission identifying the results of their audit. The letter explained that, while the existing lighting exceeded that necessary for a major arterial road, Hydro recommends that six new poles be installed and that the existing 400 watt luminaires be replaced with 200 watt luminaires. The estimated cost of the proposed improvements is $35,000.00.

Upon further discussion with Hydro staff, they explained that the proposed additional poles and less powerful luminaires will not result in greater levels of street lighting, but in a more even distribution of the existing lighting levels. As a result, there will be fewer dark areas along this section of Eglinton Avenue West. Community Council deferred consideration of the Hydro recommendations pending a staff report regarding the feasibility of installing decorative pedestrian lighting in this area as a more effective means of improving safety and improving the area's appearance. Community Council also requested the General Manager of the Toronto Hydro-Electric Commission to report on the level of lighting on arterial roads in York compared with other areas of the City.

The Community Council also requested that we clarify the procedure for the funding of street and lane lighting along with the approval process. Prior to amalgamation, the funding for the installation of street and lane lighting was provided within the current operating budget of the City. When Council approved the installation of lighting, the work was carried out by York Hydro. We understand that this is the procedure we are to continue to follow in 1998.

In 1997, the City of York allocated $20,000.00 for the installation of street lighting, $120,000.00 for the installation of lane lighting, and $449,000.00 for maintenance and energy cost. It is our understanding that this budget has been maintained in 1998. However, in 1997, the actual cost of maintenance and energy cost exceeded the budget by approximately $32,000.00. To keep the lighting budget within the approved funding, it is necessary that the shortfall of $32,000.00 be provided from lane lighting capital account. In addition the following expenditures have been committed to the aforementioned accounts:

Lane lighting:$18,100.00

Street lighting:$ 3,399.00

As the estimated cost for the street lighting improvements on Eglinton Avenue West between Bicknell Avenue and Richardson Avenue is approximately $35,000.00, that $15,000.00 be provided by the street lighting capital account and the balance of $20,000.00 be transferred from the lane lighting capital account to cover the full cost of this project.

At their meeting on June 24, 1998, York Community Council considered a letter dated June19,1998 from the Keele-Eglinton B.I.A., requesting that the installation of the proposed street lighting improvements not be delayed pending further study of arterial road lighting levels throughout Toronto or the feasibility decorative pedestrian lighting. Planning staff reported verbally that the issue of decorative pedestrian lighting will be addressed through a comprehensive streetscaping program being developed as part of the Eglinton Avenue West Community Plan, which will be presented to Council this Fall.

Funding of Recommended Street Lighting Improvements:

As noted above, funding for the proposed street lighting improvements can be drawn from the Lane Lighting Capital Account No. 458-56 ($20,000.00) and Street Lighting Capital Account No.459-561 ($15,000.00).

Conclusion:

On June 24, 1998, York Community Council approved street lighting improvements on Eglinton Avenue West in accordance with recommendations of the Toronto Hydro Electric Commission. The estimated cost of the improvements is $35,000.00. I recommend that funding of these improvements be drawn from the Lane Lighting Capital Account No. 458-56 ($20,000.00) and Street Lighting Capital Account No. 459-561 ($15,000.00).

The Community Council also submits the following communication (April 9, 1998) from the Toronto Hydro-Electric Commission to the York Economic Development Office:

In response to your request regarding the feasibility of installing lighting on both sides of EglintonAvenue West from Bicknell Avenue to Richardson Avenue, I submit the following:

Eglinton Avenue West:

-the existing lighting is well above the 22lux level recommended for a major arterial road;

-any improvement requires Council approval for required funding;

-adding additional illumination would increase operating costs as well as impairing motorists' visual acuity when entering and exiting the area;

-recommend replacing fourteen (14) existing 400 watt luminaires with 200 watt luminaires;

-install thirteen (13) additional 200 watt luminaires and six poles;

-upgrade the underground street lighting system between Bicknell Avenue and Keele Street.

Estimated cost is $35,000.00.

Lane Lighting

The only laneway in the immediate area that is not illuminated is located immediately south of Eglinton Avenue West and runs east and west from Yarrow Road to a dead end.

-recommend installing one pole and one luminaire in each section of laneway.

Estimated cost is $3,500.00.

The Community Council also submits the following communication (June 19, 1998) from Mr.SteveTasses, Chair, Keele-Eglinton B.I.A.:

This letter is to inform you of two very important resolutions passed by the Keele-Eglinton Business Improvement Area at the June 9, 1998 Board of Management meeting as part of its ongoing efforts to improve the BIA.

The first resolution calls for the City of Toronto, York Community Council to approve upgrading street lighting on Eglinton Avenue from Bicknell Avenue to Richardson Avenue as identified in the Toronto Hydro audit of April 9, 1998. Since the Hydro audit was carried out business owners, residents, two police officers, a Hydro Inspector and Councillors Nunziata and Saundercook took part in a safety audit of the BIA which identified upgrading street lighting as a priority to improve the conditions on Eglinton Avenue West between Bicknell Avenue and Glenhaven Street, further east of the area identified in the Hydro audit.

The BIA feels that the installation of upgraded lighting should not be delayed while lighting levels on arterial roads in Toronto are compared as recommended by York Community Council on May6,1998. Furthermore, the BIA welcomes the possibility of decorative lighting at a later date as council recommended this be investigated on Eglinton Avenue West between Bicknell Avenue and Bathurst Street.

The second issue addresses the removal of a spray-painted planter containing a vandalized tree in the front of 2524 and 2520 Eglinton Avenue West. The Board of Management agreed to pass a resolution urging council to approve the removal of the tree planter at the above address and to remove the graffiti on the existing planters located on the north side of Eglinton Avenue West between Keele Street and Glenhaven Street.

By installing upgraded lighting and removing vandalized tree planters and trees, the Keele-Eglinton BIA will be two steps closer to improving the business and residential community in the area.

Thank you for your support in the above matters.

The Community Council also submits the following communication (May27,1998) from Mr.MurrayS.Lennox, Vice President, Special Projects, Toronto Hydro-Electric Commission:

(1)As requested we have proceeded with the lighting of the east/west lane immediately south of Eglinton Avenue West, from Yarrow Road to a dead end. Estimated cost - $3,500.00.

(2)The proposed lighting improvements on both sides of Eglinton Avenue West, from BicknellAvenue to Richardson Avenue, has been deferred.Estimated cost - $35,000.00.

(3)Decorative Lighting Fixtures - Eglinton Avenue West, from Bicknell Avenue to RichardsonAvenue. Feasibility Study - we await your direction.

(4)(a)The level of lighting on arterial roads in York is the same as the rest of the new CityofToronto, except for North York and one or two streets in Toronto. The average maintained light level throughout the City on arterial roads is the minimum level of 2 fc recommended by the Illuminating Engineering Society of North America (IESNA). The average level on arterial roads in North York varies from 3 fc in residential areas, to 4 fc in commercial areas. In some parts of Toronto, the level is 2.5 to 3 fc. In various parts of the City where pedestrian scale lighting has been installed in addition to the standard street lighting, the light level has been increased above the minimum of 2 fc and varies from location to location, depending on the installation.

(b)Establishing a standard level of street lighting throughout the City of Toronto is an issue that needs to be addressed. This is an issue that was identified and discussed during the preparation of our recent proposal for street lighting to the City of Toronto, but was not included in the proposal document. We are prepared to address this concern at the convenience of the City. However, the proposal would create a capital investment for the City.

(a)Black Creek Business Area Association (BCBAA) Revitalization Action Plan

Ward 6, North York Humber and Ward 27, York-Humber.

The York Community Council reports having approved the following joint report:

(June 19, 1998) from the York Director, Economic Development Office and the Executive Director, North York Economic Development Office, forwarding the Black Creek Business Area Association Revitalization Action Plan prepared by Cumming & Company, Planning and Management Services, in consultation with the BCBAA; advising that the Plan sets out strategies for undertaking future marketing projects, potential infrastructure improvement which would stimulate economic growth, and develop a new vision and framework for the future of the organization; and recommending that:

(1)the Black Creek Business Area Association Revitalization Action Plan be received;

(2)this report and the accompanying BCBAA Revitalization Action Plan be forwarded for information to the Economic Development Committee; and

(3)the Revitalization Action Plan be referred to the Commissioner of Economic Development, Culture & Tourism and that reports be submitted to the appropriate committee(s), as necessary, with respect to the implementation of projects recommended through the Revitalization Action Plan.

The Community Council also submits the following communications:

(i)(June 24, 1998) from Ms. Ella Jackson, Vice Chair, Black Creek Business Area Association, presenting the achievements of the BCBAA and advising of a ten step process established to achieve their goals.

(ii)(June 5, 1998) from Councillor Frances Nunziata advising that the BCBAA would like to make a presentation to the York Community Council.

The following persons appeared before the Community Council in connection with the foregoing matter:

(b)St. Matthew Catholic School Site Master Plan - Request for a

50/50 Cost Sharing Arrangement between the City of Toronto

and the Toronto Catholic District School Board.

The York Community Council reports having approved the following resolution:

(May 28, 1998) from Councillor Nunziata:

WHEREAS the St. Matthew Catholic School community has developed a Site Master Plan to address long standing concerns with respect to ensuring the safety and security of students and children; and

WHEREAS the parent community has raised over $5,000.00 towards this initiative and the St. Matthew School Council is now requesting a 50/50 cost sharing agreement between the Board and the City of Toronto to bring the Site Master Plan to fruition;

THEREFORE BE IT RESOLVED that the York Community Council, in recognition of the shared responsibility of ensuring the safety of children and providing recreational opportunities to the community, recommends that the Commissioner of Economic Development, Culture & Tourism, be requested to report on the City of Toronto entering into a 50/50 cost sharing agreement with the Toronto Catholic District School Board on the St.Matthew Site Master Plan - Phase 1.

The Community Council submits the following communication:

(June 24, 1998) from Ms. Donna Cousineau, Chair, St. Matthew Catholic School Council and Mr. Jim Cooney, Principal, St. Matthew Catholic School, providing background information on a Master Plan for the development of the St. Matthew School site; advising that Phase 1 is estimated to be $160,000.00, plus 20% construction cost; that donations have been secured from the:

TD Bank-$ 500.00

Friends of the Environment (Canada Trust)-$10,000.00

St. Matthew Parent Community-$ 5,500.00

and requesting that a cost sharing arrangement be established between the City of Toronto and the Toronto Catholic District School Board.

Request for Reactivation of the Westpointe Advisory Committee

Ward 27 - York Humber.

The York Community Council reports having deferred consideration of this matter to its July 22, 1998 meeting, and having directed that the developer and stakeholders be invited to attend this meeting.

The Community Council submits the following communications:

(i)(May 14, 1998) from the York Solicitor, responding to a request from the Community Council for a report on the history of the Levy site, the status of the current application and any legal implications of the request for reactivation of the Westpointe Advisory Committee; and recommending that the Committee not be activated at the present time.

(ii)(April 6, 1998) from Ms. Ella Jackson, Chair, Westpointe Foresight Group, advising that there has been a new purchaser of the site, the development is proceeding, the Westpointe Advisory Committee has not been convened to monitor current progress, and requesting that the advisory committee be reactivated.

The York Community Council reports having received the following communication:

(June 24, 1998) from Mr. John Hollins, Director of Elections, project leader for the Ward Boundary Working Group, providing a summary of the phases and timelines associated with the boundary review process; and attaching a questionnaire for completion by members of Council.

(e)Request for Removal of City-Owned Walnut Tree

located at 314 Kane Avenue - Ward 27, York-Humber.

The York Community Council reports having requested the Commissioner of Economic Development, Culture & Tourism, to direct the York Director of Parks, to report on:

(1)the condition of the City-owned tree at 314 Kane Avenue, and on the concerns expressed by the owner;

(2)the feasibility of establishing a leaf-link program, in consultation with seniors centres; and

(3)whether from a privacy perspective, the City can use medical information as a guideline for consideration of requests to remove City-owned trees.

The Community Council submits the following communications:

(i)(June 11, 1998) from Councillor Nunziata advising that the owner of 314KaneAvenue would like to make a deputation.

(ii)(May 13, 1998) from the York Director of Parks to the owner of 314 Kane Avenue, advising that the walnut tree located on City property does not qualify for removal.

-Mrs. E. Nero appeared before the York Community Council in connection with the foregoing matter.

(f)City Powers, Policies and Procedures regarding the

Conversion to Condominium and the Demolition of

Rental Housing before and after the Proclamation of

The Tenant Protection Act.

The York Community Council reports having received the following communication:

(May 20, 1998) transmittal letter from the City Clerk, advising that the Urban Environment and Development Committee had recommended to Council adoption of a report (May 1, 1998) from the Commissioner of Urban Planning and Development Services, subject to several amendments, including that a copy of said report be forwarded to the Community Councils for review.

(g)Relocation of Departments from the York Civic Centre.

The York Community Council reports having:

(1)approved the following resolution by Council Nunziata; and

(2)requested the Chief Administrative Officer to hold information meetings at least every two months with the inside and outside workers at the York Civic Centre.

WHEREAS departments in the York Civic Service Centre are being relocated to different areas of the City of Toronto and the main switchboard phone number for the Civic Centre was cancelled;

WHEREAS no prior information on the relocations or the cancellation of the main York switchboard number were provided to members of the York Community Council for review and comment and;

WHEREAS some of the changes in service could have a negative impact on the level of and accessibility to municipal services provided to residents of the York community;

THEREFORE BE IT RESOLVED THAT the York Community Council requests that the City Chief Administrative Officer ensure that any plans for relocation of departments in the York Civic Service Centre be forwarded to the members of the York Council for information and the opportunity of providing comment as to implications on service delivery to York residents.

The Community Council also submits the following communication:

(June 10, 1998) from Councillor Frances Nunziata to the Chief Administrative Officer requesting a list of departments where relocation from the York Civic Service Centre is impending or being contemplated and that members of the York Community Council should be provided with an opportunity to provide input on the implications of these relocations on service to their constituents.

Ms. Marjorie Sutton, on behalf of the York Federation of Ratepayers, appeared before the Community Council in connection with the foregoing matter.

(h)Permit Parking on Kitchener Avenue between Gilbert Avenue

and Caledonia Road - Ward 28, York-Eglinton.

The York Community Council reports having requested the City Clerk to conduct a poll of the residents on Kitchener Avenue between Gilbert Avenue and Caledonia, to determine interest in on-street permit parking.

The Community Council submits the following report:

(May 26, 1998) from the York Commissioner of Operations Services advising that a survey revealed a total of eight (8) curbside parking spaces on the north side of Kitchener Avenue between Gilbert Avenue and Caledonia Road, and recommending that on-street permit parking be implemented, subject to the results of a poll indicating that the majority of residents are in favour.

(i)Request for Outdoor Eating Area - Nova Era Bakery,

488-490 Rogers Road - Ward 27, York-Humber.

The York Community Council reports having approved the recommendations in the following report; and having requested the York Commissioner of Operations Services to report to the July 22, 1998 meeting of the Community Council, on the parking requirements for this type of application:

(May 29, 1998) from the York Commissioner of Operations Services, advising that the owner of Nova Era Bakery is requesting permission to establish an outdoor eating area adjoining the premises at 488-490 Rogers Road, within the Watt Avenue road allowance; and recommending that:

(1)the City Clerk give public notice of the application by Nova Era Bakery, for an outdoor eating area within the Watt Avenue road allowance;

(2)the notice invite the public to comment on this application at a York Community Council meeting; and

(3)after hearing public comments, that the Community Council decide whether to grant the permit.

(j)Request for Alternate Side Parking on Blandford Street,

Ward 28, York-Eglinton.

The York Community Council reports having approved the following report:

(June 5, 1998) from the York Commissioner of Operations Services, advising that a survey revealed a total of sixteen (16) and six (6) curbside parking spaces available on the east and west sides of Blandford Street between Rogers Road and Hanson Road, respectively; that alternate side parking is not practical due to the disproportionate number of legal curbside parking spaces on the east versus the west side; that at the present time the total complement of parking permits have been issued; and recommending that alternate side parking not be implemented.

(May 26, 1998) from the OMB regarding the issuance of Decision/Order No. 1271, and allowing appeals to York By-law No. 2366-91, and to Toronto Zoning By-law No. 438-86, to rezone lands municipally known as 1467 Bathurst Street, 1515 Bathurst Street and 480St.Clair Avenue West, to permit a residential-commercial project known as Heath Park; forwarding copy of by-law to be amended in manner set out; and authorizing the City Clerk to assign a number to the zoning by-law for record keeping purposes.

(May 20, 1998) from the Chairman, GO Transit, advising that the proposed station at Black Creek Drive/Eglinton Avenue West, will be reviewed in conjunction with GO Transit's future capital projects, which must be approved by the Board.

The York Community Council reports having approved the following request to recess for lunch at 11:30 a.m.:

(June 12, 1998) from Councillor Nunziata requesting that the Community Council meeting recess at 11:30 a.m. rather than the scheduled 12:30 p.m., to officiate the George Syme Seniors Centre fourth bi-annual Duck Race at Scarlett Mills Park, which starts at 11:30 a.m.

(p)Preliminary Report on Rezoning Application for

3 Strathearn Road - Ward 28, York-Eglinton.

The York Community Council reports having approved the following report:

(June 15, 1998) from the York Commissioner of Development Services, advising that the applicant is proposing to sever the lot into two parcels, both with frontage on StrathearnRoad; that this proposal has generated concerns within the surrounding community; that the proposed preservation area study affects more than the subject property; and recommending that staff be directed to hold a community information meeting and prepare a final report with recommendations.

(q)Special Evening Meeting of the York Community Council

regarding Toronto's Bid to Host the 2008 Olympics.

The York Community Council reports having approved a Special Meeting of the Community Council to be held on Tuesday, September 15, 1997 at 7:30 p.m. in the Council Chamber, for a presentation by Mr. David Crombie and to hear comments or concerns from the public regarding the City of Toronto's bid to host the 2008 Olympics.

(r)All-Way Stop Control at Glenholme Avenue and Earlsdale Avenue,

Ward 28, York-Eglinton.

The York Community Council reports having received the following report:

(May 8, 1998) from the York Commissioner of Operations Services, advising that a study revealed that the above intersection did not meet the warrants for an all-way stop control, and recommending that it not be implemented.

Reference Clause No. 8(k) in Report No. 6 which was approved by the York Community Council on May 27, 1998, and referred back by Council on June 3, 4 and 5, 1998.

(s)Request for All-Way Stop Control at Glenholme Avenue

and Earnscliffe Avenue - Ward 28, York-Eglinton.

The York Community Council reports having requested the Commissioner of Works and Emergency Services, to direct the York Commissioner of Operations Services, to report next day on the installation of an all-way stop control at Glenholme Avenue and Earnscliffe Avenue.

(t)Poll Results - Lambton Avenue between Cliff Street and Arnold Avenue;

(1)To Reverse On-Street Permit Parking from the North to the South Side; and

(2)To Implement Alternate Side Parking

The York Community Council reports having deferred consideration of the following report to its July 22, 1998 meeting:

(June 23, 1998) from the City Clerk, providing the results of polls conducted on LambtonAvenue between Cliff Street and Arnold Avenue, regarding proposals to reverse the on-street permit parking from the north to the south side, and to implement alternate side parking.

(u)Zoning By-law Amendment for Temporary Use at 180 Church Street,

Ward 27, York-Humber.

The York Community Council reports having approved the following report:

(June 24, 1998) from the York Commissioner of Development Services advising of an application by Humber River Regional Hospital for a temporary use zoning by-law to allow a daycare at 180 Church Street for a maximum of three years; and recommending that:

(1)the City Clerk arrange for a Public Meeting under the Planning Act to be held on July22,1998; and

(2)staff prepare a final report with recommendations and a draft By-law for consideration at the above meeting.

(v)Poll Results - Proposal for On-Street Permit Parking on

Winona Drive between Vaughan Road and Eglinton Avenue West

The York Community Council reports having deferred consideration of the following report to its July 22, 1998 meeting, when both Councillors can be present:

The York Community Council reports having authorized the amount of $1,500.00 to be charged to the corporate account to cover the cost of refreshments for an event to be held on Friday,June 26, 1998, in appreciation of the City's employees.
