Committee Decision

Scarborough Community Council enacted the draft by-law from the City Solicitor, as follows:

 

1.         The private lane at 3771 St. Clair Avenue East and shown on Attachment No. 1 to this By-law dated April 27, 2009 is named “Pherrill Mews”.

 

2.         The Rose and Thistle Group Limited, its agent or successor, shall enter into an agreement with the City to pay the City for the costs of fabrication and installation of the appropriate signage, estimated to be $300.00.

 

3.         The owners or their successors of the subject lands shall maintain at their own risk, the signage installed under section 2 of this By-law.

While reviewing the area signage, as a result of future road construction in the Brycemoor Road area, Transportation Services staff identified seventeen uncontrolled three-way intersections in the immediate area of Brycemoor Road at Brownfield Gardens.

 

It is recommended that minor street stop signs be installed at the subject seventeen uncontrolled three-way intersections to clearly define the right-of-way and to regulate traffic flow.

Request for an Encroachment Agreement - 52 Fallingbrook Road
Committee Decision

Scarborough Community Council:

 

1.         Directed the owner(s) to enter into an encroachment agreement with the City to the satisfaction of the City Solicitor and the General Manager of Transportation Services.

 

2.         Directed the owner to relocate the drain pipes that are located behind the decorative boulder retaining wall at the northerly limit of the driveway and to ensure that they do not drain water onto the municipal boulevard, sidewalk or roadway.

 

3.         Directed that the retaining wall that has already been constructed out of block that is 0.61 of a metre away from the utility pole and at a height of 0.37 of a metre must be relocated to a point of no less than 1.0 metre behind the utility pole.

 

4.          Authorized the City Solicitor to prepare and execute the encroachment agreement.

 

5.         Directed that the life of the Agreement be limited to 10 years from the date of registration on title or to the date of removal of the encroachment at which time, the City may consider the Agreement for further extension, if requested by the applicant.

 

6.         Directed the indemnification to the City by the owner(s) of the encroachment for all liability relating in any way to the encroachment and providing of an insurance policy for such liability for the lifetime of the Agreement in a form as approved by the City Solicitor, in an amount no less than $2,000,000.00 or such greater amount as the City Solicitor may require.

 

7.         Directed that in the event of sale or transfer of the property abutting the encroachment, Legal Services be authorized to extend the Encroachment Agreement to the new owner, subject to the approval of the General Manager of Transportation Services.

 

8.         Directed that the owner(s) pay the following fees:

 

a.         Application Fee of $463.31.

 

b.         Legal Administration Cost and Registration on Title, plus disbursements, including G.S.T.

 

c.         One-time rental fee of $480.46.

The purpose of this report is to obtain approval to convert the existing pedestrian crossover to traffic control signals at Pharmacy Avenue and Kellyvale Road.

 

Traffic studies reveal that traffic control signals are not warranted; however, a safety review indicates that this intersection is no longer a suitable location for a pedestrian crossover.  As a result, traffic control signals should be installed.

This report responds to a concern about a lack of parking regulations on the both sides of Wexford Boulevard between Lawrence Avenue East and Laxford Avenue. Staff has confirmed the need for parking regulations in order to maintain safe and efficient two-way traffic on Wexford Boulevard. In addition the area residents have expressed their support for the parking regulations in the form of a petition.

 

It is recommended that Transportation Services install "No Parking, 8:00 a.m. to 6:00 p.m., Monday to Friday "on both sides of Wexford Boulevard between Lawrence Avenue East and Laxford Avenue directly adjacent the extended corner restrictions of "No Parking Anytime" south of Lawrence Avenue East. The "No Parking Anytime" corner restrictions need to be accompanied by appropriated by-law housekeeping, so these signs become enforceable.

 

These new regulations would be directly adjacent to the current "No Parking Anytime" extended corner restrictions near Lawrence Avenue East.

The owners of Nadi's Family Restaurant Bar and Pool Lounge (the "Licensees") have made an application to the Alcohol and Gaming Commission of Ontario (the "AGCO") for additional licensed facilities of the indoor area of their establishment, expanding the capacity from 28 to 88 persons.

 

AGCO has received a formal objection from the Councillor's office, as well as a resident living in the vicinity of Nadi's Family Restaurant Bar and Pool Lounge.  This establishment has prompted a number of complaints to the local Councillor from neighbouring residents and from the local community association.  The issues include, but are not limited to, excessive noise, loitering, rowdiness and allegations of criminal activity.  The Municipal Licensing and Standards division received a complaint relating to loud music and noise at the establishment in September 2008.

 

There is a great deal of concern amongst the residents that an expansion to the existing license would accentuate these existing problems and add significantly to noise disturbances caused by the establishment.  There is also concern that the Licensee does not have effective control of the premises, but still wishes to increase the capacity of its liquor licence where potential impacts on the residents will be magnified.

 

There is urgency to this matter, because the advertising for the liquor licence application was completed on July 12, 2009.
