A second suite is a self-contained apartment (dwelling unit) located within a dwelling and designed for occupancy by a separate household which results in the creation of not more than 2 total suites. There is no quick way to tell if your home meets all of the bylaw requirements for a second suite. Part of the requirements include standards in the Fire Code, Property Standards, Electrical Code and Zoning Bylaw.

Even if the second suite is legal, ML&S will still make referrals to Fire Services to ensure that the second suite meets the requirements of the Fire Code. If required, a referral will be made to Toronto Building even when the second suite is permitted and meets the zoning/property standards requirements.

Parking and second suites

  • In the Etobicoke York, North York and Scarborough Districts: homes with a second suite must have at least 2 parking spaces. The location of those spaces may need zoning approval.
  • In the Toronto & East York District: depending on the residential zoning district, the parking requirements may be different.
