Tree Planting Process for Property Owners who want to Plant a Tree on the Street Allowance. (New tree or replacement tree)
The planting of a private tree in municipal road allowance is considered a delegated encroachment under Toronto Municipal Code Chapter 743, Article IV, and requires the preparation of an encroachment agreement with the City. If a contractor is planting the tree an Agreement for Contractors to Perform Arboricultural Services on City Owned Street Trees should be submitted.

Private trees must be of a species approved by Parks, Forestry and Recreation. The property owner is required to maintain the tree in a healthy state of growth for a period of two years following planting, at which time the City will assume ownership of the trees.
A street work permit is also required before planting the tree.
