City Council has established a Compliance Audit Committee to consider applications for compliance audits of candidates' campaign finances, pursuant to the Municipal Elections Act, 1996, (the MEA).
Application for a Compliance Audit
An application for a compliance audit of a candidate's election campaign finances may be made by an elector who is entitled to vote in a City of Toronto election and who believes on reasonable grounds that a candidate has contravened a provision of the MEA relating to election campaign finances.
An application for a compliance audit must be made in writing to the City Clerk and must set out the reasons for the elector's belief in a contravention of the MEA.
The application (PDF), must be made within 90 days after the latest of,
- the filing date under section 78 of the MEA;
- the candidate's supplementary filing date, if any, under section 78 of the MEA;
- the filing date for the final financial statement under section 79.1of the MEA; or
- the date on which the candidate's extension, if any, under subsection 80 (4) of the MEA expires.
Recovery of costs
If an audit is granted by the Compliance Audit Committee and if the audit report indicates that there was no apparent contravention and the committee finds that there were no reasonable grounds for the application, the council is entitled to recover the auditor's costs from the applicant.
Compliance Audit for School Boards
Requests for compliance audits of school board candidates must be made to the Director of the appropriate school board. Please contact the appropriate school board website for more information.
