The Scarborough Community Council referred the report (March 25, 2009) back to the Director, Urban Forestry, Parks, Forestry and Recreation, with a request that he, in consultation with Technical Services staff, and the applicant's arborist and engineer, formalize a plan to preserve the trees outlined in the application and report back to the Scarborough Community Council for its meeting on May 14, 2009.

Summary

This report recommends that Council approve the request for removal of five (5) privately-owned trees. The grade around the trees is to be raised by approximately one metre to address grading and drainage issues on the development site.
 
Inspection of the trees by staff revealed that they are in fair condition. The grading change proposed for the site will have an impact on the health of the five (5) trees. The additional soil will reduce the amount of oxygen and water that the root systems of the trees receive, resulting in a decline in their health. Urban Forestry supports the request for tree removal so that the owners of the new homes are not left with the burden of removing dead trees in the future.

Conveyance of Rear Portion of 1251 Tapscott Road to Canadian Pacific Railway

Committee Recommendations

Scarborough Community Council recommends that:

 

1.         City Council convey for nominal consideration Part 2 on Expropriation Plan AT1551966 to CP Rail and that each of the Chief Corporate Officer and the Director of Real Estate Services be authorized severally to sign any documents on behalf of the City to give effect thereto.

 

2.         City Council authorize the Director of Real Estate Services to sign the letter of understanding between the City and CP Rail listing the terms upon which this Property is being transferred by the City to CP Rail.  The terms are listed in Appendix “A’ attached to the report (March 11, 2009) from Chief Corporate Officer.

 

3.         City Council, as approving authority under the Expropriations Act,  authorize the transfer of the Property to CP Rail without giving the owner from whom the land was taken the first chance to repurchase the Property on the terms of the best offer received by the City.

 

4.         City Council authorize the City Solicitor to complete this transaction on behalf of the City including making payment of any necessary expenses, and amending the closing date and other dates to such earlier or later date(s) and on such terms and conditions as she may from time to time consider reasonable.

 

5.         City Council authorize and direct the appropriate City officials to take the necessary action to give effect thereto.

Summary

To replace Canadian Pacific Rail Company’s (“CP Rail”) spur line rail servicing 1051 Tapscott Road that was lost when a portion of 1051 Tapscott Road was expropriated by the City to extend McNicoll Avenue.  The City also expropriated a portion of the rear of 1251 Tapscott Road (PART 2, Expropriation Plan AT1551966, “the Property”) and it is now recommended that the transfer of this Property to CP Rail be authorized for the substitute site of the said spur line track.

 

The expropriated Property was acquired and is being transferred to CP Rail at nominal consideration to minimize damages which may be claimed against the City by the owner and/or tenant of 1051 Tapscott Road arising out of the City’s expropriation of a portion of their land to extend McNicoll Avenue and the resultant loss of the original rail spur line.

Summary

This report responds to a concern about lack of permissive parking on the west side of Bamburgh Circle (west leg) in the vicinity of 100 Bamburgh Circle. Transportation staff has confirmed the need for permissive parking regulations in order to facilitate safe and efficient drop-off and pick-up of young students at 100 Bamburgh Circle.

 

It is recommended that Transportation Services install Permissive Parking regulation on the west side of Bamburgh Circle and the south side of Huntsmill Boulevard directly adjacent 100 Bamburgh Circle.

This staff report is about a matter for which the Community Council does not have delegated authority from City Council to make a final decision.

 

This report responds to a request to replace the existing Pedestrian Crossover with an All-Way Stop Control at the intersection of Brenyon Way and Wickson Trail/John Tabor Trail.  The report shows that an All-Way Stop Control is warranted at this intersection that is located in the Malvern Neighbourhood. 

 

However, the intersection design along with the existence of a school crossing with an Adult Crossing Guard precludes the use of All-Way Stop Control; the installation of Traffic Control Signals is the only available option.

1.         City Council amend the Employment Districts Zoning By-law No. 24982 (Dorset Park) substantially in accordance with the draft zoning by-law amendment attached as Attachment 4 to the report (March 26, 2009) from the Director, Community Planning, Scarborough District.

 

2.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft zoning by-law amendment as may be required.

This application proposes to amend the zoning by-law to permit ancillary retail in conjunction with a household appliance repair, refurbishing and warehousing operation.  A-One Appliances Inc. operates from the two industrial buildings located on the subject lands, with the retail, repair, refurbishing and storage of appliances occurring in the building facing Lawrence Avenue East (2410 Lawrence Avenue East) and the warehousing occurring in the rear building (6 Nantucket Boulevard).

 

The proposed increase in the ancillary retail use permission associated with a household appliance repair, refurbishing and storage/ warehousing business, is consistent with the Employment Areas designation of the Official Plan, the Provincial Policy Statement and conforms to the Growth Plan for the Greater Golden Horseshoe.  The proposed use is appropriate at this location.

 

This report reviews and recommends approval of the application to amend the Employment Districts Zoning By-law No. 24982 (Dorset Park Employment District).
