Summary

This Staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

The purpose of this report is to consider a request by the owner(s) of 60 Castlemere Cres. to be exempted from Chapter 447-Fences section (3) of the Toronto Municipal Code.  This section states that:

 

The minimum height of a swimming pool enclosure above the highest outside grade within one metre of the enclosure shall be 1.2 metres on Single Residential Property when measured at any point along the enclosure.

 

A chain-link fence when used as a swimming pool enclosure shall be constructed in a good, workmanlike manner and for a pool on Single Residential Property shall have a mesh size of 38 millimetres maximum.

 

That every gate in a swimming pool enclosure shall be self-closing and equipped with a lockable, self-latching device located on the inside near the top of the gate or on the outside at least 1.5 metres above grade.

Recommendations

The City Solicitor recommends that:

 

1.         City Council assume the services installed for Registered Plan 66M-2371 and that the City formally assume the road and road widenings within the Plan of Subdivision.

 

2.         City Council authorize Legal Services Division to release the performance guarantee with the exception of a cash settlement in the amount of $10,000.00 as set out in the report.

 

3.         City Council direct that an assumption By-law be prepared to assume the public highways and municipal services in Subdivision Plan 66M-2371.

 

4.         City Council authorize and direct the City Solicitor to register the assumption By‑law in the Land Registry Office, at the expense of the Owner.

 

5.         City Council authorize the City Clerk and Treasurer to sign any release or other documentation necessary to give effect thereto.

 

6.         City Council authorize the appropriate City officials to transfer ownership of the street lighting system constructed with Plan of Subdivision No. 66M-2371 to Toronto Hydro.

Summary

This report requests Council’s authority for the City to assume the services with respect to the above development.

Summary

This staff report is about a matter for which the Community Council does not have delegated authority from City Council to make a final decision.

 

The purpose of this report is to obtain approval for the installation of traffic control signals at Lawrence Avenue East and Susan Street.

 

Traffic studies reveal that the existing pedestrian refuge island should be upgraded to a traffic signal to improve safety.  As a result, traffic control signals should be installed.

Financial Impact

The financial cost of installing these new traffic control signals is approximately $150,000.00.  The funding for these signals is available in Transportation Services Division’s Capital Works Budget under Project No. CTP706-01.

Request for an Encroachment Agreement - 147 Courcelette Road

Recommendations

Transportation Services, Scarborough District, recommends that Scarborough Community Council:

 

1.         Approve the application for an encroachment agreement for 147 Courcelette Road, subject to the following conditions:

 

a.         That the owner(s) enter into an encroachment agreement with the City to the satisfaction of the City Solicitor and the General Manager of Transportation Services;

 

b.         That the life of the Agreement be limited to 10 years from the date of registration on title or to the date of removal of the encroachment at which time, the City may consider the Agreement for further extension, if requested by the applicant;

 

c.         That indemnification be provided to the City for all liability relating in any way to the encroachment with the City of Toronto added as additional insured for such liability for the lifetime of the Agreement in a form as approved by the City Solicitor, in an amount no less than $2,000,000.00 or such greater amount as the City Solicitor may require;

 

d.         That in the event of sale or transfer of the property abutting the encroachment, Legal Services be authorized to extend the Encroachment Agreement to the new owner, subject to the approval of the General Manager of Transportation Services; and

 

e.         The owner(s) pay the following fees:

 

i.          Application Fee of $480.46.

 

ii.         Legal Administration Cost and Registration on Title, plus disbursements including G.S.T.

 

iii.        Encroachment rental fee of $480.46.

 

2.  Authorize the City Solicitor to prepare and execute the encroachment agreement.

This report responds a need to clarify the parking regulations by-laws on Victoria Park Avenue between Bracken Avenue and Queen Street East. Transportation staff has confirmed the need to housekeep the parking regulations by-laws in order to enable proper enforcement of the posted parking regulations and maintain safe and efficient two-way traffic.

 

It is recommended that Transportation Services amend the parking regulation by-laws on the both sides of Victoria Park Avenue between Bracken Avenue and Queen Street East.

Summary

This staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

This report responds to a concern about lack of parking regulations on the west side of Townley Avenue north of Belmore Avenue. Staff has confirmed the need for parking regulations in order to maintain safe and efficient two-way traffic, adequate sight lines while enabling roadway maintenance.  In addition the area residents have expressed their support for the parking regulations in the form of a petition.

 

It is recommended that Transportation Services install “No Parking Anytime” on the west side of Townley Avenue from Belmore Avenue to 26 metres north of Belmore Avenue.

Financial Impact

 The financial cost of installing this parking prohibition sign is approximately $250.00.  Funding for this sign is available in the Transportation Services 2010 Operating Budget, within Cost Centre TP0397.

It is recommended that an All-Way Stop Control not be installed at Hiscock Boulevard and Scranton Road since the subject intersection failed to meet the required All-Way Stop Control warrants adopted by Council for use in the City of Toronto.

This report responds to a concern about lack of parking regulations on the north sides of Bonis Avenue west of Kennedy Road. Staff has confirmed the need for parking regulations in order to maintain safe and efficient two-way traffic, adequate sight lines while enabling roadway maintenance.

   

It is recommended that Transportation Services install “No Parking Anytime” on the north side of Bonis Avenue (in the vicinity of the townhouse complex driveways), from 140 metres west of Kennedy Road to 155 metres west of Kennedy Road and from 175 metres west of Kennedy Road to 190 metres west of Kennedy Road.

During an operational review on Silversted Drive, Transportation Services staff identified eight uncontrolled three-way intersections in the immediate area of Briarscross Boulevard and Pipers Green Avenue. 

 

It is recommended that minor street stop signs be installed at the subject eight uncontrolled three-way intersections to clearly define the right-of-way and to regulate traffic flow.

Financial Impact

 The financial cost of installing the subject recommended stop controls is approximately $2,250.00.  The funding for these stop controls is available in the Transportation Services 2010 Operating Budget, within Cost Centre TP0397.

Summary

This staff report is about two matters for which the Community Council does not have delegated authority from City Council to make a final decision.

 

The purpose of this report is to advise on the need to enact a southbound designated right-turn lane and prohibit “U” turns for northbound and southbound traffic at the intersection of Morningside Avenue at Tams Road.

 

Community Council’s recommendation and City Council’s approval of the lane designation amendment and prohibited “U” turns will improve traffic operations, provide a safer environment to motorists and allow enforcement by the Toronto Police Service at the intersection of Morningside Avenue at Tams Road.

Financial Impact

The financial cost of installing the compulsory right turn lane signage is approximately $500.00.  Funding for these compulsory signs is available in the Transportation Services 2010 Operating Budget, within Cost Centre TPO397.

On March 21, 2007 the Toronto Transit Commission (TTC) endorsed a light rail transit plan for the City of Toronto which included seven projects across the City, and subsequently initiated environmental assessment studies for those projects, as well as one for the Scarborough Rapid Transit (SRT) extension to Malvern.

On May 6, 2010 the Toronto Transit Commission is considering the outcome of the Transit Project Assessment Study and draft Environmental Project Report (EPR) for the Scarborough Rapid Transit Conversion and Extension, including Kennedy Station Improvements.

On May 19, 2010 Planning and Growth Management Committee is holding a Public Meeting on the Official Plan Amendment (no. 92) required to enable this project to go ahead.

On March 9, 2010, Scarborough Community Council adopted a resolution requesting the Manager of Transportation Planning, Scarborough Division, to provide a report to the May 25, 2010 meeting of Scarborough Community Council on the document by Councillor Thompson entitled “Scarborough LRT Redux”.

This report responds to that direction.

The City Planning Division recommends that:

 

1.         City Council direct the City Solicitor and appropriate staff to attend the Ontario Municipal Board hearing for the lands at 1221 Markham Road, in opposition to the applicant’s zoning amendment application.

 

2.         City Council authorize the City Solicitor, in consultation with the Director of Community Planning, Scarborough District, to continue discussions with the applicant in an effort to resolve the appeal at the upcoming OMB hearing, if a revised development proposal is put forward by the applicant which addresses the issues and incorporates the conditions detailed in this report, to the satisfaction of the City.

Summary

The applicant has appealed the zoning by-law amendment application for a mixed use development at 1221 Markham Road.  The applicant has also appealed Official Plan Amendment No. 71 (OPA 71 – Markham Ellesmere Revitalization Area), adopted by Toronto City Council on August 6, 2007, as it pertains to the subject site. 

 

In March, 2010 the applicant submitted revised plans to the City and Ontario Municipal Board (OMB) proposing the construction of 696 residential condominium (apartment) units in three buildings, 21 storeys in height, and 1,846m2 (19,870 sq.ft) of retail and restaurant uses. Planning staff do not support the applicant’s current proposal since it is not consistent with the Official Plan and Markham Ellesmere Revitalization Area objectives adopted by City Council to provide for vibrant mixed use development on a public road network, complete with community benefits in exchange for increased height and density.  The applicant’s proposal aims to benefit from the intensification potential presented by the Official Plan without meeting the overall design objectives of the Official Plan and without providing the necessary supporting public infrastructure and community benefits.

The purpose of this report is to seek Council’s direction with respect to the appeals.  The OMB has scheduled a Pre-Hearing on June 11, 2010.  To date, the full hearing has not been scheduled.

 

This report recommends that the applicant’s zoning amendment application in its current form, be opposed at the OMB for the reasons set out in this report.  This report also recommends that the City Solicitor, in consultation with the Director of Community Planning, Scarborough District, be authorized to continue discussions with the applicant to resolve the appeal if an alternative proposal is put forward by the applicant which would address the concerns and issues raised in this report, to the satisfaction of the City.

1.         City Council direct the City Solicitor and appropriate staff to attend the OMB hearing to ensure that the City’s 
interests are appropriately represented and to support the proposed rezoning on the terms outlined in Recommendation 2.

 

2.         That City staff be authorized to support amendments to the Employment District Zoning By-law #24982 (Milliken Employment District) for the lands at 3241-3261 Kennedy Road and 19-27 Passmore Avenue, subject to the following conditions:

 

a.         the additional small scale retail and service uses be restricted to those generally outlined in Attachment 5: Recommended List of Additional Uses;

 

b.         the size of any individual small scale retail and service uses be capped as generally shown in Attachment 5: Recommended List of Additional Uses;

 

c.         the small scale retail and service uses, including restaurants be restricted to a maximum of 30% of the gross floor area of all buildings or 5 240 square metres (56,405 square feet);

 

d.         maximum gross floor area of all restaurant uses be restricted to 1 466 square metres (15,780 square feet) or 8 percent of the gross floor area of all buildings; and,

 

e.         minimum of 366 parking spaces be provided.

 

3.         City Council authorize the City Solicitor to request the OMB to withhold its Order approving the zoning by-law amendment until a draft by-law is prepared to the satisfaction of the City Solicitor in consultation with the Chief Planner and Executive Director of the City Planning Division.

 

4.         City Council authorize the City Solicitor and City staff to take the necessary steps required to implement the foregoing.

Summary

The purpose of this report is to inform City Council of the status of the subject zoning by-law amendment application and to seek direction from Council for an upcoming Ontario Municipal Board (OMB) Hearing on appeal by the owner.  This report recommends that the City Solicitor and appropriate staff attend the OMB and bring forward the position outlined in this report to the Hearing scheduled for June 15, 2010.
