Effective November 3, 2025, development charges for non-rental residential developments (such as condominiums and freehold homes) must be paid in full prior to occupancy being granted.

As a result of Bill 17 changes to the DC Act, effective November 3, 2025, the timing for payment of DCs for non-rental residential developments has changed.

Effective November 3, 2025:

  • DCs for non-rental residential developments (such as condominiums and freehold homes) must be paid in full prior to occupancy being granted.
  • In accordance with recent amendments to the Ontario Building Code under O. Reg. 163/24,all non-rental residential developments—including condominiums and freehold homes—must obtain an occupancy permit before legal occupancy is permitted. Municipalities cannot issue occupancy permits until all applicable DCs payable upon occupancy have been paid in full.

Previously:

  • DCs for non-rental residential DCs  were due at the time of building permit issuance.
  • Not all projects were required to obtain an occupancy permit before granting first occupancy.

Section 27 Agreements:

If your project is governed by a Section 27 agreement, the DCs will continue to be paid according to the terms outlined in that agreement.

Payment Trigger: Full payment of non-rental residential DC is required when an occupancy permit is issued.

Applies To: All non-rental residential developments, including ownership housing.

Does Not Apply To: Rental housing and institutional developments, which continue to follow their existing instalment payment schedules, with first payment due upon occupancy.
