1. General

The City of Toronto (“City”) maintains the Online Vaccine Ordering form (“OVO”) for the City of Toronto Public Health Unit. OVO is a web-based service provided by the City to enable Toronto Physicians to electronically submit orders for a variety of publicaly funded vaccines.

When you click the “Agree” button when entering, and by using OVO, you are agreeing to comply with and be bound by the following terms of use. Please review the following terms carefully. If you do not agree with these terms you cannot use or gain access to the OVO form.

2. Limited Right to Use

Subject to the terms and conditions of this Agreement, you are granted the right to access, and use OVO for your professional use.

You may only access and use OVO to submit and/or retrieve vaccine requests you are lawfully permitted to access and use.

You may only place orders using OVO if: you are a Health Care Provider working in Toronto or working on behalf of one, you are registered with the Province to store and give vaccines, and have refrigeration facilities that meet the requirements of Ontario’s Vaccine Storage and Handling Guidelines, with the capacity to safely store the ordered vaccine(s).

You will only enter information to OVO that you know to be accurate. You will report any errors in or concerns about OVO to TPH’s Vaccine Preventable Disease Program by emailing vaccineorder@toronto.ca or if you do not use e-mail, calling 416-338-2030.

You are responsible for safeguarding your login credentials and personal or personal health information, including your Ontario Government Pharmaceutical and Medical Supply Service (OGPMSS) registration number and PIN, before, during, and after your use of OVO.

You are responsible for the security of the device, browser and network that you are using to access the OVO website and transmit information.

You will provide accurate OVO login credentials where required.

3. No Harmful Use

You warrant that the information or material that you provide to OVO through your access to or use of OVO does not infringe the rights of any person or entity.

Without limiting the generality of the foregoing you shall not:

  • Impersonate any other person or entity or make any misrepresentations
  • Unlawfully delete or revise any material posted by any other person or entity
  • Use OVO in such a manner as to gain unauthorized entry or access to information on OVO, to post unauthorized information on OVO or to  gain unauthorized entry or access to any password-protected or restricted area of the OVO or the City’s computer or network systems
  • Interfere with or disrupt OVO or computer networks connected thereto
  • Enter or store any Personal or Personal Health Information in OVO
  • Violate any law or regulation or any generally accepted Internet practice or interfere with any other legitimate OVO user’s ability to use OVO and any of the services or provided by OVO.

4. Non-Transferability and Passwords

Any password or right given to you to use OVO is not transferable.

5. No Liability

The City is not responsible, and will not be liable to you or anyone else, for any damages whatsoever, including any indirect, special incidental or consequential damages, arising out of or in connection with your use, or inability to use, OVO even if the City has been advised of the possibility of such damages.

6. Disclaimer

The City is providing OVO on an “as is”, “as available” basis. The City does not make any express or implied warranties, representations or endorsement with respect to OVO including, but not limited to warranties as to usefulness, completeness, accuracy and reliability. Further, the City does not represent and warrant that OVO will be available or meet your requirements, that access will be uninterrupted, that there will be no delays, failures or errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system.  You have sole responsibility for adequate protection and backup of your data, hardware and software and to take reasonable and appropriate precautions against viruses and other contaminating or destructive properties.

7. Collection, Use and Disclosure of Personal and Personal Health Information

The Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) and the Personal Health information Protection Act (PHIPA) apply to all information collected by the City, including Toronto Public Health. The information will only be collected, used and disclosed in accordance with MFIPPA and PHIPA. Please refer to the Toronto Public Health Information Practice Statement for more information.

8. Copyright

The text, images and data on OVO are protected by the Canadian Copyright Act. The City grants you a personal non-exclusive license to read and print copies of your vaccine orders and those of others you are, in law, permitted to access.

You do not gain any ownership rights to any of the copyrighted information you gain access to through OVO.

9. Termination of OVO Use

The City may, at its sole discretion, terminate or refuse to permit the use of any services on OVO by any person, for any reason and without notice.

You agree that even if the City does not insist on or enforce an item in this agreement, the City still has the right to insist on and enforce that item.
