Summary of Park Fees Relating to the Development Process
Parkland Levies
In new developments or redevelopments, developers and builders will be required to either set aside a certain amount of land for parkland (parkland dedication) or alternatively they pay cash-in-lieu of parkland dedication. When they pay the fee in lieu of parkland dedication, the fee is called a Parks Levy Fee. These fees are paid prior to the issuance of the first building permit. Parks Levy Fees as set out below are a percentage of the market value of the development lands. (The Real Estate Unit of Facilities & Real Estate does the appraisal to determine the market value and the fee payable. There is also a fee for the appraisal.)

Parkland Occupation Permit
If the developers and builders require occupation of proposed or existing Park for construction staging, they would be required to enter into a Park Occupation Permit with the Planning, Design and Development Unit of Parks, Forestry and Recreation. The permit will outline the details of the park occupancy, restoration and associated fees. The terms of the permit shall be to the satisfaction of the General Manager of Parks, Forestry and Recreation. The rate is negotiated sometimes through the assistance of Facilities and Real Estate.

Limiting Distance Agreement
If the development is adjacent to an existing park or new proposed park the developer or builder should be aware that prior to the issuance of any building permits, if required, they may need to enter into a Limiting Distance Agreement with the City to achieve the required building setback with respect to the Ontario Building Code. This relates to provisions in the Ontario Building Code regarding percentage of window openings and minimum distances between buildings to prevent fire spread. Compensation to the City for the use of a portion of the City parkland to satisfy the Ontario Building Code requirement will be required under the Limiting Distance agreement.
