Recommendations

The City Planning Division recommends that:

 

1.            City Council amend the Zoning By-law for the lands at 50 Resources Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 8.

 

2.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment and Draft Plan of Subdivision as may be required.

 

3.            In accordance with the delegated approval under By-law 229-2000, City Council be advised that the Chief Planner may approve the Draft Plan of Subdivision as generally illustrated on Attachment 2, subject to:

 

a.         the conditions of Draft Plan of Subdivision as set out in Attachment 9 must be fulfilled prior to the release of the plan of subdivision for registration;

b.         any such revisions to the proposed subdivision plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development; and

c.         the approval of the Draft Plan of Subdivision not be issued until the Zoning By-law is in full force and effect.

 

4.            Prior to introducing the necessary Bills to City Council for enactment:

 

a.            the owner enter into a legal agreement under Section 37 of the Planning Act to secure the community benefits outlined in this report;

b.            the owner enter into a Subdivision Agreement as set out in the conditions of Draft Plan of Subdivision; and

c.            the Notice of Approval Conditions for Site Plan Approval be issued.

Summary

This application is to amend the Class One Industrial (I.C1) zoning of the property to permit the development of a 16,230.5 square metre large-format home improvement retail store (including an attached accessory garden centre of 3,060.1 square metres).  The applicant has included on the plans, for illustration purposes only, additional uses currently permitted on the lands.  The application proposes to delete certain incompatible uses from the IC.1 zoning that applies on the lands not occupied by the large-format retail store.

Recommendations

The City Planning Division recommends that:

 

1.            City Council amend the Official Plan for the lands at 2256-2270 Lawrence Avenue West substantially in accordance with the draft Official Plan Amendment attached as Attachment 6.

 

2.            City Council amend the Zoning By-law for the proposed semi-detached dwellings substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 7.

 

3.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and/or draft Zoning By-law Amendment as may be required.

 

4.            Before introducing the necessary Bills to City Council for enactment, require issuance of the Notice of Approval Conditions for the Site Plan Application.

 

5.            City Council approve Application 09 111812 WET 02 RH to demolish the 7 existing residential dwelling units, which contain 5 residential rental housing units, located at 2256-2270 Lawrence Avenue West pursuant to Municipal Code Chapters 667 and 363 subject to the following conditions under Chapter 667:

 

a.         The owner meet the requirements of the Tenant Assistance Plan at the owner’s expense, to the satisfaction of the Chief Planner and Executive Director, and which will include provisions that exceed the requirements under the provincial Residential Tenancies Act by providing, on a sliding scale geared to the length of occupancy each tenant has resided in their unit, additional compensation of extra month’s rent and a moving allowance.

 

b.         The owner provide an undertaking to the satisfaction of the City Solicitor in consultation with the Chief Planner and Executive Director, City Planning Division which secures the condition outlined in Recommendation 5(a).

 

6.            City Council authorizes the Chief Planner and Executive Director, City Planning Division to issue a preliminary approval of the application under Municipal Code Chapter 667 after the satisfaction of the condition in Recommendation 5(b), above, and after the Zoning By-law amendments in Recommendation 2 have come into full force and effect.

 

7.            City Council authorize the Chief Building Official to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning Division has given the preliminary approval as authorized in Recommendation 6.

 

8.            City Council authorize the Chief Building Official to issue a permit under Section 33 of the Planning Act no earlier than issuance of the first building permit for the foundation of the development, and after the Chief Planner and Executive Director, City Planning Division has given the preliminary approval as authorized in Recommendation 6.  The Section 111 permit may be included in the demolition permit under Municipal Code Chapter 363-11.1E, on condition that:

 

a.         The Owner erect a residential building on site no later than three (3) years from the day demolition of the buildings is commenced.

 

b.         Should the Owner fail to complete the new building within the time specified in condition (a), the City Clerk shall be entitled to enter on the collector’s roll, to be collected in a like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit for which a demolition permit is issued, and that each sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued.

Summary

This application proposes to demolish the existing seven detached dwellings at 2256-2270 Lawrence Avenue West, and construct 3 pairs of semi-detached dwellings fronting onto Westona Street and 3 pairs of semi-detached dwellings fronting onto Bowsprit Avenue.  A Rental Housing Demolition and Conversion application has also been submitted to demolish the existing seven dwellings which contain 5 residential rental housing units.

Summary

The City Planning Division recommends that:

 

1.            Staff be directed to schedule a community consultation meeting for the lands at 36 Park Lawn Road together with the Ward Councillor.

 

2.            Notice for the community consultation meeting be given to landowners and residents within 120 metres of the site.

 

3.            Notice for the public meeting under the Planning Act be given according to the regulations under the Planning Act.

Summary

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes a 36-storey residential tower, with an approximate height of 113 metres, plus mechanical penthouse, containing 308 dwelling units.  The development proposes three levels of underground parking, and 20-visitor parking spaces located at-grade within the podium.

1.            Installing traffic control signals at the intersection of Oakdale Road at the driveways to Humber River Regional Hospital/Westview Centennial Secondary School.

 

2.            Installing traffic control signals conditional on the Toronto District School Board, at their expense, aligning the existing driveway to Westview Centennial Secondary School with the existing driveway to Humber River Regional Hospital, to the satisfaction of the Director, Transportation Services, Etobicoke York District.

Summary

The purpose of this report is to obtain approval to install traffic control signals on Oakdale Road, at the driveways to Humber River Regional Hospital/Westview Centennial Secondary School.

 

Installing of traffic control signals is justified as the Pedestrian Crossover Warrant requirements are achieved; however, this form of crossing protection fails to meet several key environmental standards at this location. Installing traffic control signals at this intersection provides safe and convenient access for pedestrians and vehicles crossing Oakdale Road accessing Humber River Regional Hospital/Westview Centennial Secondary School, but results in increased delay to through vehicles on Oakdale Road.

The purpose of this request is to prevent vehicle traffic generated by the George S. Bell Arena and the industrial/commercial properties east of Cobalt Avenue from using Cobalt Avenue and the residential section of Ryding Avenue, west of Gourlay Crescent, to access Runnymede Road and St. Clair Avenue West at Cobalt Avenue.

This report summarizes the results of the traffic calming survey undertaken between August 31 and September 29, 2009, for owners and occupants on Falstaff Avenue, between Culford Road and Keele Street.  The survey exhibits a response rate of just 48 percent.  As a result, installing speed humps is not recommended since the minimum survey response rate of greater than 50 per cent is not achieved.

Financial Impact

Adopting this report has no financial impact; however, if Community Council decides to approve installing speed humps on Falstaff Avenue, between Culford Road and Keele Street, the following financial impact results:

 

1.            The estimated cost for installing approximately eight (8) speed humps will be $24,000.00.  This will be accommodated within funds allocated by City Council as part of the Transportation Capital Budget, subject to competing priorities and funding availability.

Recommendations

Toronto Fire Services recommends that:

 

1.            Part or those parts of the private road or roads shown on the site plan filed with the Fire Chief in respect of the municipal addresses set out below be designated as a fire route pursuant to Municipal Code Chapter 880 – Fire Routes - 130 Tenth Street.

 

2.            City Council authorise the Fire Chief and City Solicitor to take the appropriate action to make a designated Fire Route.  

Summary

To obtain Council approval for the amendment of the Fire Route By-law to designate certain locations as fire routes within the meaning of City of Toronto Municipal Code Chapter 880, as amended.

Recommendations

The Director of Business Services recommends that:

 

1.            Etobicoke York Community Council approve the addition of one director to the Eglinton Hill BIA Board of Management as set out in Attachment No. 1.

 

2.            Schedule A of the Municipal Code Chapter 19, Business Improvement Areas, be amended to reflect the changes to the BIA Board of Management.

Summary

The purpose of this report is to recommend Etobicoke York Community Council approve the addition of one member to the Eglinton Hill BIA Board of Management.  The Etobicoke York Community Council has delegated authority to make final decisions regarding BIA appointments.
