The Etobicoke York Community Council:

 

1.         Deferred its decision on the Zoning Amendment and Subdivision Applications for 50 Resources Road until its meeting to be held on June 22, 2010.

 

2.         Directed that a third party review be prepared by a market consultant satisfactory to staff, in consultation with the applicant and Woodbine Live!, the cost of which shall be shared between both the applicant and Woodbine Live!

 

3.         Requested the Director, Community Planning, Etobicoke York District, to report on the results of the peer review analysis at the continuation of the public meeting before the Etobicoke York Community Council.

 

4.         Directed that no further Public Notice is required under the Planning Act in this regard.

Summary

2256-2270 Lawrence Avenue West – Official Plan and Zoning By-law Amendments and Rental Demolition Application – Final Report

Committee Recommendations

Etobicoke York Community Council recommends that:

 

1.            City Council amend the Official Plan for the lands at 2256-2270 Lawrence Avenue West substantially in accordance with the draft Official Plan Amendment, attached as Attachment 6 to the report (April 8, 2010) from the Director, Community Planning, Etobicoke York District.

 

2.            City Council amend the Zoning By-law for the proposed semi-detached dwellings substantially in accordance with the draft Zoning By-law Amendment, attached as Attachment 7 to the report (April 8, 2010) from the Director, Community Planning, Etobicoke York District.

 

3.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and/or draft Zoning By-law Amendment as may be required.

 

4.            City Council require that, before introducing the necessary Bills to City Council for enactment, issuance of the Notice of Approval Conditions for the Site Plan Application.

 

5.            City Council approve Application 09 111812 WET 02 RH to demolish the 7 existing residential dwelling units, which contain 5 residential rental housing units, located at 2256-2270 Lawrence Avenue West pursuant to Municipal Code Chapters 667 and 363 subject to the following conditions under Chapter 667:

 

a.         The owner meet the requirements of the Tenant Assistance Plan at the owner’s expense, to the satisfaction of the Chief Planner and Executive Director, and which will include provisions that exceed the requirements under the provincial Residential Tenancies Act by providing, on a sliding scale geared to the length of occupancy each tenant has resided in their unit, additional compensation of extra month’s rent and a moving allowance.

 

b.         The owner provide an undertaking to the satisfaction of the City Solicitor in consultation with the Chief Planner and Executive Director, City Planning Division which secures the condition outlined in Recommendation 5(a).

 

6.            City Council authorizes the Chief Planner and Executive Director, City Planning Division to issue a preliminary approval of the application under Municipal Code Chapter 667 after the satisfaction of the condition in Recommendation 5(b), above, and after the Zoning By-law amendments in Recommendation 2 have come into full force and effect.

 

7.            City Council authorize the Chief Building Official to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning Division has given the preliminary approval as authorized in Recommendation 6.

 

8.            City Council authorize the Chief Building Official to issue a permit under Section 33 of the Planning Act no earlier than issuance of the first building permit for the foundation of the development, and after the Chief Planner and Executive Director, City Planning Division has given the preliminary approval as authorized in Recommendation 6.  The Section 111 permit may be included in the demolition permit under Municipal Code Chapter 363-11.1E, on condition that:

 

a.         The Owner erect a residential building on site no later than three (3) years from the day demolition of the buildings is commenced.

 

b.         Should the Owner fail to complete the new building within the time specified in condition (a), the City Clerk shall be entitled to enter on the collector’s roll, to be collected in a like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit for which a demolition permit is issued, and that each sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued.

Installing of traffic control signals is justified as the Pedestrian Crossover Warrant requirements are achieved; however, this form of crossing protection fails to meet several key environmental standards at this location. 4.         The signed Agreement to be returned to the City along with the required Certificate of Insurance, evidencing a third party bodily injury  and property damage insurance in the amount of $2,000,000.00 or such other coverage and greater amount  as the City may require, and naming the City of Toronto as an additional  insured party under the policy.

 

5.         The Certificate of Insurance shall be renewed and a copy thereof submitted to Municipal Licensing and Standards on an annual basis for the life of the encroachment.

 

6.         The Outdoor Boulevard Café only be licensed for seasonal use, between the period of May 1st to October 31st and the patio furniture and fencing shall be removed from the municipal boulevard at the end of the season.

 

7.         The owner is required to obtain a construction/streets permit and contact Bell Canada prior to the commencement of any construction because of close proximity of the proposed patio to their respective service underground.

 

8.         Prior to the installation of any canopy structures, the applicant shall modify this Encroachment Agreement and obtain all necessary permits.

 

9.         The owner shall operate the boulevard café in strict compliance with the requirements as stipulated under Toronto Municipal Code, Chapter 591, Noise.

 

10.       The owner shall maintain the Boulevard Café in good repair and comply at all times with the regulations set out in the former Municipality of Metropolitan Toronto By-law 41-93, as amended.

115 Torbarrie Road – Development Charge Credit for Above Base Park Improvements
Committee Recommendations

The Etobicoke York Community Council recommends that:

 

1.         City Council authorize the Deputy City Manager and Chief Financial Officer to enter into a Development Charge Credit Agreement with Ringley Corporation Ltd. (66M-2436) to provide for the following:

 

             a.        with respect to the development of the subdivision of 115 Torbarrie Road, (66M-2346), the Owner agrees to provide Above Base Park Improvements in an amount and manner satisfactory to the General Manager, Parks, Forestry and Recreation;

 

b.         in return for such work, the City will give the Owner a credit against the Parks and Recreation component of the development charges payable for the development, such credit not to exceed the lesser of:

 

i.          $331,220.00, which includes the credit of $161,00.00 already provided for in the applicable subdivision agreement;

 

ii.         the actual cost of the Above Base Park Improvements, as certified by the Manager of Parks and Recreation; or

 

iii.        the Parks and Recreation component of the development charges paid for the development, using the percentage of the Parks and Recreation component in effect as of the actual date(s) of payment of development charges.

Summary

In November of 2006, the City entered into a Subdivision Agreement with Ringley Corporation Ltd. (66M-2436) for the development of a large parcel of land at 115 Torbarrie Road.  As part of this approval, a large park block (Block 158) was conveyed to the City, and the owner agreed to pay for certain Above Base Park Improvements to Block 158.  In return, the Subdivision Agreement states that the owner will receive a credit against the parks and recreation component of such development charges.  Under Phase One of the subdivision, approximately permits for 382 dwelling units were issued in 2007.  Of the development charges paid for these units, the owner was entitled to a maximum credit for $161,000.00, against development charges payable.

 

Parks and Recreation has determined that further work is necessary to complete the improvements to Block 158, in the estimated amount of an additional $170,220.00.  Phase Two of the subdivision will result in construction of approximately 234 dwelling units.  Finance Department has confirmed that the Parks and Recreation component of development charges payable for Phase Two building permits will be sufficient to cover the estimated cost of completing the park ($170,220.00).  The owner has agreed to deliver these additional Above Base Park Improvements, in return for a credit against the parks and recreation portion of development charges payable in Phase Two. When combined with the credit already granted in the Subdivision Agreement, the owner will be entitled to a total development charge credit of $331,220.00 in return for constructing the Above Base Park Improvements to Block 158.
