1. REQUEST FOR AN EXEMPTION FROM BY-LAW NO. 122-93 OF THE FORMER BOROUGH OF EAST YORK TO APPROVE A FRONT YARD PARKING APPLICATION AT 231 MONARCH PARK AVENUE

Reporting on the applicant's appeal of staff's refusal of an application for front yard parking at 231 Monarch Park Avenue, which does not meet the requirements of By-law No. 122-93 of the former Borough of East York. As this is an appeal and a request for an exemption from the by-law, it is scheduled as a deputation item; and recommending that:

(1) City Council approve the application for front yard parking at 231 Monarch Park Avenue, subject to the applicant complying with the criteria set out in By-law No. 122-93 of the former Borough of East York; or

(2) City Council deny the application for front yard parking which involves the paving in hard surface the entire front yard at 231 Monarch Park Avenue; or

(3) City Council approve the application for front yard parking which involves the paving in hard surface the entire front yard at 231 Monarch Park Avenue, notwithstanding that it does not meet the provisions of By-law No. 122-93, subject to:

(a) the applicant installing physical barriers (such as planters of sufficient weight that cannot be easily removed) in order to delineate the parking pad and the private walkway;

(b) parking be approved for one vehicle only; and

(c) the applicant entering into an agreement for the construction and maintenance of the front yard parking pad as provided in By-law No. 122-93 of the former Borough of East York.

2. TRAFFIC POLL RESULTS: IMPLEMENTATION OF ALTERNATE SIDE OVERNIGHT PERMIT PARKING ON SUTHERLAND DRIVE BETWEEN LEA AVENUE AND MARKHAM AVENUE.

Reporting on results of a traffic poll conducted on Sutherland Drive between Lea Avenue and Markham Avenue regarding the implementation of alternate side overnight permit parking; advising that the proposed changes can be accommodated from within the existing Operating Budget; and recommending that the East York Community Council consider the poll results and determine whether or not to implement alternate side overnight permit parking on Sutherland Drive between Lea Avenue and Markham Avenue.

6. PART LOT CONTROL BY-LAW AMENDMENT APPLICATION, PROPOSED 11 UNIT TOWNHOUSE DEVELOPMENT, 131466 ONTARIO LTD., 401 DAWES ROAD.

Recommending approval of a Part Lot Control Exemption Application to permit the development of 11 townhouses on a property currently zoned Residential R2A Site Specific at 401 Dawes Road; advising that there are no financial implications; and recommending that:

(1) Council enact Part Lot Control Exemption By-law with respect to Lots 24, 25, 26 and Part of Lot 27 Registered Plan M-395 City of Toronto known municipally as 401 Dawes Road, (being Part 1 to 21, inclusive, on Draft Reference Plan -_____, a copy of which is attached as Figure 1);

(2) the Part Lot Control Exemption By-law shall expire two years from the date of the passing of the By-law;

(3) prior to Council passing the Part Lot Control Exemption By-law, the owner shall register against title a restriction satisfactory to the City Solicitor, whereby no transfer or charge of the subject lands or any part thereof shall be made without the consent of the Director of Community Planning, East District;

(4) prior to the Director of Community Planning, East District's consent, the applicant is to demonstrate to the City through appropriate legal instrument(s) that easements for access and servicing will be granted to the appropriate property-owners in the development and that a maintenance agreement has been or will be registered against the appropriate titles; and

(5) Council authorize such unsubstantive, technical or stylistic changes to the Part Lot Control Exemption By-law as may be required to properly carry out the intent of this resolution.

7. REQUEST FOR VARIANCE FROM SIGN BY-LAW REQUIREMENTS FOR 995 BROADVIEW AVENUE.

Advising of an application to install a "V" shaped outdoor advertising structure on the roof of the commercial building at 995 Broadview Avenue; that there are no financial implications with respect to this report; and recommending that:

(1) Council deny the variance from the Sign By-law to permit the installation of an outdoor advertising structure on a property with an area of 687 square metres (7,400 square feet); or

(2) if Council wishes to permit the installation of the proposed sign, to do so by way of a Site Specific Sign By-law Amendment, for 995 Broadview avenue; and

(3) the appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

8. REQUEST FOR VARIANCE FROM SIGN BY-LAW REQUIREMENTS FOR 25 BERMONDSEY ROAD.

Reporting on a proposal to relocate an oversized pylon sign at 25 Bermondsey Road; advising that there are no financial implications with respect to this report; and recommending that Council grant the variance from the Sign By-law to permit the relocation of an oversized Pylon sign at 25 Bermondsey Road.

9. APPLICATION TO INSTALL THREE SIGNS INCIDENTAL TO CONSTRUCTION AND LAND DEVELOPMENT ON A VACANT LOT AT CURITY AVENUE AND CRANFIELD ROAD.

Recommending that Council approve the report to permit the installation of three signs incidental to construction and land development, with an aggregate sign area of 20.8 square metres (224.0 sq. ft), on a vacant lot at Curity Avenue and Cranfield Road, subject to requirements under article 5.1 (b) of the Sign By-law.

10. APPEAL DECISION - COMMITTEE OF ADJUSTMENT

Seeking authority for action taken by the Medical Officer of Health to appeal the Committee of Adjustment's decision dated January 11, 2000 respecting 4 Kenrae Road; advising that there are no financial implications and recommending that:

(1) City Council confirm actions taken to appeal the decision of the East York Committee of Adjustment respecting 4 Kenrae Road insofar as it applies to the conditions in the decision restricting the number of dogs to ten; and

(2) the City Solicitor be directed to attend at the Ontario Municipal Board hearing of this appeal to limit the number of dogs to three, in accordance with By-law 28-1999, at the property 4 Kenrae Road.

11. APPOINTMENTS TO THE TODMORDEN MILLS MUSEUM COMMUNITY MUSEUM MANAGEMENT BOARD AND THE EAST YORK COMMUNITY LOCAL ARCHITECTURAL CONSERVATION ADVISORY COMMITTEE (LACAC) PANEL.

Implementing Council's process for appointing Members of Council to Community Local Architectural Conservation Advisory Committee (LACAC) Panels and Community Museum Management Boards; advising that there are no financial implications; and recommending that:

(1) the East York Community Council give consideration to Members' preferences outlined in Schedule 1, and recommend to City Council the appointment of Members of Council to:

(i) East York Community LACAC Panel; and

(ii) Todmorden Mills Museum Community Museum Management Board

for a term of office expiring November 30, 2000, and until their successors are appointed; and

(2) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto.
