A Guide for Retailers provides business owners and employees information on the sale, supply, display and promotion requirements of tobacco and vapour products under the Smoke-Free Ontario Act, 2017 (SFOA, 2017).

It is the responsibility of the business owner to ensure that their store is compliant with the law. In addition, business owners have a legal responsibility to ensure that that they and their employees understand and comply with the requirements of the SFOA, 2017. Business owners must be diligent in training all employees on their legal responsibilities and ensure all applicable signage is posted in accordance with the law.

A business owner is deemed liable for any contravention of the SFOA, 2017 regarding the sale, supply, display and promotion of a tobacco product or vapour product unless the business owner exercised due diligence to prevent such a contravention.
