COMMUNICATIONS/REPORTS

    1.RELEASE OF HYDRO EASEMENT - 21 OAK STREET, YORK

     

    York Solicitor

    (November 4, 1997)

     

    Advising that the Solicitors for the owner of the property known municipally as 21 Oak Street in the City of York have requested that a hydro easement, which was registered on November 21, 1972 as Instrument No. 584524 York, be released from title to the property. The Hydro-Electric Commission for the City of York has advised that the easement was originally needed to protect overhead hydro distribution wires, poles, and anchors when the property was used for the operation of an industrial facility. That facility has since been demolished and all of York Hydro’s plant has been satisfactorily removed and recovered. Accordingly, York Hydro advises that there is no longer a need for the easement and that it may be released. The Solicitor recommends the following:

     

    "That the Mayor and Clerk be authorized to execute on behalf of the City a release to the hydro easement which was registered against a portion of the subject property on November 21, 1972 as Instrument Number 584524 York."

     

    2.APPEAL OF COMMITTEE OF ADJUSTMENT APPLICATION

    No. 3 CA-97-98 - 573 Blackthorn Avenue Ward 28: York Humber

    Advising that the Development Services Department has no objection to the minor variance applications for 106 Gloucester Grove and 28 Guestville Avenue and therefore, there is no need to attend the Municipal Board Hearings to be scheduled for these applications.

     

    In regard to the minor variance application for 573 Blackthorn Avenue, the Department recommended refusal of the application because of the opportunity to provide additional parking in the rear yard and because the application would not meet the intent of Zoning By-law 1-83. The By-law provisions allow for front yard parking where a minimum of one parking space for each dwelling unit is not provided on the lot in a garage, side yard or rear yard and where such parking space is accessed by a driveway greater than 2.4 metres in width. In light of the Department’s recommendation and rationale, staff should be directed to attend the Ontario Municipal Board to recommend refusal of the minor variance application to permit a front yard parking space.

    6.APPLICATION FOR ZONING BY-LAW AMENDMENT
    - 19 KENORA CRESCENT

    Advising applicant that this matter will be forwarded to the next regular meeting of the Land Use Committee for information and that staff will review the application and plans and will then submit a report to the Land Use Committee for consideration and subsequently to Council for adoption.

    7.ZONING BY-LAW AMENDMENT FOR 723 AND 725 JANE STREET AND 120 CORBETT AVENUE

    Ref. Clause No. 104 embodied in Report No. 17 of the Land Use Committee (December 2, 1997) which was adopted by the Council of the City of York at its meeting held on December 9, 1997.

    City of York Council adopted the following recommendation:
    (1.) That the new City of Toronto City Clerk be authorized to provide notification for a Planning Act Public Meeting at the earliest possible date,

    (2.) That the application and the draft Zoning By-law (Schedule 1), worded to the satisfaction of the City Solicitor, be considered for approval, subject to holding a Planning Act Public Meeting and submission of a supplementary report addressing any issues arising from the Public Meeting and written submissions; and

    (3.) That the Owner enter into a Development Agreement with the City prior to the enactment of the Zoning By-law.

     

    8.REQUEST FOR STOP SIGN AT THE CORNER OF HAVERSON BOULEVARD AND DONALD AVENUE

    Advising the results of a recent traffic study with the recommendation that an all-way stop control is not warranted at the intersection of Haverson Boulevard and Donald Avenue, and therefore not recommended for installation.

     

    9.REQUEST FOR REPORT ON REMOVAL OF PARKING METERS ON TIMES ROAD JUST NORTH OF EGLINTON AVENUE WEST

    Advising that the Parking Authority in the early part of 1990 installed a total of three (3) on-street parking meters on the east side of Times Road between the Municipal Lane and Livingstone Avenue to control and regulate illegal long term parking; that this parking currently serves the business community along Eglinton Avenue West, as well as the three municipally addressed businesses located on the west side of Times Road, immediately north of Eglinton Avenue West; and that a recent review of this matter reveals in fact that the parking meters are serving this very purpose to provide additional short term parking for customers within the area. In fact a revenue audit of monies received from these three parking meters reveals a total of $ 2,258.05 over a one year period; and recommended that on-street metered parking on the east side of Times Road between the Municipal Lane and Livingstone Avenue not be removed.

     

    10.REQUEST FOR DISABLED PARKING AT 16 HERTFORD AVENUE

    Advising that Mrs. E. Vieira could legally park on the south side of Hertford Avenue, where on-street parking is presently prohibited, which would result in an impediment to the safe two-way vehicular traffic flow on the street; that they are more inclined to recommend prohibiting parking on the north side of Hertford Avenue, where on-street parking is legally permitted, directly in front of Mrs. E. Vieira’s residence, located at 16 Hertford Avenue. This would enable Mrs. E. Vieira to park in the prohibited disabled parking area by virtue of her provincial permit, without disrupting traffic flow on the street; and recommended that the Uniform Traffic By-laws 196-84 and 2958-94 be amended to establish a designated disabled parking space on the north side of Hertford Avenue, directly in front of municipally addressed residence 16 Hertford Avenue; further, that Mrs. Evelino Vieira receive a copy of this report.

     

    11.REQUEST FOR PARKING PROHIBITION IN FRONT OF 55 LACEY AVENUE

    Advising that presently on-street parking on Lacey Avenue is exclusively permitted on the east side of the street. The parking duration is an unsigned three (3) hour maximum parking regulation, except during the hours of 12:00 midnight to 6:00 a.m. when on-street permit parking is in effect for only those vehicles displaying a valid permit that states Lacey Avenue. Mr. R. Papa is requesting we prohibit parking directly in front of his residence to provide unobstructed sight when exiting his private driveway. Parking is presently prohibited in front of and within 60 cm of a legal driveway. A recent investigation reveals there is sufficient curb length between his driveway entrance/exit and his neighbours driveway to permit a single motor vehicle to legally park, without impeding into the 60 cm setback; and it is therefore recommended that parking not be restricted on the east side of Lacey Avenue, directly in front of 55 Lacey Avenue; and further, that Mr. Raffaele Papa, 55 Lacey Avenue receive a copy of this report.

     

    12.REQUEST FOR PARKING PROHIBITION ON AVALON AVENUE

    Advising that Avalon Avenue presently provides the only access to Roseland Junior Public School; that both parents and the principal have expressed a safety concern as it relates to motor vehicles, being permitted to legally park on the west side of Avalon Road; that field surveys reveal there is a total complement of six (6) curbside parking spaces available on the west side of Avalon Road, which serve to provide parking for the eleven municipally addressed properties, as well as their visitors; and recommended:

     

    That, the local Councillors hold a public meeting with the residents of Avalon Avenue, including the principal of Roseland Junior Public School to determine support for the implementation of a parking prohibition on the west side of Avalon Road between Bexley Crescent and the northerly terminus of the street.

     

    13.REQUEST FOR ALTERNATE PARKING ON SILVERTHORN AVENUE OR A PORTION THEREOF.

    Advising that reversing the legal on-street parking regulation from the west side to the east side of Silverthorn Avenue between Harlton Crescent and Donald Avenue does not resolve motorists obligation to ensure their vehicle is legally parked, but only transfer the risk; that reversing the parking regulation will also result in a loss of three (3) on-street curb side parking spaces for the Silverthorn Market’s customers, as well as the residents of the area; that the Municipality cannot be expected to ignore public safety, for the convenience of motorists whose obligation it is to ensure their vehicle is legally parked; that additionally the owner does have an alternative option to provide commercial boulevard parking directly in front and alongside the flankage of his property, rather than transfer the risk to the opposite side of the street; and recommended:

     

    That the Uniform Traffic By-laws not be amended to reverse the current on- street parking regulation from the west to the east side of Silverthorn Avenue between Harlton Crescent and Donald Avenue;

     

    Further, Mrs. Mary Curtis receive a copy of this report.

     

    14.REQUEST TO CONSIDER REVERSING ON-STREET PARKING FROM THE NORTH TO THE SOUTH SIDE OF LAMBTON AVENUE BETWEEN CLIFF STREET AND ARNOLD AVENUE

    Advising that on-street parking is feasible on either side of Lambton Avenue between Cliff Street and Arnold Avenue; and recommended:

     

    That the Director of Council Services and City Clerk poll the residents of Lambton Avenue between Cliff Street and Arnold Avenue to determine majority interest in reversing on-street parking from the north to the south side of the street;

     

    Further, Mr. John Niemeyer receive a copy of the poll results.

     

    15.PROPOSAL FOR TRAFFIC CALMING MEASURES ON GREENBROOK DRIVE, WARD 27

    Advising that the Works and Parks Committee, at its meeting held on September 22, 1997, directed that the City Clerk conduct a poll of residents on Greenbrook Drive to ascertain whether or not to continue with the traffic calming project on Greenbrook Drive, and to further review the turn prohibition at the corner of Greenbrook Drive and Trethewey Drive, in light of the new traffic calming strategy. The results of the poll conducted of residents on Greenbrook Drive, regarding the traffic calming project (pinch points) on Greenbrook Drive and the turn prohibition at Greenbrook Drive and Trethewey Drive are provided for the consideration and direction of York Community Council.

     

    16.REQUEST FOR LIGHTING LANEWAY BEHIND 316-326 OAKWOOD AVENUE

    (Ref. Clause No. 49.16, Report No. 8 Works and Parks Committee meeting, April 24, 1997)

    Advising that they have incorporated the installation of 1 - New 70 W High Pressure Sodium luminaire at the rear of 326 Oakwood Avenue (adjacent to O’Leary Avenue) facing the laneway, as part of the 1997 City Lane/Street Lighting Approved Program, scheduled for in service this month; and that their file notes suggest a possible additional pole/luminaire half way down the laneway towards Earlsdale Avenue (rear of 318/320 Oakwood Avenue) would inhibit parking.


    17.REQUEST TO HAVE A SECTION OF CEDARVALE PARK DESIGNATED AN OFF-LEASH ZONE FOR DOGS

    Ref. Clause No. 143 embodied in Report No. 16 of the Works and Parks Committee (December 1, 1997) which was amended by the Council of the City of York at its meeting held on December 9, 1997 as follows:

    That the following communication from Dr. Gayle A. Shinder be received,

    Further, that the new City of Toronto Council be requested to develop a uniform policy with respect to leashed and unleashed dogs in city parks; and Further, that the new City Council review all of Cedarvale Park and establish, with community consultation, an unleashed dog area that is larger or different than the one that already exists.

     

    18.NEW NAME - THE TORONTO AND REGION CONSERVATION AUTHORITY

    19.PROPOSED PARKING PROHIBITION ON THE WEST SIDE OF SCARLETT ROAD AT THE LAMBTON GOLF AND COUNTRY CLUB DRIVEWAY
