Recommendations

The City Planning Division recommends that:

 

1.            City Council amend the Zoning By-law for the lands at 50 Resources Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 8.

 

2.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment and Draft Plan of Subdivision as may be required.

 

3.            In accordance with the delegated approval under By-law 229-2000, City Council be advised that the Chief Planner may approve the Draft Plan of Subdivision as generally illustrated on Attachment 2, subject to:

 

a.         the conditions of Draft Plan of Subdivision as set out in Attachment 9 must be fulfilled prior to the release of the plan of subdivision for registration;

b.         any such revisions to the proposed subdivision plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development; and

c.         the approval of the Draft Plan of Subdivision not be issued until the Zoning By-law is in full force and effect.

 

4.            Prior to introducing the necessary Bills to City Council for enactment:

 

a.            the owner enter into a legal agreement under Section 37 of the Planning Act to secure the community benefits outlined in this report;

b.            the owner enter into a Subdivision Agreement as set out in the conditions of Draft Plan of Subdivision; and

c.            the Notice of Approval Conditions for Site Plan Approval be issued.

Summary

This application is to amend the Class One Industrial (I.C1) zoning of the property to permit the development of a 16,230.5 square metre large-format home improvement retail store (including an attached accessory garden centre of 3,060.1 square metres).  The applicant has included on the plans, for illustration purposes only, additional uses currently permitted on the lands.  The application proposes to delete certain incompatible uses from the IC.1 zoning that applies on the lands not occupied by the large-format retail store.

Summary

At its meeting of April 27, 2010, Etobicoke York Community Council deferred consideration of the Final Report related to these applications to its meeting of June 22, 2010.  Community Council directed that a third-party/peer review be prepared by a market consultant and requested the Director, Community Planning, Etobicoke York District, to report on the results of the peer review analysis at the continuation of the statutory meeting.

 

The consultant’s findings and conclusions are found in the attached report, prepared by W. Scott Morgan & Associates Limited.  In addition, Mr. Morgan will present a verbal synopsis of the report and answer any questions from Community Council at the June 22, 2010 meeting.

 

Since the April 27, 2010 Etobicoke York Community Council meeting, Lowes has submitted a Site Plan Control application and has made significant progress toward resolving technical issues related to the Draft Plan of Subdivision.  Further discussions have been held to clarify the proposed zoning by-law.

 

On the basis of those discussions and the progress made on technical matters, staff are recommending adoption of the revised zoning by-law and draft approval of the Draft Plan of Subdivision at this time.  The revisions to these documents, (Attachment 2 and 3 to this report) are considered minor and technical in nature.  Staff also recommend that conditions 4 (b) and (c) in the Final Report be deleted.  Those conditions require the signing of a subdivision agreement and issuance of Notice of Approval Conditions (NOAC) for the Site Plan Control application prior to adoption of the by-law.

2.            Authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

Summary

This application is a City-initiated amendment to the former City of Etobicoke Zoning Code for the property formerly known as 315-325 Dalesford Road.  This amendment responds to Community Council’s direction to amend Site Specific By-law 862-2007 to allow for driveway widths of up to eight metres at the curb for driveways leading to two townhouse units.

3.            The Bills not be introduced to City Council for enactment, until the applicant has constructed a new acoustical fence along the east property line, to the satisfaction of the Director of Community Planning, Etobicoke York District.

Summary

Summary

At the meeting of City Council on June 27, 28 and 29, 2006, the Director of Community Planning, Etobicoke York District, was requested to report to Community Council recommending an amendment to the former City of Toronto Zoning By-law 438-86, once a number of conditions had been satisfied, to permit the conversion of 99 Chandos Avenue, formerly used for industrial purposes, to a residential use containing a building with 15 dwelling units substantially in accordance with the draft Zoning By-law included as Attachment 5 to the Final Report (March 21, 2006) from the Director of Community Planning, Etobicoke York District.

3.            City Council amend By-law No. 264-2003 designating the property at 691 Scarlett Road under Part IV, Section 29 of the Ontario Heritage Act to update the by-law in accordance with Section 30(10) of the Ontario Heritage Act to include a statement explaining the cultural heritage value or interest of the property and a description of its heritage attributes.

 

4.            Should the owner appeal the amending of the designating by-law, City Council authorize the City Clerk to refer the proposed amendment to the Conservation Review Board.

 

5.            Should the owner appeal the amending of the by-law, City Council authorize the City Solicitor and appropriate staff to attend at the Conservation Review Board in support of the proposed amendment. 

 

6.            City Council authorize the City Solicitor and appropriate staff to take such necessary steps to implement the foregoing.

Summary

This report recommends that City Council refuse the application for the demolition of the property at 691 Scarlett Road, which is designated under Part IV, Section 29 of the Ontario Heritage Act.  The report further recommends that Council amend the designating By-law No. 264-2003 to update the by-law in accordance with the 2005 amendments to the Ontario Heritage Act.

The City Planning Division recommends that:

 

1.            City Council direct the appropriate staff to initiate the process for the land exchange/sale of the portions of the Old Mill Drive and Riverview Gardens municipal right-of-ways to implement the proposed road realignments, and initiate the detailed design of the future road alignments.

 

2.            City Council direct Planning staff to continue processing the zoning amendment application with the proposed realignment of Old Mill Drive and Riverview Gardens.

 

3.            The proponent be required to prepare and implement, at their expense, appropriate traffic management measures concurrent with the construction of road realignments and the development, and a post development Traffic and Road Safety Audit to address potential traffic infiltration, pedestrian safety, and possible Mossom Road impacts, to the satisfaction of Transportation Services and City Planning.

 

4.            City Council direct staff to secure appropriate Section 37 community benefits, among other matters as necessary, in an executed agreement prior to the introduction of any Bills to City Council, as outlined in this report.

 

5.            City Council authorize the City Solicitor and appropriate staff to appear before the Ontario Municipal Board should the application be appealed by the proponent and the proposed development be modified from the current proposal outlined in this report.

A technical assessment has determined that the criteria for installing speed humps have not been met for Clouston Avenue, between Weston Road and Denison Road West.

Financial Impact

Adopting the above-noted recommendation does not result in any financial impact; however, if Community Council decides to approve installing traffic calming devices on this section of Clouston Avenue, the following financial impact will result:

 

1.            The estimated cost for installing approximately three speed humps will be $9,000.00. This can be accommodated within funds allocated by City Council as part of the Transportation Capital Budget, subject to competing priorities and funding availability.
