Etobicoke York Community Council recommends:

 

1.            City Council amend the Zoning By-law for the lands at 50 Resources Road substantially in accordance with the draft Zoning By-law Amendment, attached as Attachment 2 to the report (June 18, 2010) from the Director, Community Planning, Etobicoke York District.

 

2.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment and Draft Plan of Subdivision as may be required.

 

3.            In accordance with the delegated approval under By-law 229-2000, City Council be advised that the Chief Planner may approve the Draft Plan of Subdivision as generally illustrated on Attachment 2 to the report (April 9, 2010) from the Director, Community Planning, Etobicoke York District, subject to:

 

a.         the conditions of Draft Plan of Subdivision as set out in Attachment 3 to the report (June 18, 2010) from the Director, Community Planning, Etobicoke York District must be fulfilled prior to the release of the plan of subdivision for registration;

 

b.         any such revisions to the proposed subdivision plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development; and

 

c.         the approval of the Draft Plan of Subdivision not be issued until the Zoning By-law is in full force and effect.

 

4.           City Council direct that, prior to introducing the necessary Bills to City Council for enactment the owner enter into a legal agreement under Section 37 of the Planning Act to secure the community benefits outlined in the report (April 9, 2010) from the Director, Community Planning, Etobicoke York District.

This application is to amend the Class One Industrial (I.C1) zoning of the property to permit the development of a 16,230.5 square metre large-format home improvement retail store (including an attached accessory garden centre of 3,060.1 square metres).  The applicant has included on the plans, for illustration purposes only, additional uses currently permitted on the lands.  The application proposes to delete certain incompatible uses from the IC.1 zoning that applies on the lands not occupied by the large-format retail store.

Summary

At its meeting of April 27, 2010, Etobicoke York Community Council deferred consideration of the Final Report related to these applications to its meeting of June 22, 2010.  Community Council directed that a third-party/peer review be prepared by a market consultant and requested the Director, Community Planning, Etobicoke York District, to report on the results of the peer review analysis at the continuation of the statutory meeting.

 

The consultant’s findings and conclusions are found in the attached report, prepared by W. Scott Morgan & Associates Limited.  In addition, Mr. Morgan will present a verbal synopsis of the report and answer any questions from Community Council at the June 22, 2010 meeting.

 

Since the April 27, 2010 Etobicoke York Community Council meeting, Lowes has submitted a Site Plan Control application and has made significant progress toward resolving technical issues related to the Draft Plan of Subdivision.  Further discussions have been held to clarify the proposed zoning by-law.

 

On the basis of those discussions and the progress made on technical matters, staff are recommending adoption of the revised zoning by-law and draft approval of the Draft Plan of Subdivision at this time.  The revisions to these documents, (Attachment 2 and 3 to this report) are considered minor and technical in nature.  Staff also recommend that conditions 4 (b) and (c) in the Final Report be deleted.  Those conditions require the signing of a subdivision agreement and issuance of Notice of Approval Conditions (NOAC) for the Site Plan Control application prior to adoption of the by-law.

2.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

 

3.            City Council direct that the Bills not be introduced to City Council for enactment until the applicant has entered into an agreement with the City satisfactory to the Director of Community Planning, Etobicoke York District, in consultation with the City Solicitor, to secure at the applicant’s sole expense, the construction of a new acoustical fence along the east property line, such agreement to be financially secured.

Etobicoke York Community Council recommends:

 

1.            City Council refuse the application for the demolition of the property at 691 Scarlett Road under Section 34(1) of the Ontario Heritage Act, on a without prejudice basis to allow the applicant to re-apply.

 

2.            City Council authorize the City Solicitor and appropriate staff to attend at the Ontario Municipal Board hearing in opposition of the appeal should the owner appeal the refusal of the application for demolition.

 

3.            City Council amend By-law 264-2003 designating the property at 691 Scarlett Road under Part IV, Section 29 of the Ontario Heritage Act to update the by-law in accordance with Section 30(10) of the Ontario Heritage Act to include a statement explaining the cultural heritage value or interest of the property and a description of its heritage attributes.

 

4.            City Council authorize the City Clerk to refer the proposed amendment to the Conservation Review Board should the owner appeal the amending of the designating by-law.

 

5.            City Council authorize the City Solicitor and appropriate staff to attend at the Conservation Review Board in support of the proposed amendment should the owner appeal the amending of the by-law. 

 

6.            City Council authorize the City Solicitor and appropriate staff to take such necessary steps to implement the foregoing.

The Etobicoke York Community Council held a statutory public meeting on June 22, 2010, and notice was given in accordance with the Ontario Heritage Act, RSO 1990. 

 

The Etobicoke York Community Council requested the Director, Policy and Research, City Planning, to work with the Ward Councillor to arrange a community consultation meeting to discuss this issue, with all related costs to be borne by the applicant, and report to the January 2011 meeting of the Etobicoke York Community Council.

In the 1940’s, Wallace C. Swanek built his first house at 161 Queenslea Avenue, and a second house at 165 Queenslea Avenue for his family, with the foresight of having parkland across from it.  Wallace continued to build all along Queenslea Avenue, as well as neighbouring streets, and in the early 1950’s, as part of the approval for one of his developments, was required to set aside some parkland; Wallace always dreamed of having a public place of recreation in the area for his children, grandchildren, and the expanding neighbourhood, so he decided to convey to the City much more property than was required of him for the creation of Gary Park.  Although Wallace sadly passed away on March 31, 1985, his contribution to the community, and his gift of a park, was never forgotten, and in 1998 Gary Park was renamed to Wallace C. Swanek Park in his honor.  This park, which is heavily used by the local community, is valued not only for the vast amount of green space it provides to the community, but also for the history it represents.  For over a year, I, along with City staff, have been working with the Pelmo-Swanek Community on a new vision for Wallace C. Swanek Park and on June 24th, 2010 at Neighbours Night Out, City staff will be sharing with the community the new design vision and staged plan that has been developed to see improvements to the existing playground and recreational/sports fields and facilities.

 

While the community has been working hard to see their vision for Wallace C. Swanek Park come to light, the Toronto Catholic District School Board (TCDSB) has indicated interest in pursuing plans to relocate St. John the Evangelist Catholic Elementary School (23 George Street), to the site of this park despite past discussions that were held with them wherein I advised that this park is not an appropriate location for the school, and even suggested alternate sites.  The TCDSB have stated that if the school were to be built on this parkland, many, if not all of the 33 houses immediately surrounding the park would have to be acquired or, if necessary, expropriated.  After a recent meeting with representatives from the TCDSB and the Pelmo-Swanek Community Association (PSCA), the community was made aware of the school board’s intentions and has made it clear that in no way can they support a school being built on the parkland.  The Pelmo-Swanek Community Association has since initiated a petition in opposition of the school board’s proposal which, in the two weeks it has been circulated, has already been signed by over 500 area residents, with more signatures to come.

 

Parkland is meant to be cherished and preserved and the City’s Official Plan recognizes that. While the TCDSB has indicated that they would make sure that the same area of parkland that currently exist would exist if the school were to be built on the parkland, they can only accommodate this by demolishing the houses surrounding the park; this is unacceptable, especially because there are other options for the school board including building a new school on the site of their existing location.
