450 Pape Avenue - Intention to Designate under Part IV, Section 29 of the Ontario Heritage Act
Committee Recommendations

The Toronto Preservation Board recommended to the Toronto and East York Community Council that:

 

1.         City Council include the property at 450 Pape Avenue (William Harris House) on the City of Toronto Inventory of Heritage Properties.

 

2.         City Council state its intention to designate the property at 450 Pape Avenue (William Harris House) under Part IV, Section 29 of the Ontario Heritage Act.

 

3.         If there are no objections to the designation in accordance with Section 29(6) of the Ontario Heritage Act, City Council authorize the City Solicitor to introduce the bills in Council designating the property under Part IV, Section 29 of the Ontario Heritage Act.

 

4.         If there are objections in accordance with Section 29(7) of the Ontario Heritage Act, City Council direct the City Clerk to refer the proposed designation to the Conservation Review Board.

 

5.         If the proposed designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of Council’s decision on the proposed designation of the property.

Summary

This report recommends that City Council include the property at 450 Pape Avenue (William Harris House) on the City of Toronto Inventory of Heritage Properties and state its intention to designate the property under Part IV, Section 29 of the Ontario Heritage Act.

 

At its meeting of September 15, 2009, Toronto and East York Community Council referred a letter dated September 10, 2009 from Councillor Paula Fletcher to the Director, Policy and Research, City Planning Division, to consider a request to have the property at 450 Pape Avenue designated as a heritage property and to report to the Toronto Preservation Board and Toronto and East York Community Council on this matter.

 

Following research and evaluation, staff have determined that the property at 450 Pape Avenue meets Regulation 9/06, the criteria prescribed by the Province of Ontario for municipal designation under Part IV, Section 29 of the Ontario Heritage Act.  If City Council states its intention to designate the property, the owner would be required to apply to Council for permission to alter and/or demolish the building and structures under Part IV, Sections 33 and 34 of the Ontario Heritage Act.

Summary

This report recommends that City Council state its intention to designate the property at 335 Yonge Street (Empress Hotel) under Part IV, Section 29 of the Ontario Heritage Act.  The property was included on the City of Toronto Inventory of Heritage Properties in March 1974.

 

The property at 335 Yonge Street is located on the southeast corner of Yonge Street and Gould Street.  On April 16, 2010, a portion of the north (Gould Street) wall collapsed.

 

At its meeting of April 20, 2010, the Toronto and East York Community Council requested the Manager of Heritage Preservation Services to report to the May 28, 2010 meeting of the Toronto Preservation Board on the designation of the property under Part IV, Section 29 of the Ontario Heritage Act.

 

Following research and evaluation, staff have determined that the property meets Ontario Regulation 9/06, the provincial criteria prescribed for municipal designation under the Ontario Heritage Act.   The designation of the property would enable City Council to control alterations to the site, enforce heritage property standards and maintenance and refuse demolition.

Committee Recommendations

The Toronto Preservation Board recommended to the Toronto and East York Community Council that:

 

1.         City Council state its intention to designate the property at 315 Bloor Street West (Dominion Meteorological Building) under Part IV, Section 29 of the Ontario Heritage Act.

 

2.                  If there are no objections to the designation in accordance with Section 29(6) of the Ontario Heritage Act, City Council authorize the City Solicitor to introduce the bills in Council designating the property under Part IV, Section 29 of the Ontario Heritage Act.

 

3.                  If there are objections in accordance with Section 29(7) of the Ontario Heritage Act, City Council direct the City Clerk to refer the designation to the Conservation Review Board.

 

4.                  If the designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of Council’s decision on the designation of the property.

 

5.                  City Council grant authority for the execution of a Heritage Easement Agreement under Section 37 of the Ontario Heritage Act with the owner of the property.

 

6.                  City Council authorize the City Solicitor to introduce the necessary bill in Council authorizing the entering into of a Heritage Easement Agreement.

Summary

This report recommends that City Council state its intention to designate the property at 315 Bloor Street West under Part IV, Section 29 of the Ontario Heritage Act and to authorize the entering into of a Heritage Easement Agreement between the City and the University of Toronto, owners of the property.  The property at 315 Bloor Street West was listed on the City of Toronto Inventory of Heritage Properties in June 1973.

 

The property at 315 Bloor Street West, which is located on the southwest corner of Devonshire Place and Bloor Street West and contains the building originally known as the Dominion Meteorological Building, is being converted by the University of Toronto for the School of Global Affairs.  The University of Toronto has agreed to the designation of the property and to enter into a heritage easement agreement with the City.

691 Scarlett Road (St. Matthias Anglican Church) - Application to Demolish a Designated Heritage Property and Amendment of Designating By-law
Committee Recommendations

The Toronto Preservation Board recommended to the Etobicoke York Community Council that:

 

1.         City Council refuse the application for the demolition of the property at 691 Scarlett Road under Section 34(1) of the Ontario Heritage Act.

 

2.         Should the owner appeal the refusal of the application for demolition, City Council authorize the City Solicitor and appropriate staff to attend at the Ontario Municipal Board hearing in opposition of the appeal.

 

3.         City Council amend By-law No. 264-2003 designating the property at 691 Scarlett Road under Part IV, Section 29 of the Ontario Heritage Act to update the by-law in accordance with Section 30(10) of the Ontario Heritage Act to include a statement explaining the cultural heritage value or interest of the property and a description of its heritage attributes.

 

4.         Should the owner appeal the amending of the designating by-law, City Council authorize the City Clerk to refer the proposed amendment to the Conservation Review Board.

 

5.         Should the owner appeal the amending of the by-law, City Council authorize the City Solicitor and appropriate staff to attend at the Conservation Review Board in support of the proposed amendment.

 

6.         City Council authorize the City Solicitor and appropriate staff to take such necessary steps to implement the foregoing. 

 

7.         City Council request the Chief Building Official/Executive Director, in consultation with Heritage Preservation Services, to investigate for compliance in accordance with Article V of the Toronto Municipal Code, Chapter 629, Property Standards.

Summary

This report recommends that City Council refuse the application for the demolition of the property at 691 Scarlett Road, which is designated under Part IV, Section 29 of the Ontario Heritage Act.  The report further recommends that Council amend the designating By-law No. 264-2003 to update the by-law in accordance with the 2005 amendments to the Ontario Heritage Act.

 

The owner of the property at 691 Scarlett Road submitted an application to demolish a heritage building under Section 34(1) of the Ontario Heritage Act.  A Notice of Receipt was served on the owner on April 22, 2010.  City Council must provide a decision on the application within 90 days after the Notice of Receipt is served.  This decision deadline is July 21, 2010. 

 

The City has not received an application for the redevelopment of the site.

Revised Report - Short-Term Delegation of Authority to Deal with Applications under Parts IV and V of the Ontario Heritage Act During and After the 2010 Municipal Election
Committee Recommendations

The Toronto Preservation Board recommended to the Planning and Growth Management Committee that:

 

1.                 Approval of this report by the Toronto Preservation Board shall be considered to be consultation with the Toronto Preservation Board for all purposes under the Act, including subsections 29(2), 32(2), 33(4), 33(15), 34(2) and 42 (4.1).

 

2.                 Except for permits that must be or are deemed to be issued under Article IV of the Municipal Code, Chapter 103, Heritage, City Council direct the Chief Planner to refuse applications made under Parts IV and V of the Ontario Heritage Act that have not been considered by Council at or prior to its last regularly scheduled meeting before the October 2010 municipal election and for which the ninety-day period in which Council must respond will expire before Council's first regularly scheduled meeting in 2011, unless the applicant or owner agrees to extend this period to allow Council to consider the application at its first regularly scheduled meeting in 2011.

 

3.                City Council direct the Chief Planner to express Council’s intention to designate listed properties, after the last City Council meeting of the term until the resumption of regular City Council meetings following the October 2010 municipal election when an application to alter or demolish a listed property is submitted.

 

4.                 City Council direct the Chief Planner to report back to City Council through the Toronto Preservation Board and respective Community Councils at the next available meeting after the resumption of regular City Council meetings following the October 2010 municipal election with a list of the applications received and the decisions made during the delegation period.
