In Toronto, the use and sale of fireworks are regulated by the Fireworks Bylaw. Businesses that sell family fireworks from a temporary mobile outlet, such as a trailer in a parking lot, are required to obtain a permit. These businesses may only sell fireworks during one or more of the following time periods:

  • Victoria Day and the seven days immediately before Victoria Day
  • Canada Day and the seven days immediately before Canada Day
  • Diwali Day and the seven days immediately before Diwali Day

Minimum Age

Must be at least 18 years of age

Identification Requirements

Original documents are required for all applications and renewal transactions.

Include two pieces of government-issued identification (one must be photo ID):

  • Canadian Passport
  • Driver’s Licence
  • Canadian Birth Certificate
  • Citizenship Card
  • Permanent Resident Card
  • SIN Card (Social Insurance Number)
  • Valid Work Permit

Note:

  • First and last names must match on all identification.
  • We do not accept Health Cards.
  • Identification is required for all officers/directors listed on the Articles of Incorporation, Corporate Profile or Federal Form 6

Business Requirements

All applicants must also provide the following:

Corporations must also provide:

  • a copy of Articles of Incorporation (Note: If there has been a change to the list of officers and directors, please also provide a current Corporate Profile Report or a Federal Form 6)
  • the Annual Return for Corporation Form which lists all current directors and officers of the Corporation. This must be:
    • original as copies will not be accepted
    • signed by an officer/director of the Corporation. The Form cannot be signed by a designate of the Corporation.

If a director of the corporation is unable to apply in person at the Licence and Permit Issuing Office, a designate may apply on their behalf. The designate must:

  • have an original letter advising of their signing authority on corporation letterhead, signed by a director of the corporation dated within 30 days
  • provide two pieces of identification for themselves
  • provide two pieces of identification for each officer and director of the corporation, or if original identification is not available, photocopies of the identification will also be accepted.

Insurance Requirements

Family fireworks include low hazard fireworks for recreation, such as fireworks showers, fountains, golden rain, lawn lights, pinwheels, Roman candles, volcanoes, sparklers and other similar devices.

Vendors selling family fireworks need to show proof of at least $2,000,000 in Comprehensive General Liability insurance, naming the City of Toronto as an additional insured.

The completed insurance form must be signed and stamped by the insurer.

Permission From the Property Owner

Temporary mobile outlet must be located on a private property. This property can either be owned by the vendor or by a property owner providing written permission allowing the sale of fireworks.

This permission should be on a  letterhead dated the current calendar year advising that the property owner gives permission for fireworks to be sold on the property.

Provide a sketch of the property and indicate where fireworks will be sold.

Federal Explosives Licence

A Natural Resources Canada Authorization of Explosives licence is required if the vendor stores over 1000 kg (gross weight) of family fireworks at the site.

The Licence and Permit Issuing Office at the East York Civic Centre is closed due to COVID-19. Businesses requiring licences and/or permits from the City of Toronto can apply via a new online application portal.

Selling To Minors

Do not sell fireworks to minors below the age of 18.

Location

Temporary mobile outlet must be located on a private property. This property can either be owned by the vendor or by a property owner providing written permission allowing the sale of fireworks.

Outlet must have two unobstructed exits to ensure that employees and the public can quickly evacuate in case a fire.

Post visible “NO SMOKING” signs at the front of the outlet and make sure there are at least two fully operational fire extinguishers ready for immediate use at all times. These extinguishers need to be a minimum of 3A60BC fire extinguishers.

Displaying Fireworks Permit

A permit is needed for each outlet from which fireworks are being sold. Display a copy of the current, valid permit in a clearly visible location.

Information For Fireworks Buyers

Vendors are required to display information about fireworks regulations and safety tips at their store. They also need to provide this information to buyers purchasing fireworks.

Storing Fireworks

All family fireworks stored at the outlet should be located:

  • A minimum of 20 metres from any road
  • 30 metres from any occupied building or dwelling and
  • 30 metres from any gas station or other place where explosives or other highly flammable substances are stored or sold.

The storage of the fireworks must meet the requirements of the Explosives Act. Storing fireworks in vehicles is prohibited.
