The Toronto Building division of the City of Toronto is responsible under the Ontario Building Code Act, for enforcing the Ontario Building Code in the City of Toronto. This responsibility includes the issuance of building permits to verify that construction meets the requirements of the building code and other applicable laws.
On those developments where balcony glass has failed, and an unsafe condition has been identified, Toronto Building has issued orders to protect the public with overhead protection in the form of hoarding (and other measures) and to engage the services of an engineer to assess the situation and prescribe actions necessary to make the conditions safe on each site.
We are taking these incidents very seriously. We have been working cooperatively with the developers carrying out the conditions of the orders issued to protect public safety and find a remedy to the situation.
At this point, the cause of the failures is not known. On August 31, 2011 reports from the affected property owners are due to the City. By September 15, 2011 those property owners have been required to provide a proposal for remedying the situation to the City.
Toronto Building and the Chief Building Official are working proactively to protect the public and provide safety to those using and those around the buildings. The City of Toronto is working collaboratively with all other levels of government, the development industry, Tarion and associations representing the development industry. Toronto Building, in consultation with those involved, is undertaking a comprehensive review of all of the properties, to identify causes and potential solutions. The Chief Building Official will report to the Planning & Growth Management Committee in the fall of 2011 on the progress being made with the review.
