This staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

The purpose of this report is to consider a request by the owner(s) of 19 Camilla Crescent to be exempted from Chapter 447-Fences section (2) of the Toronto Municipal Code.  This section states that the maximum height of a fence in the front yard on a residential property is 1.2 metres and a fence within 2.4 metres of a driveway shall be open mesh chain-link or of an equivalent open-fence so as to not obstruct the view of the boulevard or highway.  The definition of a “fence” under Chapter 447 includes any hedge or shrub.

The General Manager of Parks, Forestry and Recreation recommends that:

 

1.         City Council approve the naming of the newly-constructed facility at 25 Mendelssohn Street “Warden Hilltop Community Centre”.

Summary

The purpose of this report is to seek City Council approval to name the newly-constructed facility located at 25 Mendelssohn Street.

 

The Parks, Forestry and Recreation Division is recommending that the facility name Warden Hilltop Community Centre be officially adopted as the name of the new facility.

 

The Parks, Forestry and Recreation Division has exercised due diligence in ensuring that all criteria in the Naming and Renaming for Parks and Recreation Facilities Policy has been met and recommends the naming of this facility.

1.         Rename Stamford Park situated at 1255 Victoria Park to “Jim McPherson Park” in honour of Mr. McPherson’s significant contributions to the community and the development of soccer in the City of Toronto.

This report responds to the request made at Scarborough Community Council, regarding the renaming of Stamford Park located at 1255 Victoria Park in honour of  Jim McPherson.

Parks, Forestry, and Recreation staff is recommending that Stamford Park situated at 1255 Victoria Park be officially renamed “Jim McPherson Park” in honour of Mr. McPherson’s significant contributions to the community and the enhancement of soccer in the City of Toronto.

 
Parks, Forestry and Recreation staff have exercised due diligence in ensuring that all criteria in the Naming and Renaming for Parks and Recreation Facilities Policy have been met. At the community meeting held on May 19th at Scarborough Soccer Centre, residents expressed that the proposed name of “McPherson Park” should be amended to “Jim McPherson Park” to distinguish among other residents in the ward with the McPherson name.

Toronto Building, Scarborough District, recommends that Scarborough Community Council:

 

1.         Approve the application to demolish the subject residential building at 3354 Kingston Road with the following conditions:

 

a.         that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official;

 

b.         that all debris and rubble be removed immediately after demolition;

 

c.         that the site be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5 and 629-10, paragraph B;

 

d.         that any holes on the property are backfilled with clean fill;

 

e.         that in accordance with the Municipal Code Chapter 363-12, the applicant for the demolition permit constructs and substantially completes the new building to be erected on the site of the residential property to be demolished not later than two years from the day demolition of the existing building is commenced; and

 

f.          that on failure to complete the new building within the time specified in (e) above, the City Clerk shall be entitled to enter on the collector’s roll, to be collected in like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit contained in the residential property in respect of which the demolition permit is issued and that such sum shall, until payment, be a lien or charge upon the lands in respect of which the permit to demolish the residential property is issued.

1.        Enact the compulsory stops regulation(s), as identified in Appendix 1 of this report.

Summary

This staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

During an operational review on Silversted Drive, Transportation Services staff identified eight uncontrolled three-way intersections in the immediate area of Briarscross Boulevard and Pipers Green Avenue. 

 

It is recommended that minor street stop signs be installed at the subject eight uncontrolled three-way intersections to clearly define the right-of-way and to regulate traffic flow.

Financial Impact

 The financial cost of installing the subject recommended stop controls is approximately $2,250.00.  The funding for these stop controls is available in the Transportation Services 2010 Operating Budget, within Cost Centre TP0397.

Summary

This staff report is about a matter for which the Community does not have delegated authority from City Council to make a final decision.

 

The purpose of this report is to obtain approval for the installation of Traffic Control Signals on Victoria Park Avenue, approximately 170 metres north of Denton Avenue.

 

This report recommends that the City install these new traffic control signals.

Financial Impact

These traffic signals will be funded by the Toronto Transit Commission. This results in no financial impact on the Transportation Services budget. The proposed Traffic Control Signals are estimated to cost $200,000.00.

Transportation Services, Scarborough District, recommends that Scarborough Community Council recommend that City Council:

 

1.         Approve the installation of traffic control signals at the intersection of Rouge River Drive/west intersection and Sheppard Avenue East.

 

2.         Pass or amend the appropriate by-law(s) accordingly.

Summary

This staff report is about a matter for which the Community Council does not have delegated authority from City Council to make a final decision.

 

The purpose of this report is to secure authority for the installation of Traffic Control Signals at Rouge River Drive/west intersection and Sheppard Avenue East.

 

Traffic studies reveal that pedestrian crossing protection is warranted in the form of traffic control signals.

Financial Impact

There is no financial impact associated with this report; however, the financial cost of installing these new traffic control signals would be approximately $150,000.00 should the installation be approved.  The funding for these signals is not available in Transportation Services Division’s Capital Works Budget under Project No. CTP710-01.

The City Planning Division recommends that:

 

1.         Staff be directed to schedule a community consultation meeting for the lands at 1625 Military Trail together with the Ward Councillor.

 

2.         Notice for the community consultation meeting be given to landowners and residents within 120 metres of the site.

 

3.         Notice for the public meeting under the Planning Act be given according to the regulations under the Planning Act.

Summary

This application was made on April 19, 2010 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

An official plan amendment, zoning by-law amendment and site plan control application have been submitted for a 4-storey, 160-unit retirement home.  The gross floor area of the proposed building is 13 111 square metres (141,130 square feet).  A total of 66 at grade parking spaces are proposed.  The official plan amendment application is required to amend Site and Area Specific Policy Number 293 to provide for a 160-unit retirement home and to reduce the right-of-way width of Military Trail between Old Kingston Road and Highway 2A from 27 metres to 23 metres.  The zoning by-law amendment application seeks to rezone the property from Multiple-Family Residential (M) in the Highland Creek Community Zoning By-law No. 10827 to an Apartment Residential (A) Zone.

 

This report provides preliminary information on the above-noted applications and seeks Community Council's directions on further processing of the applications and on the community consultation process.

 

The application has been circulated to City divisions and external agencies, where appropriate, for comment.  The report recommends that a community consultation meeting be scheduled by City Planning staff, in consultation with the Ward Councillor.  A final report and a public meeting under the Planning Act is targeted for the first quarter of 2011, providing the applicant submits required information in a timely manner.

Summary

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

The application proposes to rezone the subject lands to permit the use of the lands for a recreational sports facility.  This facility will include two 50 metre swimming pools, a running track, gymnasium(s), meeting rooms, ancillary offices, food and retail uses.  This facility will also serve as the Aquatic Centre for the 2015 Pan/Parapan American Games.

 

This report provides preliminary information on the application and seeks Community Council's directions on further processing of the application and on the community consultation process.

The application is currently considered “incomplete” under the Planning Act, and additional information is required from the applicant.  The applicant is encouraged to submit additional required materials so that staff can properly evaluate the application.

2.         Authorize the City Solicitor to make such stylistic and technical changes to the draft zoning by-law amendment as may be required.

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes to rezone the lands at 2025 Midland Avenue to permit a four-storey, 2787 square metre (30,000 s.f.), medical/office building, including ground floor commercial uses.  Current employment uses permitted on the site would be maintained.

 

The proposed land uses are consistent with the Employment Areas designation of the Official Plan, the Provincial Policy Statement and conforms to the Growth Plan for the Greater Golden Horseshoe.  The proposed medical/office building and commercial uses on the site are compatible with surrounding development and appropriate for this location.

 

This report reviews and recommends approval of the application to amend the zoning by-law.

4.         Before introducing the necessary zoning by-law Bill for enactment, City Council require the applicant to enter into a site plan control agreement under Section 41(16) of the Planning Act and Section 114 of the City of Toronto Act.

Summary

This application proposes to rezone the lands at 96 State Crown Boulevard in order to permit a vehicle repair garage (auto body and painting), an ancillary vehicle sales operation and vehicle parking or display within the State Crown Boulevard street yard.

 

Industrial uses and vehicle service garages are permitted on the subject property.  The proposed vehicle repair garage and ancillary vehicle sales uses are considered appropriate with the proposed development standards to ensure that they will be at a scale and location on the property that does not detract from other uses within the employment area.  Also, in designating the property under site plan control, the subject lands would be developed with a site design which includes landscaping, screening and limited street yard parking to ensure that the lands remain compatible with the surrounding area.

 

This report reviews and recommends approval of the application to amend the zoning by-law and to further place the subject lands under site plan control.

The City Planning Division recommends that City Council:

 

1.         Amend the Official Plan for the lands at the southeast corner of Corporate Drive and Consilium Place, substantially in accordance with the draft official plan amendment attached as Attachment 10.

 

2.         Amend the zoning by-law for the lands at the southeast corner of Corporate Drive and Consilium Place, substantially in accordance with the draft zoning by-law amendment attached as Attachment 11.

 

3.         Authorize the City Solicitor to make such stylistic and technical changes to the draft official plan amendment and draft zoning by-law amendment as may be required.

 

4.         Before introducing the necessary Bills to City Council for enactment, City Council require the owner to provide a cheque payable to the City of Toronto, in the amount of $400,000.00 for the purposes of conducting a Markham Branch (Corporate Drive) Flood Remediation Study which would include a Technical Study and Environmental Assessment (EA) Study of the feasibility, cost and options to remove the owner’s lands and other affected private lands in the vicinity, from the floodplain.

 

5.         Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an agreement pursuant to Section 37 of the Planning Act to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and the City Solicitor, such agreement to be registered on title to the lands to secure the following facilities, services and matters totalling $2,000,000:

 

Phase I:

 

a.         an indexed cash contribution of $1,000,000.00 payable to the City of Toronto prior to the issuance of the first above-grade building permit for the Phase I development (760 dwelling units) for the provision of the following:

 

i.          $400,000 to fund improvements to the Scarborough Animal Centre;

 

ii.         $300,000 to fund showers/multi-purpose room/gym facilities within the new Scarborough Centre Branch Library to be constructed adjacent to the Scarborough Civic Centre and/or to fund construction of these facilities within the Scarborough Civic Centre and improvements to the pedestrian access between the Library and the Scarborough Civic Centre;

 

iii.        $100,000 for Public Art within the public realm adjacent to, or in close proximity to the subject site;

 

iv.        $100,000 for the Scarborough Walk of Fame; and

 

v.         $100,000 to fund improvements to the Toronto Wildlife Centre.

 

Phase II:

 

b.         an indexed cash contribution of $1,000,000.00 payable to the City of Toronto prior to the issuance of the first above-grade building permit for the Phase II development (755 dwelling units) for the provision of the following:

 

i.          $400,000 to fund improvements to the Scarborough Animal Centre;

 

ii.         $400,000 to fund improvements/restoration to the Woodlot of the Civic Precinct of the Scarborough Centre; improvements to and/or re-naturalization/restoration of the open space and/or channel of the Markham Branch of the East Highland Creek, and street tree planting within the McCowan Precinct of the Scarborough Centre;

 

iii.        $100,000 for the Scarborough Walk of Fame; and

 

iv.        $100,000 to fund improvements to the Toronto Wildlife Centre.

 

c.         Additional matters in support of the development, to be secured in the Section 37 Agreement, as a legal convenience, are set out in Attachment 1 (Matters to be Secured in the Section 37 Agreement) of this report, and include matters respecting:

 

           funding of a Flood Remediation Study by the owner;

           completion of the Study to the satisfaction of the City and the Toronto and Region Conservation Authority;

           remediation works to be completed by the City and funded by the owner;

           cost-sharing of the Study and remediation works;

           floodplain management;

           conditions for the removal of a Holding (H) provision (zoning by-law);

           land conveyances and timing;

           provision of easements;

           provision of a privately-owned, publicly accessible open space park;

           matters to be addressed under site plan control review; and

           submission/approval of architectural and landscape plans and drawings.

 

6.        Before introducing the necessary Bills to City Council for enactment, all architectural and landscape plans and drawings submitted to the City Planning Division for review on May 31, 2010, are to the satisfaction of the Director, Community Planning, Scarborough District.

Summary

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes a mixed use development consisting of four residential buildings, ranging in height from 36 to 45 storeys and containing 1,515 dwelling units.  The buildings would be connected by four and five-storey podium elements containing townhouse units, retail space and residential amenity areas.  The development is proposed to be constructed in two phases.  Phase I consists of the west portion of the site along Consilium Place.  Phase II, comprising the east portion of the site, adjacent to the East Highland Creek, would be subject to a Holding (H) provision in the zoning by-law which would not be removed until issues related to floodplain and stormwater management have been resolved.

 

This report reviews and recommends approval of applications to amend the Official Plan and Zoning By-law, including the requirement for community benefits in return for the increased height and density, pursuant to the provisions of Section 37 of the Planning Act.
