The purpose of this report is to consider a request by the owner(s) of 19 Camilla Crescent to be exempted from Chapter 447-Fences section (2) of the Toronto Municipal Code.  This section states that the maximum height of a fence in the front yard on a residential property is 1.2 metres and a fence within 2.4 metres of a driveway shall be open mesh chain-link or of an equivalent open-fence so as to not obstruct the view of the boulevard or highway.  The definition of a “fence” under Chapter 447 includes any hedge or shrub.

Parks, Forestry, and Recreation staff is recommending that Stamford Park situated at 1255 Victoria Park be officially renamed “Jim McPherson Park” in honour of Mr. McPherson’s significant contributions to the community and the enhancement of soccer in the City of Toronto.

 
Parks, Forestry and Recreation staff have exercised due diligence in ensuring that all criteria in the Naming and Renaming for Parks and Recreation Facilities Policy have been met. At the community meeting held on May 19th at Scarborough Soccer Centre, residents expressed that the proposed name of “McPherson Park” should be amended to “Jim McPherson Park” to distinguish among other residents in the ward with the McPherson name.

1.         Approved the application to demolish the subject residential building at 3354 Kingston Road with the following conditions:

 

a.         that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official;

 

b.         that all debris and rubble be removed immediately after demolition;

 

c.         that the site be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5 and 629-10, paragraph B;

 

d.         that any holes on the property are backfilled with clean fill;

 

e.         that in accordance with the Municipal Code Chapter 363-12, the applicant for the demolition permit constructs and substantially completes the new building to be erected on the site of the residential property to be demolished not later than two years from the day demolition of the existing building is commenced;

 

f.          that on failure to complete the new building within the time specified in (e) above, the City Clerk shall be entitled to enter on the collector’s roll, to be collected in like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit contained in the residential property in respect of which the demolition permit is issued and that such sum shall, until payment, be a lien or charge upon the lands in respect of which the permit to demolish the residential property is issued;

 

g.        that all privately and publicly owned trees, which are protected by the City of Toronto By-laws, be protected in accordance with the By-laws during the demolition process.

a.         that the owner(s) enter into an encroachment agreement with the City to the satisfaction of the City Solicitor and the General Manager of Transportation Services;

 

b.         that the life of the Agreement be limited to 5 years from the date of registration on title or to the date of removal of the encroachment(s) at which time, the City may consider the Agreement for further extension, if requested by the applicant;

 

c.         the appropriate staff be directed to assist with establishment of a mitigation plan;

 

d.         that indemnification be provided to the City for all liability relating in any way to the encroachment with the City of Toronto added as additional insured for such liability for the lifetime of the Agreement in a form as approved by the City Solicitor, in an amount no less than $5,000,000.00 or such greater amount as the City Solicitor may require;

 

e.         that in the event of sale or transfer of the property abutting the encroachment, Legal Services be authorized to extend the Encroachment Agreement to the new owner, subject to the approval of the General Manager of Transportation Services; and

 

f.          the owner(s) pay the following fees:

 

a.         Application Fee of $2,068.59.

 

b.         Legal Administration Cost and Registration on Title, plus disbursements including G.S.T.

 

c.         Encroachment deposit of $225.00 per monitoring well.

 

2.         Authorized the City Solicitor to prepare and execute the encroachment agreement.

The purpose of this report is to consider a request by the owner(s) of 1030 Birchmount Road, to install monitoring wells within the City of Toronto right-of-way on Ashtonbee Road and Birchmount Road. The approval process requires that the adjacent property owner, CGU Canada Services Inc. enter into an encroachment agreement with the City of Toronto in order to obtain a Utility Cut Permit, so that soil samples can be excavated and  monitoring wells be installed.  This will lead to establishing a course of action on how to mitigate any potential contamination of the Birchmount Road and Ashtonbee Road right-of-ways and any other City land.

This application proposes to rezone the lands at 2025 Midland Avenue to permit a four-storey, 2787 square metre (30,000 s.f.), medical/office building, including ground floor commercial uses.  Current employment uses permitted on the site would be maintained.

 

The proposed land uses are consistent with the Employment Areas designation of the Official Plan, the Provincial Policy Statement and conforms to the Growth Plan for the Greater Golden Horseshoe.  The proposed medical/office building and commercial uses on the site are compatible with surrounding development and appropriate for this location.

Scarborough Community Council recommends that:

 

1.         City Council amend Employment District Zoning By-law No. 24982 (Tapscott Employment District) for the lands at 96 State Crown Boulevard, substantially in accordance with the draft zoning by-law amendment attached as Attachment 5 to the report (June 2, 2010) from the Director, Community Planning, Scarborough District.

 

2.         City Council amend the Scarborough Site Plan Control By-law No. 21319 substantially in accordance with the draft site plan control by-law attached as Attachment 6 to the report (June 2, 2010) from the Director, Community Planning, Scarborough District.

 

3.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft by-laws as may be required.

 

4.         City Council, before introducing the necessary zoning by-law Bill for enactment, require the applicant to enter into a site plan control agreement under Section 41(16) of the Planning Act and Section 114 of the City of Toronto Act.

This application proposes to rezone the lands at 96 State Crown Boulevard in order to permit a vehicle repair garage (auto body and painting), an ancillary vehicle sales operation and vehicle parking or display within the State Crown Boulevard street yard.

 

Industrial uses and vehicle service garages are permitted on the subject property.  The proposed vehicle repair garage and ancillary vehicle sales uses are considered appropriate with the proposed development standards to ensure that they will be at a scale and location on the property that does not detract from other uses within the employment area.  Also, in designating the property under site plan control, the subject lands would be developed with a site design which includes landscaping, screening and limited street yard parking to ensure that the lands remain compatible with the surrounding area.

 

This report reviews and recommends approval of the application to amend the zoning by-law and to further place the subject lands under site plan control.

Scarborough Community Council recommends that:

 

1.         City Council amend the Official Plan for the lands at the southeast corner of Corporate Drive and Consilium Place, substantially in accordance with the draft official plan amendment attached as Attachment 10 to the report (June 4, 2010) from the Director, Community Planning, Scarborough District.

 

2.         City Council amend the zoning by-law for the lands at the southeast corner of Corporate Drive and Consilium Place, substantially in accordance with the draft zoning by-law amendment attached as Attachment 11 to the report (June 4, 2010) from the Director, Community Planning, Scarborough District.

 

3.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft official plan amendment and draft zoning by-law amendment as may be required.

 

4.         Before introducing the necessary Bills to City Council for enactment, City Council require the owner to provide a cheque payable to the City of Toronto, in the amount of $400,000.00 for the purposes of conducting a Markham Branch (Corporate Drive) Flood Remediation Study which would include a Technical Study and Environmental Assessment (EA) Study of the feasibility, cost and options to remove the owner’s lands and other affected private lands in the vicinity, from the floodplain.

 

5.         Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an agreement pursuant to Section 37 of the Planning Act to the satisfaction of the Chief Planner and Executive Director, City Planning Division, and the City Solicitor, such agreement to be registered on title to the lands to secure the following facilities, services and matters totalling $1,800,000:

 

Phase I:

 

a.         an indexed cash contribution of $900,000.00 payable to the City of Toronto prior to the issuance of the first above-grade building permit for the Phase I development (760 dwelling units) for the provision of the following:

 

i.          $360,000 to fund improvements to the Scarborough Animal Centre;

 

ii.         $270,000 to fund showers/multi-purpose room/gym facilities within the new Scarborough Centre Branch Library to be constructed adjacent to the Scarborough Civic Centre and/or to fund construction of these facilities within the Scarborough Civic Centre and improvements to the pedestrian access between the Library and the Scarborough Civic Centre;

 

iii.        $90,000 for Public Art within the public realm adjacent to, or in close proximity to the subject site;

 

iv.        $90,000 for the Scarborough Walk of Fame; and

 

v.         $90,000 to fund improvements to the Toronto Wildlife Centre.

 

Phase II:

 

b.         an indexed cash contribution of $900,000.00 payable to the City of Toronto prior to the issuance of the first above-grade building permit for the Phase II development (755 dwelling units) for the provision of the following:

 

i.          $360,000 to fund improvements to the Scarborough Animal Centre;

 

ii.         $360,000 to fund improvements/restoration to the Woodlot of the Civic Precinct of the Scarborough Centre; improvements to and/or re-naturalization/restoration of the open space and/or channel of the Markham Branch of the East Highland Creek, and street tree planting within the McCowan Precinct of the Scarborough Centre;

 

iii.        $90,000 for the Scarborough Walk of Fame; and

 

iv.        $90,000 to fund improvements to the Toronto Wildlife Centre.

 

c.         Additional matters in support of the development, to be secured in the Section 37 Agreement, as a legal convenience, are set out in Revised Attachment 1 (Matters to be Secured in the Section 37 Agreement) and includes matters respecting:

 

           funding of a Flood Remediation Study by the owner;

           completion of the Study to the satisfaction of the City and the Toronto and Region Conservation Authority;

           remediation works to be completed by the City and funded by the owner;

           cost-sharing of the Study and remediation works;

           floodplain management;

           conditions for the removal of a Holding (H) provision (zoning by-law);

           land conveyances and timing;

           provision of easements;

           provision of a privately-owned, publicly accessible open space park;

           matters to be addressed under site plan control review; and

           submission/approval of architectural and landscape plans and drawings.

 

6.        Before introducing the necessary Bills to City Council for enactment, all architectural and landscape plans and drawings submitted to the City Planning Division for review on May 31, 2010, are to the satisfaction of the Director, Community Planning, Scarborough District.

 

7.         Before introducing the necessary Bills to City Council for enactment, the Section 37 Agreement noted in Recommendation 5 include a clause that the Owner will develop and maintain the Publicly Accessible Landscaped Open Space above base condition that includes additional park improvements (such as a gazebo, shade structures, a water play area/splash pad, playground equipment, sculptures) at the Owner's expense in a manner satisfactory to the General Manager of Parks, Forestry and Recreation having regard to the Landscape Plan.

 

8.         Before introducing the necessary Bills to City Council for enactment, the Section 37 Agreement noted in Recommendation 5 include a clause that the Owner and the City agree that the value of the Landscape Improvement above base condition thereon and the value of the Publicly Accessible Landscaped Open Space, adjacent to the East Highland Creek as determined by independent appraisal subject to the approval of the General Manager of Parks, Forestry and Recreation at the issuance of the first Building Permit for Phase II of the Development, shall be credited against any cash in lieu of parkland payment required by the City for the Parkland Dedication Requirement. Notwithstanding the foregoing, the value of the credit for the Publicly Accessible Landscaped open space shall not exceed $200,000.

 

9.         City Council authorize City Staff  to submit a site specific amendment to Chapter 165 of the former City of Toronto Municipal Code as may be necessary to implement the parkland contribution credit towards the Parkland Dedication Requirement set out in Recommendation 8.

 

10.       Before introducing the necessary Bills to City Council for enactment, the Section 37 Agreement noted in Recommendation 5 include a clause that the Owner agrees that should the value of the Publicly Accessible Landscaped Open Space and the Landscape Improvements referred to in Recommendation 8 be more than the amount owing under Chapter 165 of the former City of Toronto Municipal Code for cash in lieu of parkland that there shall be no credit to the Owner by the City in terms of cash or a credit, partial or otherwise or towards future development.

 

11.       City Council direct Planning staff to create a Corporate Drive Working Group composed of representatives of 68 Corporate Drive Condominium Corporation 1143, the owners of the “Menkes” site and City staff during the construction phase of the development in order to address issues such as noise, dust, truck routing, traffic and other issues as identified by the working group.

 

12.       City Council direct Transportation Services staff to report to Scarborough Community Council on possible traffic improvements in the Corporate Drive/Consilium Place/McCowan Road area to address traffic congestion including the feasibility of creating/continuing a two-lane, north-bound access ramp at McCowan Road and Consilium Place.

 

13.       City Council require the owners of the property to make a minimum of two, at-grade parking stalls available in both phase I and phase II of the development (for a minimum of four dedicated parking stalls) to a car share program, and that Council require the condominium corporation to endeavour to ensure car share membership for all owners/occupants of the buildings.

 

14.       City Council require the owners to create a 30 metre wide sodded, publicly accessible park space running parallel to Highland Creek from the north to the south edges of their property prior to September 1, 2010 including a minimum of $25,000 of playground equipment, at the sole cost of the applicant to the satisfaction of Technical Services and Toronto Region Conservation Authority and the General Manager of Parks, Forestry and Recreation.

This application was made on or after January 1, 2007 and is subject to the new provisions of the Planning Act and the City of Toronto Act, 2006.

 

This application proposes a mixed use development consisting of four residential buildings, ranging in height from 36 to 45 storeys and containing 1,515 dwelling units.  The buildings would be connected by four and five-storey podium elements containing townhouse units, retail space and residential amenity areas.  The development is proposed to be constructed in two phases.  Phase I consists of the west portion of the site along Consilium Place.  Phase II, comprising the east portion of the site, adjacent to the East Highland Creek, would be subject to a Holding (H) provision in the zoning by-law which would not be removed until issues related to floodplain and stormwater management have been resolved.

 

This report reviews and recommends approval of applications to amend the Official Plan and Zoning By-law, including the requirement for community benefits in return for the increased height and density, pursuant to the provisions of Section 37 of the Planning Act.
