Under Toronto Municipal Code 629, all damaged or dead trees, branches or portions thereof must be removed by the property owner.

However, if the tree is not owned by you, you may have the right to prune it so long as you ensure that no damages will be caused. You are best to enter into an agreement with the tree owner for the pruning.

A fallen tree or tree limb(s) that has fallen onto a neighbouring property is the responsibility of the property owner where the tree/limb has fallen.
