Committee Recommendations

Etobicoke York Community Council recommends that:

 

1.            City Council amend the Official Plan for the property at 2123 Lake Shore Boulevard West and 68 Marine Parade Drive substantially in accordance with the draft Official Plan Amendment attached as Attachment 6.

 

2.            City Council amend Zoning By-law 1994-149 for the property at 2123 Lake Shore Boulevard West and 68 Marine Parade Drive substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 7.

 

3.            City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and/or draft Zoning By-law Amendment as may be required.

 

4.            The Land Owners Precinct Plan be finalized to the satisfaction of the City Solicitor and City Planning, in consultation with Technical and Transportation Services.

 

5.            The City Solicitor in consultation with the Owner be required to amend any of the agreements, already registered on-title, as necessary to secure the community benefits, parks and road infrastructure improvements described in this report.

Summary

The application to amend the Official Plan and Zoning By-law proposes to increase the permitted building height of 37 storeys, to allow a 39-storey condominium building on the lands at 2123 Lake Shore Boulevard West. The two 16-storey mid-rise buildings previously approved at 68 Marine Parade Drive have been redesigned to a single 30-storey building with retail uses at grade.

a.            The City Solicitor be authorized to prepare an Encroachment Agreement for the proposed encroachment.

 

b.            The owner to enter into an Encroachment Agreement with the City of Toronto and pay all fees associated with the preparation of the Agreement. Should an annual fee be charged in future, the owner shall be responsible for payment of the fees.

 

c.            The signed agreement to be returned to the City along with the required Certificate of Insurance, evidencing a third party bodily injury and property damage insurance in the amount of $2,000,000.00 or such other coverage and greater amount as the City may require, and naming the City of Toronto as an additional insured party under the policy.

1.            City Council accept the Offer to Purchase from Khaled Allaham and Salah Dean Allaham to purchase the City-owned parcel of vacant land located at the rear of 102 and 104 Stanley Avenue, shown as Part 1 and Part 2 on Sketch No. PS-2001-006 (the “Sketch”), being Part of Lot 54, Plan 852Y and designated as Parts 5 and 6 on Reference Plan 64R-2060, City of Toronto, subject to the retention of an easement over the entire property for sewer purposes (the “Property”), in the amount of $7,000.00, substantially on the terms and conditions outlined in Appendix “A” to this report.

 

2.            City Council authorize each of the Chief Corporate Officer and the Director of Real Estate Services severally to accept the Offer to Purchase on behalf of the City.

 

3.            City Council direct that a portion of the proceeds of closing be directed to fund the outstanding expenses related to the Property and the completion of the sale transaction.

 

4.            City Council authorize the City Solicitor to complete the transaction on behalf of the City, including paying any necessary expenses, amending the closing, due diligence and other dates, and amending and waiving terms and conditions, on such terms as she considers reasonable.

1.         Approved the variance from Article I of Chapter 693, Signs, of the Toronto Municipal Code, for 2 Wickman Road, subject to the following conditions:

 

a.         Both faces of the existing billboard to be converted to digital with static images, as the only permitted uses.

 

b.         The static images will be allowed to change every 5 to 10 seconds.

 

c.         Video, scrolling, full motion or animation will not be permitted uses, only static digital images be permitted.

 

d.         This technology shall allow for the digital board to automatically adjust itself to control any ambient light levels.

 

e.         Time be provided for the City of Toronto and/or the immediate community, to use for community messages, Amber Alerts, etc.

That Recommendation 1. under Decision Advice and Other Information be amended to re-assign the request for a report from the Director and Deputy Chief Building Official to the City Manager instead, in that the coordination of information involves multi-departments, so that the decision of the Committee now reads as follows:

              Etobicoke York Community Council:

 

1.         Directed that the City Manager, in consultation with the City Solicitor, the General Manager, Parks Forestry and Recreation, the General Manager, Transportation Services, and the Director, Finance and Administration, report on:

 

a.         An assessment of the location at 1111 Arrow Road to determine the feasibility of relocating the proposed community public space, which includes the flagpole project, landscape features, and associated concessions and amenities previously approved by City Council, from the Emery Yard to 1111 Arrow Road.

 

b.         An assessment of the potential for the City of Toronto and the Emery Village Business Improvement Area to expand its community programming and promote its business improvement objectives on the 1111 Arrow Road site as well as the potential use of Section 37 funding for the flagpole project on the site. 

 

c.         A meeting with the Owner of 1111 Arrow Road, in consultation with the Emery Village Business Improvement Area, and the Ward Councillor, to negotiate a potential agreement.
