The 2024 City Budget approved a reinstatement of Committee of Adjustment user fee rate increases as recommended through the 2022 Development Application Fee Review (2022.PH34.6). As a result, effective April 1, 2024, there will be a 10 per cent increase to Minor Variance and Consent application fees.

For proposals involving Minor Variance or Consents approvals you must submit a Committee of Adjustment Application. You can only submit applications by email at the time.

Effective April 1, 2024

Effective April 1, 2024, there will be a 10 per cent increase to Minor Variance and Consent application fees.

Applicants who received payment instructions before March 28, 2024 will have until April 8, 2024 to make payment and provide a Record of Payment to Toronto Building Customer Service (unless otherwise instructed in writing by Customer Service Staff). Failure to do so will lead to the application being subject to April 1, 2024 Committee of Adjustment fees.

Fees Effective January 1, 2024 – March 31, 2024

Minor Variance

  • Additions and alterations to existing dwellings with three units or less: $1,865.57
  • Residential dwellings with three units or less: $4,194.08
  • All other residential, commercial, industrial or institutional uses: $5,428.19
  • After the Fact variances: double the regular fee

Consent

  • Base fee for severing one lot into two or establishing a new easement: $6,763.20
  • Fee for each additional lot created: $5,491.71
  • Fee to sever multiple lot additions for the creation of one or more new lots (per existing lot): $3,381.60
  • Validation of Title, Technical Severance, Leases, Mortgage Discharge, Lot Additions, Re-Establishing Easements: $1,904.85

Fees Effective April 1, 2024

Minor Variance

  • Additions and alterations to existing dwellings with three units or less: $2,044.69
  • Residential dwellings with three units or less: $4,596.78
  • All other residential, commercial, industrial or institutional uses: $5,949.38
  • After the Fact variances: double the regular fee

Consent

  • Base fee for severing one lot into two or establishing a new easement: $7,412.57
  • Fee for each additional lot created: $6,019.00
  • Fee to sever multiple lot additions for the creation of one or more new lots (per existing lot): $3,706.29
  • Validation of Title, Technical Severance, Leases, Mortgage Discharge, Lot Additions, Re-Establishing Easements: $2,087.75

On November 1, 2019, the City Planning Division implemented a new refund policy for all Committee of Adjustment applications. The policy will be applied to all CoA applications submitted on or after November 1, 2019.

Incomplete Applications

If a file is closed by Committee of Adjustment staff due to the determination that the application is incomplete, all but $100 per application may be returned to the applicant. These refunds will be processed by the Deputy Secretary-Treasurer of the Committee of Adjustment.

Withdrawn Applications

Requests for refunds for withdrawn Committee of Adjustment applications must be made in writing to the Deputy Secretary-Treasurer of the Committee of Adjustment.

Refunds may be granted by the Deputy Secretary-Treasurer of the Committee of Adjustment for:

  • The withdrawal of consent and minor variance applications prior to internal circulation, in which case 80% of the application fee may be refunded; and
  • The withdrawal of consent and minor variance applications after internal circulation but prior to the Notice of Hearing being mailed, in which case 50% of an application fee may be refunded.

There shall be no refund for withdrawal of an application once a Notice of Hearing has been mailed.

Other Refund Requests

Requests for partial or full refunds for a reason other than the withdrawal of an application must be made in writing to the Deputy Secretary-Treasurer and will be considered and a decision will be made by the Secretary-Treasurer of Committee of Adjustment or the Committee of Adjustment panel.

Amendments to the Policy

Amendments to this policy may be made from time-to-time as determined necessary for administrative purposes by the Secretary-Treasurer of the Committee of Adjustment at their discretion.

Committee of Adjustment Applications in the Village of Long Branch

At its meeting of January 31, 2018, City Council adopted Long Branch Neighbourhood Character Guidelines.

The Long Branch Neighbourhood Character Guidelines will be used in the review of all new development applications and public initiatives for all lands designated Neighbourhoods bounded by Lake Ontario to the south, the rail corridor to the north, Twenty Third Street to the east, and Forty Second Street (including Marie Curtis Park) to the west.

The Long Branch Neighbourhood Character Guidelines will be used by home builders, the community, City staff, committees and appeal bodies to provide direction in their decision making as they develop plans, review applications for redevelopment and/or enhance the public realm in the Long Branch Neighbourhood.
