Advising that Ms. Margaret Zerafa has reported damages to her basement that she claims was caused by a tree located on City property; providing a letter from John J. Blatinecz, PH.D., Professor of Wood Science, Faculty of Forestry, University of Toronto, confirming that the root came from a silver maple tree, most likely from the one on the subject property since that tree is the closest to the house (at about 20 feet); and also a letter from J. W. Kidd, Acclaim Adjusting Service Inc.(representing the insurers of the former Corporation of the City of York) advising Margaret Zerafa that in order for her to be successful in her claim against the City, she must demonstrate the City was negligent in some way even if she shows roots from a City tree invaded her drain and basement and suggesting she seek independent legal advice.

Requesting members of the Community Council to propose the names of citizen and business representatives to serve on the sub-committee, and that this information be submitted to the May 27, 1998 meeting of the Community Council.

 

4. 295 BOON AVENUE - REQUEST FOR WITHDRAWAL OF PROPERTY CLEANUP CHARGES IMPOSED BY THE CITY, WARD 28, YORK-EGLINTON.

Recommending that a rebate for costs incurred to clean up the property not be granted; advising that warning letters were sent to the owners of 295 Boon Avenue on November 7, 1996 with an extension granted to November 22, 1996; June 26, 1997 by prepaid registered mail which was refused by the addressee; written warnings were issued personally by the supervisor providing a compliance date of August 11, 1997; and that on August 19, 1997, on instructions from the City, the property was cleared of all junk, rubbish and debris by a private contractor at a cost of $461.00 for labour and dumping costs (two truckloads) to clear the property.

5. REQUEST FOR EXEMPTION FROM NOISE BY-LAW IN CONJUNCTION WITH THE RESURFACING OF ARTERIAL ROADS IN THE

CITY OF TORONTO, WARD 27, YORK HUMBER.

(a) Eglinton Avenue West from Black Creek to intersection at Weston Road ; and

(b) Rogers Road from Old Weston Road to Weston Road North (intersections of Rogers Road at Old Weston Road, Keele Street, and Bicknell Avenue).

Recommending that an exemption from the Noise by-law be granted to the Transportation Department, Construction Branch, City of Toronto from 7:00 p.m. to 6:00 a.m. from

(a) April 20,1998 to August 21, 1998; and (b) August 31, 1998 to December 4,1998; and advising that maintenance and repair are necessary at these intersections requiring the removal of the existing pavement.

 

6. REQUEST FOR EXEMPTION FROM NOISE BY-LAW 3453-79 IN CONJUNCTION

WITH TWO HOLY FESTIVALS - ST. MATTHEW=S CHURCH,

Sunday, June 28, 1998 From 8:00 p.m. to 12:00 a.m.

Friday, September 4,1998 From 8:00 p.m. to 12:00 a.m.

and advising that for the past three years, the applicants have held their festivals in

conjunction with granted exemptions to the Noise By-law without reported incidents.

 

7. PRELIMINARY REPORT ON REZONING APPLICATION FOR

15 ROBINA AVENUE, WARD 28, YORK-EGLINTON.

Recommending that this report be received; advising that the Department provided no comment on the minor variance application for 2A Montye Avenue, therefore, no direction is required for staff to attend the Municipal Board hearing; and with regard to 460 Rogers Road, the Department in commenting on the minor variance and consent applications, indicated no objections; that at the request of the Department, Committee imposed a condition to require the owner to enter into a consent agreement to address the soil remediation of the site by way of a Record of Site Condition and any other matters deemed appropriate by the City Solicitor; that there is no matter of significance to Council policy and staff need not attend the Ontario Municipal Board hearing on this matter when it is scheduled.

 

 

10. APPLICATION FOR LIQUOR LICENCE - 1980 EGLINTON AVENUE WEST

11. REQUEST FOR 24 HOUR PERMIT PARKING ON BATAVIA AVENUE

WARD 27, YORK-HUMBER.

Recommending that the Uniform Traffic By-law 2958-94 be amended to rescind the daytime no parking prohibition during the hours 9:00 a.m. to 5:00 p.m., Monday through Friday, on Batavia Avenue between St. Clair Avenue West and Pritchard Avenue; advising that the petition received represented a total of twenty-six (26) municipally addressed residences requesting the service; that there is a total of fifty-three (53) municipally addressed properties on Batavia Avenue between St. Clair Avenue West and Pritchard Avenue; and that the petition represents 49% of the total number of municipally addressed properties on the street.

 

 

12. CASH PAYMENT-IN-LIEU OF PARKING - 1728 EGLINTON AVENUE WEST

WARD 28, YORK-EGLINTON.

Recommending that York Community Council approve a cash payment-in-lieu of three (3) parking spaces required at 1728 Eglinton Avenue West, in accordance with the Zoning

By-law 1-83; advising that the owner is required to provide an additional three (3) parking spaces to convert the existing restaurant into a licenced establishment; that currently on-street parking is legally permitted on both the north and south sides of Eglinton Avenue West, immediately adjacent to these premises providing one (1) hour maximum parking duration controlled by parking metres; and in addition, there are two municipal parking lots all within walking distance of the establishment, which provide for varied parking durations dependent upon the customers= needs.

 

 

13. REQUEST FOR DISABLED PARKING SPACE - 360 WHITMORE AVENUE

WARD 28 - YORK-EGLINTON.

Recommending that (1) the Uniform Traffic By-law 2958-94 be amended to prohibit parking anytime on both the north and south sides of Whitmore Avenue to establish a designated disabled parking space for one vehicle length, directly in front of municipally addressed residences 360 and 345 Whitmore Avenue; and (2) that Mr. W. Richman receive a copy of this report; and advising that Mr. W. Richman has obtained permission from his neighbour residing at 345 Whitmore Avenue to designate a disabled parking space on their side of the street that will enable the City to create a designated disabled parking space on both the north and south sides of the street, to coincide with the legal parking regulations, without disrupting traffic.

 

 

 

14. REQUEST FOR ALL-WAY STOP CONTROL AT GLENHOLME AVENUE AND EARLSDALE AVENUE, WARD 28, YORK-EGLINTON.

Recommending that an all-way stop control is not warranted at the intersection of Glenholme Avenue and Earlsdale Avenue, and therefore not recommended for installation; advising that to ensure the overall effectiveness and safety of all-way stop conditions, established warrant criteria are utilized in analyzing the eight (8) hour count data to determine if the warrants are justified; that in order for an intersection to be warranted for an all-way stop control, at least one of the five warrant criteria must be fulfilled one hundred percent; and that a recent study at the intersection of Glenholme Avenue and Earlsdale Avenue indicated that none of the warrant criteria were fulfilled.

26. TORONTO TRANSIT COMMISSION 1999 SERVICE PLAN

Advising that he received the resolution from the April 1, 1998 York Community Council meeting forwarded to the TTC=s attention; that the TTC will, as part of its 1999 Service Plan, examine improved service to both West Park Hospital and the Humber River Regional Hospital - Church Street site; that the service plan is currently being developed, and will be presented to the Commission and distributed to City Councillors for comments this summer.

 

27. WARD BOUNDARY REVIEW PROCESS.

Advising that Community Councils are being requested to hold meetings to invite the public=s input on the matter of ward boundaries, ward division and governance, and report

thereon through the Urban Environment and Development Committee (Reference Recommendation No. (8); forwarding for information and any attention deemed necessary, Clause No. 1 contained in Report No. 4A of The Urban Environment and Development Committee, which was adopted, by the Council of the City of Toronto at its Special Meeting held on April 28 and May 1, 1998, amended by striking out Recommendations Nos. (6) and (8) embodied in the joint report dated March 12, 1998, from the City Clerk and the Commissioner of Urban Planning and Development Services and inserting in lieu thereof the following: (6) the appropriate staff develop plans which give effect to City Council=s decision that there will be three Councillors from East York; and (8) Community Councils be requested to hold meetings to invite the public=s input on the matter of ward boundaries, ward division and governance, and report thereon through the Urban Environment and Development Committee.

 

28. EXISTING ENVIRONMENTAL COMMITTEES AND THE ENVIRONMENTAL TASK FORCE.

Advising that the Special Committee to Review the Final Report of the Toronto Transition Team (1) concurred with Recommendation AA@ embodied in the report (March 10, 1998) from the Commissioner of Works and Emergency Services, subject to amending Recommendation No. (3) to read as follows: that each Community Council be asked to advise the Special Committee to Review the Final Report of the Transition Team on the ongoing need for a general environmental advisory committee for its Community after receiving comments from the Environmental Task Force; and (2) requested the City Clerk to canvass Members of Council to ascertain whether any additional Members are interested in participating on the Storm Water Group.
