Bargaining with TCEU Local 416 (CUPE) updates

City Council has approved the memorandum of settlement between the City and the Toronto Civic Employees' Union Local 416 (CUPE), which represents the City's 6,000 outside workers and paramedics.The Memorandum of Settlement reflects the replaced language of the former collective agreement with the text shown struck through, while new language is reflected in bolded text.

Special Council Meeting on February 15
The City of Toronto will hold a special Council meeting on Wednesday, February 15 to consider the tentative agreement between the City and the Toronto Civic Employees' Union Local 416 (CUPE), which represents the City's 6,000 outside workers and paramedics.
The special session of City Council will begin at 9:30 a.m. in the Council Chamber. Members of the public are invited to attend the public portion of the meeting.
A ratification vote by Local 416 members will be held on Monday, February 13.
The City and Local 416 signed a Memorandum of Settlement yesterday confirming the terms of the tentative agreement announced by the parties on February 5.
Details of the agreement will be posted on the City's website when it has been approved by Council.

City and CUPE Local 416 sign Memorandum of Settlement
The City of Toronto and Toronto Civic Employees' Union Local 416 (CUPE), which represents the City's 6,000 outside workers and paramedics, signed a Memorandum of Settlement today at 3:15 p.m. confirming the terms of the tentative agreement announced by the parties on February 5.
The next step in the process to finalize the agreement is ratification by Local 416 membership and approval by City Council. The union has set a date of February 13 for its ratification vote. Following union ratification, City Council will meet in a special session to consider the agreement. The date of the meeting will be announced as soon as possible.
Details of the agreement will be posted on the City's website when it has been approved by Council.

- This afternoon, the City of Toronto requested a No Board Report from the Ontario Minister of Labour with regard to collective bargaining with the Toronto Civic Employees Union (CUPE) Local 416. Local 416 represents approximately 6,000 "outside workers". Collective bargaining with Local 79 continues.
- Conciliation with Local 416 commenced on Monday, January 9th with the recently appointed Conciliation Officer. The parties met again on Tuesday, January 10 and today, Thursday, January 12. Local 416 has not made any meaningful proposals or counterproposal on any of the City's substantive issues.
- When the City and Local 416 are notified of a 'No Board', the union will be in a legal strike position and the City in a legal lockout position in approximately 17 days. The notification will provide a specific date from which any actions may be taken.
- The City has a contingency plan in place that addresses the operation of key City services in the event of a labour disruption. Plans will be communicated at the appropriate time.

December 15, 2011
- The City filed a Request for the Appointment of a Conciliation Officer with the Ministry of Labour. Conciliation is a process by which a trade union or an employer can ask the Ministry of Labour for help in resolving their differences so that they can reach a collective agreement. Either party may apply to the ministry.
December 14, 2011
- The City of Toronto and Local 416 exchanged, at bargaining, proposals in regards to provisions in the collective agreement that apply to full-time paramedics. The City of Toronto notified Local 416 of its intent to hire part-time employees in the future, including qualified paramedics to work part-time hours.
- Local 416 has not offered any further dates to meet to bargain.
December 12, 2011
- The City arranged, with Local 416's concurrence, that the Deputy City Manager and Chief Financial Officer and the Director, Pension, Payroll & Employee Benefits to attend the negotiations meeting to make presentations on the City's financial and budget circumstances and the cost of benefits. Mark Ferguson, President Local 416 did not attend the meeting.

- The City of Toronto and TCEU Local 416 held bargaining sessions. L416 cancelled December 5th (a date previously agreed to by them).
October 19, 2011
- Collective bargaining commenced and the parties exchanged bargaining proposals.
October 4, 2011
- The City of Toronto provided formal written notice to the Toronto Civic Employees' Union (TCEU) Local 416 to commence collective bargaining.
Bargaining status as at November 10, 2011
Notice to commence bargaining was provided to each Local on October 4, 2011.
The City met with Local 79 on October 17; however, the Local was unwilling to commence bargaining and continues to be unwilling to commence bargaining. The City does not believe that collective bargaining commenced as required under the Labour Relations Act and yesterday filed a complaint on the grounds of unfair labour practice with the Ontario Labour Relations Board. The City has also written to the Ministry of Labour requesting that a conciliator be appointed.
The City met with TCEU Local 416 (CUPE) on October 19 where bargaining proposals were exchanged and preliminary discussions were held. The parties have had only the single bargaining session despite the City's offer to meet at any time.
