City Council on April 6, 2009, adopted the following:

 

1.         City Council authorize the preparation of a by-law for the alteration of St. Clair Avenue West, between Old Weston Road and Gunns Road/Old Stock Yards Road, to allow construction of the Preferred Design Concept identified through the St. Clair Avenue West Transit Improvements Class Environmental Assessment study process.  The modifications are generally as shown on Drawing Nos. 421F-9594, 421F-9595, 421F-9596, 421F-9597 and 421F-9598 dated March 2009, include:

 

a.         Construction of a raised, mountable trackbed in the centre of St. Clair Avenue West, between signalized intersections, with curbs as required, for the exclusive use of public transit vehicles and emergency service vehicles, including Police, Fire, and Emergency Medical Services; and

 

b.         Widening portions of the pavement up to 2.8 metres, on the north and south sides of St. Clair Avenue West between Old Weston Road and Gunns Road/Old Stock Yards Road; and, widening the pavement up to 7 metres for the section on the south side of St. Clair Avenue West between Old Weston Road to just west of Old Weston Road, generally as shown on Drawing Nos. 421F-9594, 421F-9595, 421F-9596, 421F-9597 and 421F-9598 dated March 2009.

 

2.         City Council authorize the installation of the proposed streetcar loading platforms on St. Clair Avenue West, between Old Weston Road and Gunns Road/Old Stock Yards Road, listed in the attached Appendix “A”.

 

3.         City Council request City staff, in consultation with GO Transit, Metrolinx and the Ward Councillors, to investigate opportunities to undertake changes to the underpass on St. Clair Avenue West between Old Weston Road and Keele Street, and the General Manager, Transportation Services report to the Public Works and Infrastructure Committee on the outcome of this review, including any financial implications to the City.

 

4.         City Council request the General Manager, Transportation Services, to review, in consultation with the local area Councillors, the possibility of a "red light like camera" to deter vehicles from entering the streetcar lane at the Weston Road underpass where the streeetcar track will not be on a separate right-of-way.

            City Council settle the appeal under zoning by-law amendment file no. 08 149633 WET 02 OZ by:

 

1.                  instructing  the City Solicitor to support at the OMB Hearing an amendment to the zoning by-law to implement the development proposed in the attached site plan (Attachment “A”), such by-law to be to the satisfaction of the City Solicitor and to reflect the settlement  reducing the number of residential units from 11 to 10, provided the OMB’s order  approving the zoning by-law amendment not be issued until the applicant has executed a financially secured Letter of Undertaking, satisfactory to the City Solicitor in consultation with the Executive Director of Technical Services, undertaking to carry out, at the applicant’s sole expense, the reconstruction of the south side of Chapman Road adjacent to the development site, including concrete road curb, concrete sidewalk, depressed driveway curbs, paved driveway entrances, boulevard sod, and any localized improvements necessary to transition the existing roadway to the development, and to pay City engineering and inspection fees;

 

2.            authorizing the General Manager of Parks, Forestry and Recreation to issue permits to  injure or destroy trees necessary to implement the development proposed in the attached site plan (Attachment “A”) and in accordance with the Arborist and Tree Preservation Plan, prepared by Bostock Consulting Inc., dated October 13, 2008, and the comments and requirements set out in the memorandum dated November 3, 2008 to Community Planning from the Supervisor of Tree Protection and Plan Review; and

 

3.            authorizing the enactment of a by-law to dedicate the one foot reserve along the south side of Chapman Road as part of the public highway.

1.         City Council be advised, in accordance with the delegated approval under by-law 229-2000, that the Chief Planner intends to approve the draft plan of common elements condominium, as generally illustrated on Attachment 1 to the report (March 2, 2009) from the Director, Community Planning, North York District, subject to:

 

a.         the conditions as generally listed in Attachment 2 to the report (March 2, 2009) from the Director, Community Planning, North York District, including the following additional condition to Attachment 2:

 

“(5)      The declaration shall contain a clause providing that in the event of the redevelopment of 63, 61, 59 and 57 Finch Avenue West, the owners of 65 and 67 Finch Avenue West shall make best efforts to put in place reciprocal agreements with the neighbouring properties to allow the continuation of the rear driveway easterly to Elmview Avenue to permit usage of the driveway in either direction for all abutting landowners and to ensure that the costs for maintenance and repair of the driveway are shared”;

 

which except as otherwise noted must be fulfilled prior to the release of the plan of condominium for registration; and

 

b.         any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.

 

2.         City Council enact a Part Lot Control Exemption By-law with respect to the subject lands, to be prepared to the satisfaction of the City Solicitor, and that such By-law shall expire two years after it has been enacted.

 

3.         City Council authorize the City Solicitor to introduce the necessary Bill provided that prior to the introduction of the Bill:

 

a.         the owner provides proof of payment to the satisfaction of the City Solicitor of all tax arrears and current property taxes for the subject site; and

 

b.         the owner of the subject lands has registered, satisfactory to the City Solicitor, a Section 118 restriction under the Land Titles Act agreeing not to transfer or mortgage any part of the lands without the prior written consent of the Chief Planner or designate.

 

4.         City Council authorize and direct the appropriate City Officials to register the Part Lot Control Exemption By-law on title.

 

5.         City Council authorize the City Solicitor to take the necessary steps to release the Section 118 restriction at such time as the Common Elements Condominium Plan has been registered.

d.         encouraging the Toronto Parking Authority (TPA) to establish a municipal parking facility within the Civic Precinct;

 

e.         directing Parks, Forestry and Recreation staff to update the 1989 Woodlot Management and Restoration Plan as required, and develop an implementation strategy and report back, if necessary, to obtain the appropriate approvals and funding;

 

f.          directing Facilities and Real Estate and Parks, Forestry and Recreation staff, in consultation with City Planning, to initiate a process whereby a qualified landscape architectural consultant is retained for the design and development of the expanded Albert Campbell Square, including new furnishings for the existing Square, so that implementation can occur when the City receives the strata land interest, and report back, if necessary;

 

g.         directing Facilities and Real Estate staff, in consultation with the Ward Councillor, City Planning and the Toronto Transit Commission (TTC), to develop a proposal for weather protection enhancements to the Galleria connecting Albert Campbell Square to the Scarborough Town Centre and report back as necessary to obtain the appropriate approvals and funding;

 

h.         directing Transportation Services staff in consultation with the Ward Councillor and City Planning to examine the feasibility of reconfiguring Borough Approach East and Borough Approach West to allow for full-moves intersections at Ellesmere Road, and report back as necessary to obtain the appropriate approvals and funding;

1.         provide a Heritage Impact Statement that provides a rationale supporting the proposed alteration as it relates to the Wychwood Park Heritage Conservation District Plan, to the satisfaction of Manager, Heritage Preservation Services;

 

2.         provide building permit drawings with elevations that secure materials and detailing to the satisfaction of the Manager, Heritage Preservation Services;

 

3.         provide a grading and excavation plan to the satisfaction of the Manager, Heritage Preservation Services;

 

4.         provide a detailed landscape plan with revised arborist report and tree protection plan. Plans shall be accompanied with itemized cost estimates.  Information shall be to the satisfaction of the Supervisor, Tree Protection and Plan Review, Urban Forestry and Manager, Heritage Preservation Services;

 

5.         provide a Letter of Credit to the City in a form and an amount satisfactory to the Chief Planner and Executive Director, City Planning Division, to secure the work identified in the above item (4.) to the satisfaction of Supervisor, Tree Protection and Plan Review, Urban Forestry and Manager, Heritage Preservation Services;

 

6.         obtain a zoning review of the plans dated and received by the City on March 27, 2009, prepared by Phillip H. Carter; and

 

7.         enter into and register an Agreement pursuant to Section 45(9) of the Planning Act, which secures the conditions outlined in Recommendation 2(2), (3) and (4),  to the satisfaction of the City Solicitor.

 

(3)        Prior to the release of the Letter of Credit, the owner shall complete the work as described in item 2(2)(b)(4.), which includes the implementation of the tree protection plan, to the satisfaction of Supervisor, Tree Protection and Plan Review, Urban Forestry and Manager, Heritage Preservation Services.

 

(4)        The owner shall construct and thereafter maintain the alterations to the building and the property substantially in accordance with the plans outlined in Recommendation 2(2)(b).

 

(5)        City Council authorize staff to take all necessary steps to implement the foregoing, including authorizing the execution of the required section 45 Planning Act Agreement.

 

3.         City Planning staff and where appropriate, Urban Forestry staff with respect to landscaping and tree preservation, consult with the Wychwood Park Heritage Advisory Committee when reviewing the applicant's submissions as per the conditions in Part 2 above.

 

4.         The Chief Planner and Executive Director, City Planning, retain an outside heritage consultant, if funds become available, to update and strengthen the Wychwood Park Heritage Conservation District Plan, within one year.

 

5.         The City Clerk notify the owner, including their solicitor, in writing, including by registered mail, of the City Council decisions to refuse the demolition and to approve the alteration within 7 business days of the end of the Council meeting.

5.         provide a Letter of Credit to the City in a form and an amount satisfactory to the Chief Planner and Executive Director, City Planning Division, to secure the work identified in the above item (4.) to the satisfaction of Supervisor, Tree Protection and Plan Review, Urban Forestry and Manager, Heritage Preservation Services;

 

6.         obtain a zoning review of the plans dated and received by the City on March 27, 2009, prepared by Phillip H. Carter; and

 

7.         enter into and register an Agreement pursuant to Section 45(9) of the Planning Act, which secures the conditions outlined in Recommendation 2(2), (3) and (4),  to the satisfaction of the City Solicitor.

 

(3)        Prior to the release of the Letter of Credit, the owner shall complete the work as described in item 2(2)(b)(4.), which includes the implementation of the tree protection plan, to the satisfaction of Supervisor, Tree Protection and Plan Review, Urban Forestry and Manager, Heritage Preservation Services.

 

(4)        The owner shall construct and thereafter maintain the alterations to the building and the property substantially in accordance with the plans outlined in Recommendation 2(2)(b).

 

(5)        City Council authorize staff to take all necessary steps to implement the foregoing, including authorizing the execution of the required section 45 Planning Act Agreement.

 

3.         City Planning staff and where appropriate, Urban Forestry staff with respect to landscaping and tree preservation, consult with the Wychwood Park Heritage Advisory Committee when reviewing the applicant's submissions as per the conditions in Part 2 above.

 

4.         The Chief Planner and Executive Director, City Planning, retain an outside heritage consultant, if funds become available, to update and strengthen the Wychwood Park Heritage Conservation District Plan, within one year.

 

5.         The City Clerk notify the owner, including their solicitor, in writing, including by registered mail, of the City Council decisions to refuse the demolition and to approve the alteration within 7 business days of the end of the Council meeting.

Liquor Licence - 1301 Queen Street East - "Ceili Cottage"
City Council Decision

City Council on April 6, 2009, adopted the following:

 

1.         City Council direct the City Clerk to advise the Registrar of the Alcohol and Gaming Commission of Ontario (“AGCO”) that the liquor licence application for Ceili Cottage, 1301 Queen Street East (“Premises”), is not in the public interest having regard to the needs and wishes of the residents, unless the following conditions, in the form substantially set out below, are attached to the liquor licence:

 

a.         The sale and service of alcohol shall cease on the Licensed Patio at 11:00 p.m. daily and all signs of sale and service shall be cleared by 11:00 p.m. No patrons will be allowed to remain on the Licensed Patio after 11:00 p.m.

 

b.         Subject to final capacities established by the Fire Marshall, no more than 40 patrons shall be allowed on the Licensed Patio at one time.

 

c.         There shall be no speakers, televisions or amplified music on the patio at any time. Acoustic live musical performances without amplification shall be permitted on the patio but shall cease no later than 9:00 p.m. daily.

 

d.         The Licensee shall ensure that lighting used on the Licensed Patio will be designed so as to minimize impacts on the surrounding street and residences.

 

e.         Any doors between the Licensed Patio and the indoor portion of the establishment shall be kept closed at all times, except to allow for ingress and egress of patrons and staff.

 

f.          The Licensee shall ensure that any doors between the Licensed Patio and the indoor portion of the establishment are sufficiently thick and soundproof to ensure that no inside music or sounds can be heard on the Licensed Patio when the doors are closed.

 

g.         There shall be no loitering in and around the entranceway to the Premises.

 

h.         The Licensee shall provide a telephone number which will be answered by a staff member during hours of operation and be equipped with an answering machine when the establishment is closed for residents to register concerns or complaints.

 

i.          The Licensee shall ensure that all areas immediately adjacent to the establishment and the Licensed Patio are clean and free of litter, refuse and other debris.

 

j.          Before applying to change any of the conditions contained herein, the Licensee shall provide written notice to the Ward Councillor.

 

k.         In order to reduce noise impacts, the Licensee shall close all windows of the indoor establishment no later than 11:00 p.m. nightly.

 

2.         City Council request the AGCO to provide the City with an opportunity to participate in any proceedings with respect to the Premises.

 

3.         The City Solicitor be authorized to attend all proceedings before the AGCO in this matter and be directed to take all necessary actions so as to give effect to this Motion, including adding and deleting any of the conditions to be attached to any liquor licence issued for the Premises, in consultation with the Ward Councillor.
