Contest Rules |

 |
- Your entries must comply with the contest rules to qualify.
- Your submission of a photo is your acknowledgement of, and agreement to, the terms and conditions of the contest.
- Photos must be high resolution in JPG or TIFF format, minimum 300 dpi/dots or pixels per inch. Photos can be in color, black and white, sepia tone or duotone and must be taken in Toronto.
- Your photo entries must have been created by you and you must not submit a photo created by someone else. You must be the sole owner of all rights to the photos you submit.
- By entering the contest, you agree to have any of your winning photos and photos that receive honourable mention displayed at City locations and used in City of Toronto print and electronic communication materials, advertising and promotional materials and on the City’s website, for any purpose and at any time in the future, without any fee or other form of compensation.
- You waive all moral rights in any of your winning photos and photos that receive honourable mention.
- In the event that ownership of, or rights to, any photo submitted to the contest is contested in any manner, the City retains the sole discretion to disqualify that photo from the contest and discontinue use of the photo.
- In the event of a dispute regarding who submitted a photo, the photo will be deemed submitted by the authorized account holder of the Flickr account at the time of photo submission. You may be requested to provide the City with proof that you are the authorized account holder.
- You may submit more than one photograph in each category. You can win in more than one category, but can only win one prize in each category.
- The photo subject must be relevant to the photo contest’s theme and the category in which the photo is submitted. Photos must be appropriate for posting on a public government website. Photos that contain obscene, provocative, defamatory, sexually explicit or otherwise objectionable or inappropriate content will not be considered. The City of Toronto will determine, in its sole discretion, what constitutes such content.
- You must obtain a consent or release from all identifiable people in your photo(s) for use of their image in your photo.
- For photos that include identifiable children, your submission must be accompanied by a signed consent form from each child’s parent/legal guardian.
- Participants who have submitted winning/honourable mention photos will be notified at the end of July 2009, approximately. If you are a winner, you will be notified and, upon notification, you must respond within five (5) days of such notification. If you don’t respond within that time, you will be disqualified and will not receive a prize and another contestant may be selected.
- City of Toronto employees, elected officials and the panel of judges may participate in the contest, but cannot win in any of the categories or collect prizes, although they may receive honourable mention.
- The City of Toronto is not responsible for computer system, hardware, software or program malfunctions or other errors, failures, or delayed computer transactions or network connections that affect the contest or your participation in it. Furthermore, the City of Toronto is not responsible for: 1) lost, misdirected, misplaced, illegible, unintelligible, incomplete or late entries or 2) any act, failure to act, or delay regarding the transmitting or processing of entries.
- You acknowledge that the City of Toronto reserves the right, in its sole discretion, to cancel or suspend all or any portion of this contest without notice for any reason whatsoever, without any liability to you for any costs you may have incurred in respect to the contest.
- The City of Toronto is entitled to interpret these rules as required and its decisions are final.
- This contest is subject to all applicable federal, provincial and municipal laws and regulations. These contest rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the contest.
- The City of Toronto reserves the right to disqualify any contestant that it has reason to believe does not comply with the contest rules. If after the awarding of the contest prizes a contest winner is disqualified or determined to be ineligible, an alternate winner will be selected using the same judging process/criteria described above. Alternate winners are subject to all requirements set forth in these rules.
- By participating in the contest, you agree to hold harmless the City of Toronto and its employees, agents and representatives from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest, including infringement of another person’s intellectual property rights. You also release the City of Toronto and its employees, agents and representatives from any responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind you may incur or suffer arising in whole or in part from your participation in this contest.
