Panel Decision

The Toronto Local Appeal Body received presentations from the City Clerk’s Office, Office of the Integrity Commissioner, City Manager’s Office, Duxbury Law firm, City Planning, Court Services, Human Resources and City-Wide Strategic Initiatives, for information.

The Toronto Local Appeal Body received the following presentations:

John Elvidge, Deputy City Clerk, City Clerk’s Office, on City of Toronto board behaviours and how open meeting laws apply to local Boards like TLAB.

Valerie Jepson, Integrity Commissioner, Office of the Integrity Commissioner, on the role of the Integrity Commissioner, the standards of conduct and the relationship with City Council.

Jennifer Franks, Sr. Corporate Mgmt & Policy Consultant, City Manager’s Office, on the background of the Toronto Local Appeal Body, Council requirements to enact, policies and procedures, required policies and guiding principles for the Toronto Local Appeal Body. Jennifer Franks was not in attendance to provide the presentation, however, the presentation was received by the Toronto Local Appeal Body Panel Members as information.

Brian Duxbury, Duxbury Law Trial & Tribunal Lawyers, on the legislative authority for the establishment for the Toronto Local Appeal Body, what matters the Toronto Local Appeal Body may hear, OMB jurisdictions, powers of the Toronto Local Appeal Body, the Toronto Local Appeal Body’s procedural ground rules, the importance of Ontario Regulation 552/06 and the Statutory Powers Procedure Act, Section 45 and Section 53 of the Planning Act and other plan and policy considerations.

Jeffrey Cantos, Project Manager, City Planning, on the Official Plan components, employment areas, neighbourhoods and Planning Act tests.

Klaus Lehman, Manager, City Planning, on the new City-wide Zoning By-Law.

Helen Bulat, Project Manager, City Planning, on the Mediation Pilot Project to resolve minor variance & consent application disputes.

Barry Randell, Director, Court Services, on the overview of the Committee of Adjustment and the OMB, the intersections with the Toronto Local Appeal Body, role of Court Services staff and the use of technology in the adjudicative process.
